AREA EDUCATION OFFICER, HILSA, NALANDA.\n                                              ..................RESPONDENTS.\n                                 -----------\n<\/pre>\n<p>4   07.09.2010            When the case was taken up by this Court on<\/p>\n<p>                 28.08.2009 i.e. almost a year back, this Court noticed<\/p>\n<p>                 that while allowing the appeal of the petitioner the<\/p>\n<p>                 Appellate Authority has remitted the matter back to the<\/p>\n<p>                 disciplinary authority for passing fresh orders within a<\/p>\n<p>                 period of six months.\n<\/p>\n<p>                          The grievance of the petitioner was that<\/p>\n<p>                 inspite of the said remand order of the Appellate<\/p>\n<p>                 Authority dated 30.03.2007, the disciplinary authority<\/p>\n<p>                 had not passed the order till now. This Court, therefore,<\/p>\n<p>                 allowed time to learned counsel for the respondents to<\/p>\n<p>                 file a counter affidavit on behalf of the Deputy<\/p>\n<p>                 Development Commissioner, Nalanda respondent no.5<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>          assigning reason for pendency of the proceeding before<\/p>\n<p>          him for such a long time. It is almost one year, but no<\/p>\n<p>          counter affidavit has been filed.\n<\/p>\n<p>                    Learned counsel for the respondents prays for<\/p>\n<p>          another adjournment.\n<\/p>\n<p>                    The prayer is refused.\n<\/p>\n<p>                    Since there is nothing on record to show that<\/p>\n<p>          the disciplinary authority has passed orders even after<\/p>\n<p>          passage of more than two years from the order of the<\/p>\n<p>          Appellate Authority dated 30.03.2007, by which, it was<\/p>\n<p>          directed to pass a speaking\/reasoned order in the<\/p>\n<p>          proceeding within six months, it is directed that if till<\/p>\n<p>          today no final orders have been          passed in the<\/p>\n<p>          proceeding by the disciplinary authority upon remand<\/p>\n<p>          from the Appellate Authority, the entire proceeding<\/p>\n<p>          against the petitioner shall stand quashed. As a<\/p>\n<p>          consequence, the punishment order shall stand wiped<\/p>\n<p>          out and the petitioner shall be entitled to all the<\/p>\n<p>          consequential benefits.\n<\/p>\n<p>                    The writ application is allowed with the<\/p>\n<p>          aforesaid observations and directions.<\/p>\n<pre>Arvind\/                         ( J.
