No.30397 of 2010\n      DEEPAK DAS @ CHIRAG JI @ CHIRAJ S\/O LAKHAN DAS\n                            Versus\n                    THE STATE OF BIHAR\n                           -----------\n<\/pre>\n<p>3.   24.09.2010             Heard learned Counsel for the petitioner<\/p>\n<p>                  and the State.\n<\/p>\n<p>                           The petitioner seeks bail in a case instituted<\/p>\n<p>                  for the offence under Sections 302, 307, 323, 324,<\/p>\n<p>                  427, 379\/34 of the Indian Penal Code and 27 of the<\/p>\n<p>                  Arms Act, 3\/4 Explosive Substance Act and under<\/p>\n<p>                  Section 17 of the C.L.A. Act.\n<\/p>\n<p>                           It has been submitted that the petitioner is<\/p>\n<p>                  not named in the First Information Report and<\/p>\n<p>                  subsequently     his    name     transpired     during<\/p>\n<p>                  investigation but without any specific overt act and<\/p>\n<p>                  other co-accused persons when put on trial were<\/p>\n<p>                  acquitted of charges.\n<\/p>\n<p>                           Considering the same, let the petitioner<\/p>\n<p>                  above named, be released on bail on furnishing bail<\/p>\n<p>                  bond of Rs. 5,000\/-(Five thousand) with two sureties<\/p>\n<p>                  of the like amount each or any other surety to be<\/p>\n<p>                  fixed by the court concerned to the satisfaction of<\/p>\n<p>                  Additional Session Judge Ist Munger in connection<br \/>\n<span class=\"hidden_text\">                 2<\/span><\/p>\n<p>with Kharagpur P.S. Case No. 4\/2005 (S.C. No.<\/p>\n<p>584\/09) subject to the conditions, (i) That one of the<\/p>\n<p>bailor will be a close relative of the petitioner who will<\/p>\n<p>give an affidavit giving genealogy as to how he is<\/p>\n<p>related with the petitioner and the other bailor shall<\/p>\n<p>be the father of the petitioner. The bailor will<\/p>\n<p>undertake to furnish information to the Court about<\/p>\n<p>any change in address of the petitioner. (ii) That the<\/p>\n<p>bailor shall also state on affidavit that he will inform<\/p>\n<p>the court concerned if the petitioner is implicated in<\/p>\n<p>any other case of similar nature after his release in<\/p>\n<p>the present case and thereafter the court below will<\/p>\n<p>be at liberty to initiate the proceeding for cancellation<\/p>\n<p>of bail on ground of misuse, (iii) That the petitioner<\/p>\n<p>will give an undertaking that he will receive the police<\/p>\n<p>papers on the given date and be present on date fixed<\/p>\n<p>for charge and if he fails to do so on two given dates<\/p>\n<p>and delays the trial in any manner, his bail will be<\/p>\n<p>liable to be cancelled for reasons of misuse, (iv) That<\/p>\n<p>the petitioner will be well represented on each date if<\/p>\n<p>he fails to do so on two consecutive dates, his bail<\/p>\n<p>will be liable to be cancelled, (v) In view of the<\/p>\n<p>antecedents of the petitioner, the petitioner is<br \/>\n<span class=\"hidden_text\">                          3<\/span><\/p>\n<p>         directed to appear before the Superintendent of<\/p>\n<p>         Police, Munger within fifteen days of his release with<\/p>\n<p>         a copy of this order and every two weeks thereafter<\/p>\n<p>         for the next one year. The conduct of the petitioner<\/p>\n<p>         will be kept under watch in this period by the<\/p>\n<p>         superintendent of Police concerned and if it is found<\/p>\n<p>         wanting in any respect, a report shall be made to the<\/p>\n<p>         court concerned by him to initiate a proceeding for<\/p>\n<p>         cancellation of bail for reasons of misuse of bail. After<\/p>\n<p>         reporting to the Superintendent of Police, a certificate<\/p>\n<p>         will be filed by the petitioner before the court<\/p>\n<p>         concerned.\n<\/p>\n<p>                  The    magistrate     shall   scrutinize    the<\/p>\n<p>         documents of the petitioner and bailor so that there<\/p>\n<p>         is no confusion about their identity on a later stage.<\/p>\n<pre>Fahad.
