Justice C.T.RAVIKUMAR\n\n Dated :05\/05\/2009\n\n O R D E R\n                         C.T.RAVIKUMAR, J.\n                   -------------------------------------------\n                 B.A.Nos.2338, 2345, 2353 &amp;\n                          2354 of 2009\n                  ------------------------------------------\n               Dated, this the 5th    day of May, 2009\n\n                              ORDER\n<\/pre>\n<p>              Petitioners who are accused in Crime Nos.501 of<\/p>\n<p>2008, 5 of 2009, 1 of 2009 and 18 of 2009 respectively of the<\/p>\n<p>Bekkal Police Station, Kasaragod, for offences punishable under<\/p>\n<p>Sections 406 and 420 of the Indian Penal Code have filed these<\/p>\n<p>applications for anticipatory bail.\n<\/p>\n<p>            2.    The learned Public Prosecutor opposed the<\/p>\n<p>applications contending that earlier they have been given an<\/p>\n<p>order permitting them to surrender before the investigating<\/p>\n<p>officer as evidenced by Annexure II. However, the counsel for<\/p>\n<p>the petitioners prays that they may be given time to surrender<\/p>\n<p>before the investigating officer. In a case of this nature there<\/p>\n<p>cannot be any question of granting anticipatory bail. However,<\/p>\n<p>I am inclined to permit the petitioners to surrender before the<\/p>\n<p>investigating officer for the purpose of interrogation and to<\/p>\n<p>move application for bail for consideration by the Magistrate<\/p>\n<p>having jurisdiction especially in the light of Annexure II order.<\/p>\n<p>            3.        Petitioners shall surrender before the<\/p>\n<p>B.A.No.2338 of 2009, etc.<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>investigating officer on any day between 11.5.2009 and<\/p>\n<p>14.5.2009 for the purpose of interrogation and recovery of<\/p>\n<p>incriminating materials, if any.
