Pathak, AC to GP XI\n                                          -----------\n<\/pre>\n<p>2   25.04.2011             Heard learned counsel for the petitioner and the<\/p>\n<p>                 State.\n<\/p>\n<p>                            The petitioner seeks direction for fixation of revised<\/p>\n<p>                 pay scale of the petitioner according to the 6th Pay Revision<\/p>\n<p>                 and thereafter for fixing his pension along with other<\/p>\n<p>                 admissible consequential benefits with statutory interest, if<\/p>\n<p>                 payable.\n<\/p>\n<p>                            It is submitted on behalf of the petitioner that he has<\/p>\n<p>                 retired as Assistant Teacher on 30.09.2007 from Middle<\/p>\n<p>                 School, Bhalunidham and, thereafter, he represented before<\/p>\n<p>                 the District Superintendent of Education, Rohtas at Sasaram<\/p>\n<p>                 on 17.09.2010 for the grant of aforesaid relief, a copy of<br \/>\n<span class=\"hidden_text\">                         2<\/span><\/p>\n<p>     which has been appended as Annexure 1, however, nothing<\/p>\n<p>     has been communicated to him as yet. Thus, it is contended<\/p>\n<p>     that the authorities may be directed to take a decision upon the<\/p>\n<p>     aforesaid representation filed by the petitioner.<\/p>\n<p>               Learned counsel for the State raises no objection to<\/p>\n<p>     that.\n<\/p>\n<p>               As a result, this writ application is disposed of with<\/p>\n<p>     a direction to the respondent no. 3, the District Superintendent<\/p>\n<p>     of Education, Rohtas at Sasaram, to take a decision upon the<\/p>\n<p>     representation of the petitioner in accordance with law within<\/p>\n<p>     a period of two months from the date of filing of fresh<\/p>\n<p>     representation along with a copy of this order and such<\/p>\n<p>     decision taken upon the representation of the petitioner should<\/p>\n<p>     be communicated to him. The petitioner would be at liberty to<\/p>\n<p>     raise all the points which he has taken in this application. It is<\/p>\n<p>     also made clear that if the petitioner&#8217;s claim is found to be<\/p>\n<p>     correct and a decision is taken for payment of some amount,<\/p>\n<p>     the same should be paid to him within three months from the<\/p>\n<p>     date such decision taken by the respondent no. 3.
