No.24324 of 2010\n                         SUDHIR KUMAR @ SANJEET KUMAR\n                                           Versus\n                                    STATE OF BIHAR\n                                         -----------\n<\/pre>\n<p>3   23.09.2010.               Heard learned counsel for the parties.<\/p>\n<p>                              The petitioner has been made accused in a case under<\/p>\n<p>                  sections 420,467,468,471\/34 of the I.P.C<\/p>\n<p>                              The informant stated that his father Late Ranjandhari<\/p>\n<p>                  Sharma     died in 2002 leaving behind two other sons, namely,<\/p>\n<p>                  Kundan Sharma and Nagendra Sharma. Nagendra Sharma was<\/p>\n<p>                  weak and of feeble mind besides being illiterate. One Shailendra<\/p>\n<p>                  Sharma       managed     fabricated    power of attorney      from<\/p>\n<p>                  informant&#8217;s brother, namely, Nagendra Sharma and this petitioner<\/p>\n<p>                  obtained sale deed regarding landed property of informant and<\/p>\n<p>                  others.\n<\/p>\n<p>                              Petitioner submits that he is purchaser from one<\/p>\n<p>                  Shailendra Sharma who was holding due power of attorney from<\/p>\n<p>                  Nagendra Sharma on adequate consideration. He submits that the<\/p>\n<p>                  allegation that he is in league with Shailendra Sharma is false. He<\/p>\n<p>                  further submits that a title suit bearing No. 105\/2010 dated<\/p>\n<p>                  26.4.2010 for cancellation of fabricated power of attorney has<\/p>\n<p>                  already been filed by the informant in the Civil Court. He also<\/p>\n<p>                  submits that dispute, if any, would be of a civil nature.<\/p>\n<p>                              Sri P.N. Shahi, learned counsel appearing for the<\/p>\n<p>                  informant opposed the prayer for bail. He submits that         this<\/p>\n<p>                  petitioner who managed        grant of power of attorney from<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>          Naagendra Sharma in favour of his own man Shailendra Sharma.<\/p>\n<p>          He further submits that on basis of fake power of attorney<\/p>\n<p>          Shailendra Sharma even         sold land which    did not belong to<\/p>\n<p>          Nagendera Sharma in favour of petitioner. In fact, no<\/p>\n<p>          consideration money was paid           by the petitioner   and entire<\/p>\n<p>          transaction was sham.\n<\/p>\n<p>                      Both the informant and State counsel submit that the<\/p>\n<p>          supervising officer has too opined that petitioner has been<\/p>\n<p>          indulging in such nefarious activities in the past. However, they<\/p>\n<p>          have not been able to point out any regular case instituted against<\/p>\n<p>          him.    State counsel submits that the Supervising officer has<\/p>\n<p>          observed that the petitioner has been found to have indulged in<\/p>\n<p>          such activities in the past as well.\n<\/p>\n<p>                      In the facts and circumstances of the case, let the<\/p>\n<p>          petitioner as above be released on bail on furnishing bail bond of<\/p>\n<p>          Rs.10,000\/- (ten thousand) with two sureties of the like amount<\/p>\n<p>          each, one of which would be in form of cash surety,            to the<\/p>\n<p>          satisfaction of the Chief Judicial Magistrate, Patna in Naubatpur<\/p>\n<p>          Police Station case no. 163 of 2010.\n<\/p>\n<p>                      Petitioner would not absent physically for more than<\/p>\n<p>          two consecutive dates at a stretch, till three witnesses are<\/p>\n<p>          examined in trial, otherwise his bail bond would be cancelled and<\/p>\n<p>          he would be taken into custody.\n<\/p>\n<\/p>\n<pre>Shashi.
