No. 1429 of 2009\n                     * * * * * * * * * * * * * * * *\n                        Dated: 30-04-2009\n\n                               ORDER\n<\/pre>\n<p>     The accused in S.T. No. 1275 of 2005 on the file of the<\/p>\n<p>J.F.C.M.I, Kottayam,     for an offence punishable under Section<\/p>\n<p>138 of the Negotiable Instruments Act, 1881, challenges the<\/p>\n<p>conviction entered and the sentence passed against him<\/p>\n<p>concurrently by the courts below.\n<\/p>\n<p>     2.    Pending this revision, the parties have settled the<\/p>\n<p>matter.   Crl.M.A.No. 4322 of 2009 has been filed under<\/p>\n<p>Section 147 of the Negotiable Instruments Act, 1881 seeking<\/p>\n<p>permission to record the composition entered into between the<\/p>\n<p>revision petitioner and the complainant. The said petition has<\/p>\n<p>been signed by both the revision petitioner as well as the<\/p>\n<p>complainant and their respective counsels. In the light of this<\/p>\n<p>development, the aforementioned composition is recorded and it<\/p>\n<p>will have the effect of an acquittal of the revision petitioner<\/p>\n<p>within the meaning of Sec. 320 (8) Cr.P.C. The petitioner shall<\/p>\n<p>be released from prison forthwith, unless his continued<\/p>\n<p>detention is found necessary in connection with any other<\/p>\n<p>case against him.\n<\/p>\n<p>     Registry   shall        communicate         this order  to  the<\/p>\n<p>Superintendent,     Sub Jail, Kollam where the          petitioner is<\/p>\n<p>housed.\n<\/p>\n<p>     This Crl.
