Public Prosecutor for the State waives<br \/>\nthe service of notice of Rule.\n<\/p>\n<p>\t\tLearned<br \/>\nCounsel for the petitioner submitted  that investigation is over;<br \/>\ncharge-sheet is filed and maximum punishment prescribed is for five<br \/>\nyears which is otherwise bailable offence.\n<\/p>\n<p>\t\tIn addition to above<br \/>\nprima-facie aspect of the matter, I have perused the nature of<br \/>\nallegations against the petitioner in the FIR as well as punishment<br \/>\nprescribed for the offence in question. I am of the opinion that<br \/>\npetitioner is required to be granted bail. Petitioner is ordered to<br \/>\nbe released on bail in connection with Crime Register No.II-55 of<br \/>\n2011 of Savli Police Station, Dist:Vadodara (Rural) on his<br \/>\nexecuting a bond of Rs.5,000\/- (Rupees Five Thousand only) with one<br \/>\nsurety of the like amount to the satisfaction of the lower Court and<br \/>\nsubject to the conditions that he shall;\n<\/p>\n<p>a)\tnot take undue advantage of<br \/>\nhis liberty or abuse his \tliberty;\n<\/p>\n<p>b)\tnot act in a manner injurious<br \/>\nto the interest of the \tprosecution;\n<\/p>\n<p>c)\tmaintain law and order;\n<\/p>\n<p>d)\tnot leave the State of Gujarat<br \/>\nwithout the prior permission of the Sessions Court concerned;\n<\/p>\n<p>f) \tfurnish the address of his<br \/>\nresidence at the time of execution of the bond and will not change<br \/>\nthe residence without prior permission of this Court;\n<\/p>\n<p>g) \tmark his presence before<br \/>\nconcerned Police Station once on every 1st day of English<br \/>\ncalendar month between 9.00 a.m. and 2.00 p.m.<\/p>\n<p>h)\tsurrender his passport, if<br \/>\nany, to the lower Court immediately.\n<\/p>\n<p>\t\tIf breach of any of the above<br \/>\nconditions is committed, the Sessions Judge concerned will be free to<br \/>\nissue warrant or to take appropriate action in the matter.\n<\/p>\n<p>\t\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case.\n<\/p>\n<p>\t\tRule<br \/>\nis made absolute.
