2. The facts.reievant ion the nurpose of this<\/p>\n
revision are as under:\n<\/p>\n
The ;esA;3iojnd;$-‘\u00e9n\u00abt ‘i:s’u_the_’ owner of the autorickshaw
\nbearing A’P.eq._ z4o’.’I<3i~–2'5,!\u00a7ii;4\u00ab2"367. On 18.03.2001 at about<\/p>\n
10 p,m,. thei seidi-antorickshaw was driven by one<\/p>\n
it\ufb02ri;Chandrashekar\u00a7 """ "i The PSi., Dharwad Town Police<\/p>\n
tetopned the autorickshaw and found a passenger by name<\/p>\n
nhottiea;W;Qhioh was being transported without any
\nipe;mi:\u00ab\u00a7} authority. The autorickshaw and the liquor\n<\/p>\n
-fwere seized and thereafter an investigation was held
\nn\ufb01and the charge sheet was filed against the driver and<\/p>\n
[also the passenger. The Deputy Commissioner, who is<\/p>\n
Eshweri Ainritxwho possessed a bag containing liquor<\/p>\n
the Authorised Officer, issued a show~cause netice te
\nthe respondent herein, calling upon him to shee\u00a5eeuse<\/p>\n
as te why the autorickshaw should not \ufb01e \u00e9\u00e9\ufb01gi\u00e9eaied<\/p>\n
to the State. The respondent herein \u00e9peeered eerdr\u00e9p,
\nthe Deputy Cemmissioner and centended\ufb02tnet he ted n\u00a7*.5

indulged in the transportatien of thevtiqnorg<\/p>\n
During the enqniry, lthew Witnesses P.Ws.1 and 2
\nwere examined, decumente Exs.R1 te 3 were marked and
\nafter hearing} the Deputy Cemmiesioner Vide his Order<\/p>\n
dated 23.12r2Q\u00a24i eonfieceted the autorickshaw of the<\/p>\n
respondent_nereinf_ A\ufb01grieved by the said Order, the
\nrespondent *p;eret:ed r\u00a7\ufb01* appeal in Crl.A. No.4\/2065<\/p>\n
before ,the iPri;-tseesiens Judge and the said appeal<\/p>\n
iicame\ufb02teybe*eiiowed”end the Order of confiscation was<\/p>\n
inetVeside\u20actnAdgrieved by the Judgment and Order of the<\/p>\n

4. The perusai of the evidence of P.Ws.i and 2<\/p>\n
does not reveal anything as regards the knowledge of<\/p>\n
the owner of the autorickshaw about the tran\u00e9gortatien<\/p>\n
of the liquor either by the passenger or the driver oft”<\/p>\n

Judge on going through the eyidenoe of the yitneesee,
\nconcluded that the witne\u00a7ees_ he\ufb01ej not’ whieoered
\nanything about the ‘iiouotdmheihg\ufb02dtrensoorted in the
\nautorickshaw, with thet hno\ufb01iedge hot \u00bbthe registered
\nowner. In the ehsenee of the kno\ufb01iedge of the owner<\/p>\n
regarding the “trenspo\u00a3tetiog” of’ the liquor in his
\nautorickSh\u00e9w,i<\/p>\n

\nautoriokshe\ufb01 ‘cannot *hegioonfiscated. It. is in that<\/p>\n
view of the hatter that the iearned Qrinoipai Sessions<\/p>\n
._Judg\u00a7@\u00a7;lowed the eppeal of the respondent by setting<\/p>\n
‘(aside the confiscation. I do not find any error or<\/p>\n
