Kapoor, J. (Presiding Member)<\/p>\n<p>1. Heard the learned Counsel for the petitioner.\n<\/p>\n<p>2. In filing this revision petition, there is delay of 187 days. There is an application for condonation of delay without there being any affidavit. The petitioner did not appear before the State Commission and the State Commission decided the matter on the basis of the written arguments. The order waspassed on 26th April, 2004. He claims that he has come to know about the impugned order only on 26th November, 2004. He applied for a certified copy of the order and he was wrongly informed that there was no time limit to file revision petition in the National Commission against the impugned order. From the certified copy of the order of the State Commission, it is apparent that he applied for certified copy on 25th November, 2004 while he was resident of Vidisha. Unless and until he came to know it earlier he could not have applied for the same on 24th November, 2004. Secondly we feel that the delay has not been satisfactorily explained and it is not delay of few weeks but over six months delay.\n<\/p>\n<p>3. The application for condonation of delay is accordingly dismissed.\n<\/p>\n<p>4. Now, coming to the merits, the complainant-petitioner prayed for shifting of high tension line which was passing through over the plot of the complainant. High tension line is supposed to pass over one or the other plot. If everybody wanted to shift the high tension line from his plot then it would be difficult for any Electricity Board to supply electricity. In this case the M.P. Electricity Board has agreed to shift the high tension line passing through over the plot of the complainant at the cost of the complainant. The complainant deposited the amount. High tension line passing through over his plot was shifted. It took some time and later on the complainant filed the complaint for refund of the deposited amount of Rs. 19,145. The complainant has taken advantage of shifting of the line. Value of his plot has gone up. It was one of the conditions to shift the line but despite these, the State Commission has shown indulgence and awarded the compensation of Rs. 500.\n<\/p>\n<p>5. In the aforementioned circumstances, we think that there is no force in this revision petition for enhancement of compensation on any cost and it is dismissed accordingly.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>National Consumer Disputes Redressal Amrit Lal vs M.P.
