Justice K.HEMA\n\n Dated :20\/01\/2009\n\n O R D E R\n                            K.HEMA, J.\n\n                -----------------------------------------\n                        B.A.No.7751 of 2008\n                -----------------------------------------\n\n              Dated this the 20th January, 2009\n\n                             O R D E R\n<\/pre>\n<p>     This petition is for anticipatory bail.<\/p>\n<p>     2. The alleged offences are under Section 55(a) and (h)<\/p>\n<p>of the Abkari Act. According to prosecution, first accused was<\/p>\n<p>found in possession of 28.120 litres of Indian made foreign<\/p>\n<p>liquor on 11.11.2008 and he was arrested from the spot. On<\/p>\n<p>investigation, it is revealed that accused 2 to 4 entrusted the<\/p>\n<p>said article to the first accused for sale.<\/p>\n<p>     3. Petitioner is second accused in the crime. Learned<\/p>\n<p>counsel for petitioner submitted that the only allegation as per<\/p>\n<p>the prosecution case is that petitioner gave a glass to first<\/p>\n<p>accused. But, it will not constitute any offence and hence,<\/p>\n<p>anticipatory bail may be granted.\n<\/p>\n<p>     4. This petition is opposed. Learned Public Prosecutor<\/p>\n<p>submitted that as per the case diary, the information received<\/p>\n<p>is that accused 2 to 4 have given the contraband article to first<\/p>\n<p>accused for the purpose of sale and the said fact is<\/p>\n<p><span class=\"hidden_text\">  BA.7751\/08                      2<\/span><\/p>\n<p>investigated into. Therefore, it is not a fit case to grant<\/p>\n<p>anticipatory bail.\n<\/p>\n<p>     5. On hearing both sides, I am satisfied that it may not be<\/p>\n<p>proper to grant anticipatory bail to petitioner, when a crucial<\/p>\n<p>allegation is being investigated into, since it is likely to affect<\/p>\n<p>investigation     adversely.    Petitioner   is   required      for<\/p>\n<p>interrogation.\n<\/p>\n<p>               Hence, petitioner is directed to surrender<\/p>\n<p>          before the investigating officer without any<\/p>\n<p>          delay and co-operate with the investigation.<\/p>\n<p>          Whether he surrenders or not, police is at<\/p>\n<p>          liberty to arrest him and proceed in accordance<\/p>\n<p>          with law.\n<\/p>\n<p>     With this direction, petition is dismissed.<\/p>\n<p>                                  K.HEMA, JUDGE<br \/>\nvgs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Joseph Dellus vs The Sub Inspector Of Police on 20 January, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 7751 of 2008() 1.
