RAMKUMAR, J.\n\n                           - - - - - - - - - - - - - - - - -\n\n                 BAIL APPLICATION NO.  646  OF 2007\n\n               - - - - - - - - - ----------------------- - - - - - -\n\n             DATED THIS THE 6th  DAY OF FEBRUARY, 2007\n\n\n                                    O R D E R\n<\/pre>\n<p>         Petitioner   seeks   anticipatory   bail   on   the   allegation   that   the<\/p>\n<p>Kasaba   Police,   Kozhikode   are   at   his   heels   in   connection   with   Crime<\/p>\n<p>No.28\/07  registered for an offence punishable under section 41(1)(d)<\/p>\n<p>Cr.P.C.\n<\/p>\n<\/p>\n<p>       2.     Learned   Public   Prosecutor   opposed   the   application<\/p>\n<p>submitting, inter alia, that the above crime now stands registered for<\/p>\n<p>an offence punishable under section 380 read with section 34 IPC and<\/p>\n<p>that   the   petitioner   and   other   accused   committed   theft   of   wooden<\/p>\n<p>frames   from   a   workshop   and   accused   1   to   3   were   arrested   and   4th<\/p>\n<p>accused who was sitting in the vehicle made good his escape thereby<\/p>\n<p>averting his arrest.\n<\/p>\n<\/p>\n<p>       3.     I am not inclined to grant anticipatory bail to the petitioner.<\/p>\n<p>I   am,   however,   inclined   to   give   the   petitioner   an   opportunity   to<\/p>\n<p>surrender   before   the   Investigating   officer   and   then   to   have   his<\/p>\n<p>application   for   bail   considered   by   the   Magistrate   expeditiously.<\/p>\n<p>Accordingly,   the   petitioner   shall   surrender   before   the   Investigating<\/p>\n<p>Officer on any day between 7.2.2007 and 9.2.2007 for the purpose of<\/p>\n<p>interrogation.
