Justice P.R.RAMACHANDRA MENON\n\n Dated :27\/01\/2010\n\n O R D E R\n                    P.R.RAMACHANDRA MENON, J\n                 -----------------------------\n                       W.P(C) No.2467 of 2010-G\n                 ------------------------------\n              Dated this the 27th day of January, 2010.\n\n                        J U D G M E N T\n<\/pre>\n<p>      Challenging the order passed by the second respondent<\/p>\n<p>determining the contribution payable by the petitioner under the<\/p>\n<p>relevant provisions of the Kerala Toddy Workers&#8217; Welfare Fund Act,<\/p>\n<p>the petitioner has preferred statutory appeal under Section 8(5) of<\/p>\n<p>the Act before Government, which is stated as pending. However, in<\/p>\n<p>view of the coercive steps being pursued in the meanwhile, the<\/p>\n<p>petitioner had also sought for an interim stay, which was granted by<\/p>\n<p>the first respondent as per Ext.P4 order, subject to the condition<\/p>\n<p>that the petitioner remitted 25% of the assessed amount within one<\/p>\n<p>month from the date of receipt of the order.\n<\/p>\n<p>      2.   The learned counsel for the petitioner submits that the<\/p>\n<p>petitioner had approached the second respondent with the amount<\/p>\n<p>to satisfy the condition imposed by the Government\/appellate<\/p>\n<p>authority vide Ext.P4. But the same was not accepted by the second<\/p>\n<p>respondent stating that they have already forwarded necessary<\/p>\n<p>requisition to the revenue authorities. This in turn was followed by<\/p>\n<p><span class=\"hidden_text\">W.P(C) No.2467 of 2010-G           2<\/span><\/p>\n<p>Ext.P6 notice issued by the third and fourth respondents under the<\/p>\n<p>Revenue Recovery Act, which are sought to be intercepted by this<\/p>\n<p>Court.\n<\/p>\n<p>       3.    Heard the learned Government Pleader appearing for the<\/p>\n<p>respondents 1, 3 and 4 and also the learned standing counsel, who<\/p>\n<p>entered appearance on behalf of the second respondent. In view of<\/p>\n<p>the nature of relief proposed to be given, this Court does not find it<\/p>\n<p>necessary to issue notice to the fifth and sixth respondents.<\/p>\n<p>       4.    In the above facts and circumstances, the second<\/p>\n<p>respondent is directed to accept the payment to be tendered by the<\/p>\n<p>petitioner in compliance with Ext.P4, if the same is deposited within<\/p>\n<p>two weeks, subject to which, all further proceedings pursuant to<\/p>\n<p>Ext.P6 shall be kept in abeyance. Considering the submission made<\/p>\n<p>from the part of the petitioner that the statutory appeal preferred by<\/p>\n<p>the petitioner has already posted for hearing before the first<\/p>\n<p>respondent on 10.3.2010, there will be a direction to the first<\/p>\n<p>respondent to have the matter considered and finalized in<\/p>\n<p>accordance with law, as expeditiously as possible, at any rate within<\/p>\n<p>three months from the date of receipt of a copy of the judgment.<\/p>\n<p>However, it is made clear that, if the petitioner satisfies the<\/p>\n<p><span class=\"hidden_text\">W.P(C) No.2467 of 2010-G           3<\/span><\/p>\n<p>condition imposed by the Government while granting interim stay<\/p>\n<p>vide Ext.P4, the stay will continue till finalization of the appeal as<\/p>\n<p>above.\n<\/p>\n<p>       The Writ Petition is disposed of as above.\n<\/p>\n<\/p>\n<p>                                   P.R.RAMACHANDRA MENON<br \/>\n                                         JUDGE<\/p>\n<p>ab<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court R.Sundaresan vs State Of Kerala on 27 January, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 2467 of 2010(G) 1.
