Ltd and his service was<br \/>\n\tterminated.  Thereafter, &#8220;T&#8221; application was filed by<br \/>\n\tpetitioner under section 78\/79 of Bombay Industrial Relation Act<br \/>\n\tbeing registered no. 224\/197 before Labour Court, Ahmedabad.  The<br \/>\n\tLabour Court, Ahmedabad has passed an order on 21\/9\/2001 granting<br \/>\n\treinstatement with full back wages of interim period.  The said Unit<br \/>\n\ti.e. Raipur Manufacturing Co. Ltd went into liquidation on<br \/>\n\t15\/10\/2001. Therefore, Recovery Application no. 449\/2007 was filed,<br \/>\n\twherein order has been passed to recover amount from respondent on<br \/>\n\t4\/9\/2008. Thereafter, petitioner has preferred Company Application<br \/>\n\tno. 34\/2009 in Company Petition no. 114\/2001, in which, Company<br \/>\n\tCourt had ordered on 23\/7\/2009. There was a Contempt Application<br \/>\n\tbeing OJMCA no. 14\/2010 in Company Application no. 34\/2010 in<br \/>\n\tCompany Petition no. 14\/2010. The Chartered Accountant presented his<br \/>\n\treport on 5\/1\/2010 for claims and dues of present petitioner. The<br \/>\n\tpetitioner had served notice to Official Liquidator for recovering<br \/>\n\tof eighteen months wages on 2\/7\/2010.  The petitioner was replied by<br \/>\n\tother side to approach Industry Disputes Center, Bachat Bhavan,<br \/>\n\tAhmedabad.  Therefore, petitioner has forwarded claim to Industry<br \/>\n\tDispute Center.\n<\/p>\n<p>According<br \/>\n\tto petitioner, several oral and written representations were made to<br \/>\n\tIndustry Disputes Center, which were turned down without any result.<br \/>\n\t The petitioner was firstly replied that incharge person was on<br \/>\n\tleave.  Then he was stated that amount would be disbursed, he need<br \/>\n\tnot to come again and again and when he served another notice on<br \/>\n\t13\/12\/2010 and approached Industry Dispute Center, Manager it was<br \/>\n\tstated that he shall not be paid a single penny and take legal<br \/>\n\trecourse.\n<\/p>\n<p>Therefore,<br \/>\n\tthis petition is filed by petitioner for claiming eighteen months<br \/>\n\twages based on order passed by Labour Court in &#8220;T&#8221;<br \/>\n\tApplication no. 224\/1997 dated 21\/9\/2001.  The Labour Court has set<br \/>\n\taside termination order granting reinstatement with full back wages<br \/>\n\tof interim period.  The notice issued by learned advocate Mr. Shah<br \/>\n\tto Official Liquidator on 2\/7\/2010 and supplying certain documents<br \/>\n\tin respect to date of joining of petitioner in Mill, wages received<br \/>\n\ton the date of closure of Mill and birth Certificate of petitioner.<br \/>\n\tOn 19\/3\/2010, an approach was made by petitioner to Industry<br \/>\n\tDisputes Center but there was no response given by respondent no. 1.<br \/>\n\t It is necessary to note that very petitioner Ashokbhai Narandas<br \/>\n\tBundela approached to Company Court in Company application no. 34\/09<br \/>\n\tin Company petition no. 114\/2001, wherein this Court has passed an<br \/>\n\torder on 23\/7\/2009, which is relevant, therefore, quoted as under:\n<\/p>\n<p>The<br \/>\n\tpresent application has been preferred by the applicant seeking<br \/>\n\tprayer to direct the OL to disburse the amount of Rs.4,21,000\/-.\n<\/p>\n<p>Heard<br \/>\n\tMr. Shah for the applicant and Mr.Yadav for the OL.\n<\/p>\n<p>Upon<br \/>\n\thearing the learned Advocate appearing for both the sides, it<br \/>\n\tappears that the Company was ordered to be wound up on 15.10.2001 as<br \/>\n\tstated by Mr.Yadav during the course of the hearing. It also appears<br \/>\n\tthat the applicant preferred the Application T. No. 224\/97 before<br \/>\n\tthe Labour Court seeking reinstatement against the termination.  The<br \/>\n\tLabour Court has passed the Award on 22.09.2001 prior to the date of<br \/>\n\twinding up of the Company, whereby the applicant has been ordered to<br \/>\n\tbe reinstated with full backwages.  Therefore, when the Labour Court<br \/>\n\tpassed the Award, the Company was not ordered to be wound up and<br \/>\n\ttherefore the applicant would be entitled to the benefit as may be<br \/>\n\tavailable as per the said Award of the Labour Court dated 21.09.2001<br \/>\n\tin T.No.224\/97.\n<\/p>\n<p>It<br \/>\n\talso appears that thereafter, the applicant, based on the Award of<br \/>\n\tthe Labour Court, filed further Recovery Application No.449\/07<br \/>\n\twithout express leave of the Company Court and it also appears that<br \/>\n\tthe order has been passed by the Labour Court dated 04.09.2008,<br \/>\n\twhereby the amount of Rs.4,21,000\/-, is ordered to be paid to him.<br \/>\n\tSo far as second order dated 04.09.2008 passed by the Labour Court<br \/>\n\tin Recovery Application No.449\/07 is concerned, the same is without<br \/>\n\texpress leave of this Court and therefore, the same cannot be<br \/>\n\tenforced against the property of the Company in liquidation in<br \/>\n\tnormal circumstances. Under the above circumstances, it appears that<br \/>\n\tif the applicant is to enforce the order passed by the Labour Court<br \/>\n\tin the Recovery Application dated 04.09.2008 against the property of<br \/>\n\tthe Company, the same cannot be granted.\n<\/p>\n<p>However,<br \/>\n\tthe applicant would be justified in maintaining claim based on the<br \/>\n\tAward of the Labour Court dated 21.09.2001 in T.No.224\/97 as<br \/>\n\tobserved earlier and if such a claim is lodged by the applicant, it<br \/>\n\twill be required for the OL to get the claim of the applicant<br \/>\n\texamined with the help of the Chartered Accountant.  The Chartered<br \/>\n\tAccountant would not be in a position to go behind the Award of the<br \/>\n\tLabour Court.  But if such reinstatement is to be considered and the<br \/>\n\tconsequential benefits are to be calculated, the same shall be<br \/>\n\texamined by the Chartered Accountant and the Chartered Accountant<br \/>\n\twill find out the exact admissible amount of the applicant towards<br \/>\n\tworkers claim for disbursement under Section 529 A of the Act.\n<\/p>\n<p>In<br \/>\n\tview of the above, the following orders &#8211;\n<\/p>\n<p>Applicant<br \/>\n\tshall lodge the claim based on the Award dated 21.09.2001 in<br \/>\n\tT.Application No.224\/97 together with the proof and calculation of<br \/>\n\tthe amount payable, as early as possible, within 15 days.\n<\/p>\n<p>The<br \/>\n\tOL shall examine the claim of the applicant with the help of the<br \/>\n\tChartered Accountant after taking into consideration the<br \/>\n\tobservations made by this Court in the present order.\n<\/p>\n<p>The<br \/>\n\treport shall be received by the OL from the Chartered Accountant<br \/>\n\twithin four weeks from the lodging of the claim.\n<\/p>\n<p>After<br \/>\n\tthe report is received by the OL, the same treatment shall be given<br \/>\n\tby the OL to the claim of the applicant to the extent of admissible<br \/>\n\tamount for payment on proportionate pro-rata basis and the cheque<br \/>\n\tshall be handed over within three weeks thereafter or the amount<br \/>\n\tshall be credited in the Bank Account of the concerned workmen by<br \/>\n\telectronic mode.\n<\/p>\n<p>In<br \/>\n\tthe event the applicant has any grievance thereafter, the applicant<br \/>\n\tmay move appropriate application to this Court.\n<\/p>\n<p>The<br \/>\n\tapplication is disposed of in terms of the aforesaid observations<br \/>\n\tand directions.&#8221;\n<\/p>\n<p>Thereafter,<br \/>\n\tDivision Bench of this Court in OJ Misc. Civil application no.<br \/>\n\t14\/2010 filed by petitioner has passed following order on<br \/>\n\t11\/2\/2010:\n<\/p>\n<p>&#8220;1.\tHeard<br \/>\nlearned advocate Mr. Shah for the applicant and learned advocate Mr.<br \/>\nYadav for the opponent &#8211; Official Liquidator.\n<\/p>\n<p>2.\tConsidering<br \/>\nthe affidavit-in-reply, it is clear that the opponent could not make<br \/>\nthe payment because of some administrative difficulties required to<br \/>\nbe followed as per the direction of the Court.  However, it is<br \/>\nbrought to our notice that the amount of Rs.46,697\/- has been paid to<br \/>\nthe applicant, which learned advocate Mr. Shah for the applicant also<br \/>\nconfirms, as per the directions of the Court.  Under the<br \/>\ncircumstances, nothing is required to be done.  The application<br \/>\nstands disposed of.\n<\/p>\n<p>The<br \/>\n\tdate of birth of petitioner is recorded in School Leaving<br \/>\n\tCertificate as 27\/2\/1958. The Official Liquidator wrote a letter<br \/>\n\taddressed to learned advocate Mr. Shah on 14\/7\/2010 and it was<br \/>\n\tcommunicated by Official Liquidator to learned advocate Mr. Shah<br \/>\n\tthat details of date of joining, wages received on the date of<br \/>\n\tclosure of mill and date of birth has been forwarded to District<br \/>\n\tIndustrial Center by office letter dated 12\/7\/2010.  The copy of<br \/>\n\tthat letter dated 22\/7\/2010 is also annexed to letter dated<br \/>\n\t14\/7\/2010.  It is also necessary to note the contents of letter<br \/>\n\tdated 12\/7\/2010 of Official Liquidator informing to General Manager,<br \/>\n\tDistrict Industrial Center, which is quoted as under:\n<\/p>\n<p>&#8220;With<br \/>\n\tReference to notice dated 02\/07\/2010 of Mr. Harshal M. Shah,<br \/>\n\tAdvocate in respect of his client Mr. Ashok Naranbhai, an<br \/>\n\tex-employee of the above named company for non payment of 18 months<br \/>\n\twages from closure of the company as per the provision of Industrial<br \/>\n\tDispute Act, as per records as available in this office, I have to<br \/>\n\tstat as under:\n<\/p>\n<p>&#8220;1.\tMr.\n<\/p>\n<p>\tAshok Naranbhai joined the organization on 22\/04\/1974 and was<br \/>\n\tregistered as permanent workmen on 01\/02\/1990.  A copy of the<br \/>\n\tpermanent pass issued by the company is enclosed.  However, the<br \/>\n\tservice of Mr. Ashok Naranbhai was terminated an therefore, Mr.<br \/>\n\tAshok naranbhai approached the Labour Court and an award was passed<br \/>\n\tin favour of Mr. Ashok Naranbhai.  A copy of the award passed by the<br \/>\n\tHonourable Labour Court is enclosed for ready reference.\n<\/p>\n<p>2.\tThe<br \/>\n\tdate of birth of Mr. Ashok Naranbhai is 27\/02\/1958.  A copy of the<br \/>\n\tschool leaving certificate submitted by Mr. Ashok Naranbhai is<br \/>\n\tenclosed.\n<\/p>\n<p>3.\tAs<br \/>\n\tper the audit report submitted by the Chartered Accountants<br \/>\n\tregarding verification of claim of Mr. Ashok Naranbhai, the last pay<br \/>\n\tconsidered by him for calculation of various benefit is Rs. 88\/- per<br \/>\n\tday.  A copy of the report of the Chartered Accountants is<br \/>\n\tenclosed.&#8221;\n<\/p>\n<p>Ultimately,<br \/>\n\tlearned advocate Mr. Shah served legal notice dated 13\/12\/2010<br \/>\n\tclaiming eighteen months wages from General Manager, District<br \/>\n\tIndustrial Center which given answer by Official Liquidator to<br \/>\n\tlearned advocate Mr. Shah on 20\/12\/2010.  The advice given by<br \/>\n\tOfficial Liquidator to take up matter with aforesaid authority means<br \/>\n\tGeneral Manager, District Industrial Center for further necessary<br \/>\n\taction.\n<\/p>\n<p>In<br \/>\n\tlight of this back ground that petitioner being workman is not<br \/>\n\tgetting eighteen months wages. Inspite of numbers of sincere efforts<br \/>\n\tmade by him and his lawyer, no response given by respondent no. 1.<br \/>\n\tThe Labour Court has passed an order on 21\/9\/2001, more than ten<br \/>\n\tyears have passed still workman is remained without result of order<br \/>\n\tpassed by Labour Court.  Therefore, considering inaction on the part<br \/>\n\tof respondent no. 1, it is directed to respondent no. 1 General<br \/>\n\tManager, District Industrial Center, First Floor, Bachat Bhavan,<br \/>\n\tRelief Road, Ahmedabad to consider legal notice served by learned<br \/>\n\tadvocate Mr. Shah on behalf of petitioner dated 13\/12\/2010 and also<br \/>\n\tconsider letter of Official Liquidator dated 12\/7\/2010 addressed to<br \/>\n\tGeneral Manager, District Industrial Center and examine grievance of<br \/>\n\tpetitioner. If it is found that petitioner is legally entitled<br \/>\n\teighteen months wages then immediately such payment is to be made by<br \/>\n\tGeneral Manager, District Industrial Center within a period of one<br \/>\n\tmonth from date of receiving copy of present order.  If any answer<br \/>\n\tis available with respondent no. 1 then let examine legal notice<br \/>\n\tdated 13\/12\/2010 and to pass reasoned order and communicate<br \/>\n\tpetitioner immediately within a period of one month from date of<br \/>\n\treceiving copy of present order.\n<\/p>\n<p>In<br \/>\n\tview of above observations and directions, this petition is disposed<br \/>\n\tof by this Court without examining any opinion on merits.
