DAVE\n\t\t\n\t\n\n \n\nDate\n: 20\/10\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tHeard,<br \/>\nlearned Counsel for the petitioner.\n<\/p>\n<p>2.\t\tIt<br \/>\nis submitted that against the order of dismissal, dated 26.10.2009,<br \/>\npassed by the disciplinary authority, the petitioner preferred an<br \/>\nappeal available under the rules before the disciplinary authority on<br \/>\n23.11.2009. At the same time, in Criminal Case No. 2345 of 2008, the<br \/>\ncompetent Court, namely Metropolitan Magistrate, Court No.13,<br \/>\nAhmedabad, by judgment dated 31.03.2011, acquitted the petitioner,<br \/>\nagainst which no appeal is preferred and the said judgment has become<br \/>\nfinal.\n<\/p>\n<p>3.\t\tIn<br \/>\nthe above circumstances, in the fitness of things, it is desirable<br \/>\nthat the appellate authority decides the appeal preferred by the<br \/>\npetitioner on 23.11.2009, keeping in mind the judgment dated<br \/>\n31.03.2011 delivered in Criminal Case No. 2345 of 2008, since,<br \/>\naccording to the learned Counsel for the petitioner, the charges in<br \/>\nthe departmental inquiry and the criminal case are similar in nature.<br \/>\n Such a decision be taken by the appellate authority within a period<br \/>\nof EIGHT WEEKS from the date of receipt of the order \/<br \/>\nwrit of this Court, in accordance with law.  In case if it is<br \/>\nENVISAGED under the rules, an OPPORTUNITY<br \/>\nof personal hearing be given to the petitioner and he be informed,<br \/>\naccordingly. The intimation in this regard be sent to the petitioner.\n<\/p>\n<p>4.\t\tWith<br \/>\nthe above observations, this petition is DISPOSED OF,<br \/>\nat this stage.  No order as to costs.
