Justice K.M.JOSEPH\n\n Dated :11\/01\/2008\n\n O R D E R\n                       H.L.DATTU, C.J. &amp; K.M.JOSEPH, J.\n                             ------------------------------------------\n                   W.P.(C) Nos.36564, 37144 &amp; 38008 of 2007\n                             ------------------------------------------\n                       Dated, this the 11th day of January, 2008\n\n                                     JUDGMENT\n<\/pre>\n<p>H.L.Dattu, C.J.\n<\/p>\n<p>        Though these matters are posted in the petition list, by consent of the<\/p>\n<p>learned counsel appearing for the parties to the lis, the matters are taken up<\/p>\n<p>for final hearing.\n<\/p>\n<p>        2.   Petitioners in these writ petitions are granted            licence by the<\/p>\n<p>Department of Telecommunications, Government of India for conducting<\/p>\n<p>Cellular Mobile operations in various States including the State of Kerala.<\/p>\n<p>        3. In these petitions filed under Article 226 of the Constitution, the<\/p>\n<p>petitioners call in question the correctness or otherwise of the demand notices<\/p>\n<p>issued by the respondents in the writ petitions, inter alia, demanding the<\/p>\n<p>petitioners to pay the arrears of electricity charges pursuant to a Circular issued<\/p>\n<p>by the Board.\n<\/p>\n<p>        4. The primary contention of the petitioners and their learned counsel is<\/p>\n<p>that the demand notice was not preceded by a show cause notice and<\/p>\n<p>therefore, the demand notice so issued               is not only arbitrary, but also in<\/p>\n<p>violation of the principles of natural justice.<\/p>\n<p>        5. Sri.C.E.Unnikrishnan, learned counsel appearing for the respondent<\/p>\n<p>Board would submit that, for the present, the demand notices so issued by the<\/p>\n<p>respondents may be treated as show cause notices by the petitioners and file<\/p>\n<p>their objections, if any, to the said demand notices treating it as show cause<\/p>\n<p>notices and if such objections are filed, the respondents will consider those<\/p>\n<p>objections and pass appropriate orders.\n<\/p>\n<p>W.P.(C) No.36564\/2007, etc.<br \/>\n<span class=\"hidden_text\">                                               2<\/span><\/p>\n<p>        6. In view of this understanding between the learned counsel appearing<\/p>\n<p>for the parties to the lis, without going into the other details of the writ petitions,<\/p>\n<p>we dispose of the same as under:\n<\/p>\n<p>                                       ORDER<\/p>\n<p>        i) The petitioners shall treat the demand notices issued by the<\/p>\n<p>respondents directing them to pay the arrears of electricity charges, as show<\/p>\n<p>cause notices.\n<\/p>\n<p>        ii) The petitioners, if they so desire, file their objections to the said<\/p>\n<p>demand notices\/show cause notices within a period of 15 days from today.<\/p>\n<p>        iii) The respondent Board shall consider the objections that may be filed<\/p>\n<p>by the petitioners within the time granted by this Court, within 15 days thereafter<\/p>\n<p>and also afford an opportunity of hearing to the petitioners and thereafter issue<\/p>\n<p>appropriate demand notices.\n<\/p>\n<p>        iv) All the contentions of both the parties are left open.<\/p>\n<p>        Ordered accordingly.\n<\/p>\n<\/p>\n<p>                                                             (H.L.DATTU)<br \/>\n                                                          CHIEF JUSTICE<\/p>\n<p>                                                             (K.M.JOSEPH)<br \/>\n                                                                JUDGE<br \/>\nvns<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court M\/S.Idea Mobile Communications &#8230; vs Kerala State Electricity Board on 11 January, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C) No. 36564 of 2007(C) 1.
