JUSTICE SABINA\n\nPresent:      Mr.S.S.Brar, Advocate,\n              for the petitioners.\n                           ****\n\nSABINA, J.\n<\/pre>\n<p>              The petitioners have filed this petition under Section 482<\/p>\n<p>of the Code of Criminal Procedure for issuance of             directions to<\/p>\n<p>respondent Nos. 1 to 3 to register FIR against the private<\/p>\n<p>respondents under the appropriate provisions of law for having<\/p>\n<p>committed serious offence of fabricating false documents, tempering<\/p>\n<p>with the record, trespassing and also threatening them for being<\/p>\n<p>eliminated.\n<\/p>\n<p>              It has been held by the Apex Court in <a href=\"\/doc\/1836621\/\">Sakiri Vasu vs.<\/p>\n<p>State of U.P. and others<\/a>, 2008 (1) RCR (Criminal) 392 as under:-<\/p>\n<blockquote><p>              &#8220;24. In view of the above mentioned legal position, we are<\/p>\n<p>              of the view that although Section 156(3) is very briefly<\/p>\n<p>              worded, there is an implied power in the Magistrate under<\/p>\n<p>              Section 156(3) Cr.P.C. to order registration of a criminal<\/p>\n<p>              offence and\/or to direct the officer in charge of the<br \/>\n Crl. Misc. No. M- 3998 of 2009 (O&amp;M)                -2-\n<\/p><\/blockquote>\n<p>concerned police station to hold a proper investigation<\/p>\n<p>and take all such necessary steps that may be necessary<\/p>\n<p>for ensuring a proper investigation including monitoring<\/p>\n<p>the same.    Even though these powers have not been<\/p>\n<p>expressly mentioned in Section 156(3) Cr.P.C., we are of<\/p>\n<p>the opinion that they are implied in the above provision.<\/p>\n<p>25.We have elaborated on the above matter because we<\/p>\n<p>  often find that when some one has a grievance that his<\/p>\n<p>  FIR has not been registered at the police station and\/or<\/p>\n<p>  a proper investigation is not being done by the police,<\/p>\n<p>  he rushes to the High Court to file a writ petition or a<\/p>\n<p>  petition under Section 482 Cr.P.C. We are of the<\/p>\n<p>  opinion that the High Court should not encourage this<\/p>\n<p>  practice and should ordinarily refuse to interfere in such<\/p>\n<p>  matters, and relagate the petitioner to his alternating<\/p>\n<p>  remedy, firstly under Section 154 (3) and Section 36<\/p>\n<p>  Cr.P.C. before the concerned police officers and if that<\/p>\n<p>  is of no avail, by approaching the concerned Magistrate<\/p>\n<p>  under Section 156 (3).\n<\/p>\n<p>26. If a person has a grievance that his FIR has not been<\/p>\n<p>  registered by the police station his first remedy is to<\/p>\n<p>  approach the Superintendent of Police under Section<\/p>\n<p>  154 (3) Cr.P.C. or other police officer referred to in<\/p>\n<p>  Section   36   Cr.P.C.   If   despite   approaching     the<\/p>\n<p>  Superintendent of Police or the officer referred to in<\/p>\n<p>  Section 36 his grievance still persists, then he can<\/p>\n<p>  approach a Magistrate under Section 156 (3) Cr.P.C.\n<\/p>\n<p>              Crl. Misc. No. M- 3998 of 2009 (O&amp;M)                -3-\n<\/p>\n<p>             instead of rushing to the High Court by way of a writ<\/p>\n<p>             petition or a petition under Section 482 Cr.P.C.<\/p>\n<p>             Moreover he has a further remedy of filing a criminal<\/p>\n<p>             complaint under Section 200 Cr.P.C.
