The facts relevant for the purpose of thesewk<\/p>\n<p>petitions are as under:\n<\/p>\n<p>The petitioner in lthez main ica\ufb01\u00e9g is &#8220;accused<br \/>\nNo.9, whereas the petitioner in the connected matter<br \/>\nis accused No.10. in the year 2003, the deceased<br \/>\nand one Krishnamurthyiz were! lassaulted by the<br \/>\nfollowers &#8216;of;-1     that connection,<br \/>\nthe deceased had \u00a7:gesl5~\u00a7\u00a7\u00a7plalnt against the said<br \/>\naccusedi &#8220;ySo y stars &#8220;was [previous enmity between<\/p>\n<p>accused Nofl and the deceased.<\/p>\n<p>.lt is the case of the prosecution that on the<\/p>\n<p>date, cflvthed-incident i.e-, on 26.03.2009, accused<\/p>\n<p>Nos?1;t6tl2_formed an unlawful assembly with deadly<\/p>\n<p>V _weapons like longs, choppers, knives etc. and caused<\/p>\n<p>&#8220;lxthe death of Narasimhamurthy by assaulting him with<\/p>\n<p>d_the=said weapons.\n<\/p>\n<p>3. The petitioners submit that they are<br \/>\ninnocent and they have not committed any crime, much<\/p>\n<p>less the one alleged against them. They have been<\/p>\n<p><span class=\"hidden_text\">34<\/span><\/p>\n<p>5 V &#8211; ,  M<br \/>\n\\. W<br \/>\n31:&#8221; 7; . Hence, he submits that there<\/p>\n<p>is prima facie case agaisnt mthe &#8211;\ufb01etitioners =andg<\/p>\n<p>requests to reject both the petitions}, .d\n<\/p>\n<p>5. I have heard the Jearned connsel for the<\/p>\n<p>petitioners and also the learned Government Pleader.<\/p>\n<p>6. Any<\/p>\n<p>hixhow, his statement was recorded later on 28.03.2009<\/p>\n<p>\u00b0_in which he has stated that accused Nos 1 to 12 have<\/p>\n<p>V&#8221; caused assault with longs, choppers and knives.
