SHAH)<\/p>\n<p>RULE.\n<\/p>\n<p>\tMr.Jayant M. Panchal, learned Special Public Prosecutor waives the<br \/>\n\tservice of notice of rule for the respondents.\n<\/p>\n<p>Present<br \/>\n\tapplication has been filed by the applicant\/ convict ?  original<br \/>\n\taccused named Mohammad Hanif Abdul Razzaq Shaikh for releasing him<br \/>\n\ton temporary bail for a period of four weeks.\n<\/p>\n<p>It<br \/>\n\tis  submitted  by the applicant in the application that the wife  of<br \/>\n\tthe applicant has recently died leaving behind her four minor<br \/>\n\tchildren having their age between 6 and 13 years and there is no one<br \/>\n\t at home who can take care of his children.\n<\/p>\n<p>Mr.Panchal,<br \/>\n\tlearned Special Public Prosecutor appearing for the respondents has<br \/>\n\tsubmitted that the applicant  has been convicted  for the offences<br \/>\n\tpunishable under sections 3(1), 3(3) of the Prevention of Terrorism<br \/>\n\tAct (?SPOTA?? for short) read with secs.120-B  and 307 of Indian<br \/>\n\tPenal Code, under sec.3 of the Prevention of Damages to Public<br \/>\n\tProperty Act, under sec.4 of the Explosive Substances Act  and under<br \/>\n\tsec.135(1) of the Bombay Police Act.  It is submitted  by him that<br \/>\n\tthe applicant is also involved in another case under POTA which is<br \/>\n\tpending  before the POTA Court.\n<\/p>\n<p>He<br \/>\n\thas further submitted that  the applicant has made false statement<br \/>\n\tin the application to the effect that there is nobody who can take<br \/>\n\tcare of his children. It is submitted that  the statement  of the<br \/>\n\tbrother of the applicant is recorded which is placed on record, and<br \/>\n\tas per the said statement, the minor children of the applicant are<br \/>\n\tbeing taken care of by the brother and sister of the applicant. It<br \/>\n\tis also submitted by Mr.Panchal, learned Special Public Prosecutor<br \/>\n\tthat  even the applicant has not disclosed true facts in the<br \/>\n\tapplication  to the effect that earlier when the applicant was<br \/>\n\treleased on temporary bail, he was released  with police escort to<br \/>\n\tattend the funeral ceremony of his wife. It is submitted by him that<br \/>\n\tan order under sec.268 of the Code of Criminal Procedure is passed<br \/>\n\tagainst the applicant by which  an order is passed for conducting<br \/>\n\tthe trial of the accused in jail.  By making above submissions, it<br \/>\n\tis requested to dismiss the present application.\n<\/p>\n<p>Mr.Ansari,<br \/>\n\tlearned advocate appearing on behalf of the applicant is not in a<br \/>\n\tposition to dispute the statement made by the brother of the<br \/>\n\tapplicant  to the effect that the brother and sister of the<br \/>\n\tapplicant  are taking care of the children of the applicant. He has<br \/>\n\talso submitted that there is no deliberate intention  on the part of<br \/>\n\tthe applicant to suppress the fact that earlier the applicant was<br \/>\n\treleased with police escort to attend funeral ceremony of his wife.\n<\/p>\n<p>At<br \/>\n\tthe outset, it is required to be noted that  the applicant has been<br \/>\n\theld guilty and convicted for the offences punishable under sections<br \/>\n\t3(1), 3(3) of the Prevention of Terrorism Act  read with secs.120-B<br \/>\n\tand 307 of Indian Penal Code, under sec.3 of the Prevention of<br \/>\n\tDamages to Public Property Act, under sec.4 of the Explosive<br \/>\n\tSubstances Act  and under sec.135(1) of the Bombay Police Act, and<br \/>\n\tis sentenced  to undergo R.I. for a period of 10 years vide<br \/>\n\tjudgement and order dtd.15\/5\/2006. It is also required to be noted<br \/>\n\tthat the applicant is also involved in another POTA Case which is<br \/>\n\tpending before the POTA Court and in that case he is not enlarged on<br \/>\n\tbail. It is also required to be noted that even an order has been<br \/>\n\tpassed under sec.268 of the Code of Criminal Procedure by which it<br \/>\n\tis ordered to conduct the trial of the applicant in jail. Even<br \/>\n\totherwise, as per the statement of the brother of the applicant<br \/>\n\twhich is on record, the children of the applicant are being taken<br \/>\n\tcare of by the brother and sister of the applicant. Therefore, the<br \/>\n\tstatement of the applicant that there is nobody to take care of his<br \/>\n\tchildren is not correct.\n<\/p>\n<p>For<br \/>\n\tthe reasons stated hereinabove, the applicant cannot be released on<br \/>\n\ttemporary bail. The application deserves to be dismissed and is<br \/>\n\taccordingly dismissed.
