No.4251\/2009\n\n              {Gheesa Lal and Ram Chandra Vs.\n              The State of Rajasthan}\n\n         Date of Order ::: 12th August, 2009\n\n                      PRESENT\n     HON'BLE SHRI JUSTICE NARENDRA KUMAR JAIN\n\nShri Ramesh Purohit, Counsel for petitioners\nShri Ashok Prajapat, PP for the State\n                      ####\n\n\nBy the Court:<\/pre>\n<p>              Heard learned counsel for petitioners<\/p>\n<p>as     well    as     learned       Public       Prosecutor   and<\/p>\n<p>perused the material\/case diary made available<\/p>\n<p>to me during the arguments of the case.<\/p>\n<p>        It is contended on behalf of petitioners<\/p>\n<p>that     at     the       time     of      arguments   of     bail<\/p>\n<p>application          of     co-accused-persons,          namely,<\/p>\n<p>Ravindra, Paras and Ramlal in S.B. Cr. Misc.<\/p>\n<p>Bail    Appl.       No.3617\/2009,          the   case-diary   was<\/p>\n<p>summoned which was examined by the Coordinate<\/p>\n<p>Bench of this Court while granting bail under<\/p>\n<p>Section 438 Cr.P.C. to above named three co-<\/p>\n<p>accused-persons; it was observed in the order<\/p>\n<p>dated 7th August, 2009 that injury sustained by<\/p>\n<p>the injured was simple in nature and that was<\/p>\n<p>caused by co-accused Prithvi Raj. The learned<br \/>\n                               \/\/ 2 \/\/<\/p>\n<p>counsel    submits       that      case       of     present      two<\/p>\n<p>petitioners is similar with the case of three<\/p>\n<p>co-accused-persons named above, who have been<\/p>\n<p>granted bail by this Court, therefore, the same<\/p>\n<p>benefit may also be granted to the petitioners.<\/p>\n<p>      The above facts have not been disputed by<\/p>\n<p>the learned Public Prosecutor.\n<\/p>\n<p>      Taking into consideration all the facts<\/p>\n<p>and   circumstances       of      the        case    and    without<\/p>\n<p>expressing       any    opinion         on    its     merits      and<\/p>\n<p>demerits, I allow this bail application under<\/p>\n<p>Section 438 Cr.P.C.\n<\/p>\n<p>      Therefore, the S.H.O.\/I.O. of the Police<\/p>\n<p>Station    Shambhugarh is           directed         that    in   the<\/p>\n<p>event of arrest of the petitioners, namely, (1)<\/p>\n<p>Gheesa Lal S\/o Amba Lal and (2) Ram Chandra S\/o<\/p>\n<p>Sh.    Mishri      Lal    Jat,          Both        Residents      of<\/p>\n<p>Jawanpura, Tehsil Hurda, District Bhilwara, in<\/p>\n<p>FIR No.15\/2009 under Sections 143, 452, 341,<\/p>\n<p>323 and 308, he shall enlarge them on bail,<\/p>\n<p>provided each of them furnishes a personal bond<\/p>\n<p>in the sum of Rs.25,000\/- (Rupees twenty five<\/p>\n<p>thousand       only)   with    one      surety       of    the    like<\/p>\n<p>amount    to    his    satisfaction on              the    following<\/p>\n<p>conditions:-\n<\/p>\n<blockquote><p>      (i) They    shall   make    themselves<br \/>\n          available for interrogation by<br \/>\n          Investigating Officer as and when<br \/>\n          required;\n<\/p><\/blockquote>\n<blockquote><p>                         \/\/ 3 \/\/<\/p>\n<\/blockquote>\n<blockquote><p>       (ii)They   shall   not   directly   or<br \/>\n           indirectly make any inducement,<br \/>\n           threat or promise to any person<br \/>\n           acquainted with the facts of the<br \/>\n           case so as to dissuade him from<br \/>\n           disclosing such facts to the court<br \/>\n           or to any Police officer;\n<\/p><\/blockquote>\n<blockquote><p>       (iii)They   shall  not   leave   India<br \/>\n           without the previous permission of<br \/>\n           the Court.\n<\/p><\/blockquote>\n<blockquote><p>                   (NARENDRA KUMAR JAIN), J.\n<\/p><\/blockquote>\n<p>\/\/Jaiman\/\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Rajasthan High Court &#8211; Jodhpur Gheesa Lal &amp; Anr vs State on 12 August, 2009 \/\/ 1 \/\/ IN THE HIGH COURT OF JUDICATURE FOR RAJASTHAN AT PRINCIPAL SEAT, JODHPUR ORDER In S.B.
