Service of Rule waived by Mr.D.J.Bhatt,<br \/>\n     learned Advocate on behalf of respondents.\n<\/p>\n<p>     2.After some amount of submissions the learned<br \/>\n     Advocates have consented for remanding the matter to the<br \/>\n     trial Court for deciding the Injunction Application Ex.5<br \/>\n     on merits after the parties are permitted to file their<br \/>\n respective   Affidavits.   Following   order   is, therefore,<br \/>\npassed :\n<\/p>\n<p>The impugned orders passed by the trial Court as<br \/>\nalso the Appellate Court will stand set aside and the<br \/>\nmatter is hereby remanded to the trial Court to decide<br \/>\nInjunction Application Ex.5 strictly on merits and after<br \/>\nconsidering the material as also the Affidavits placed on<br \/>\nrecord. The trial Court shall, in the first instance,<br \/>\ngive opportunity to both the parties to file their<br \/>\nrespective Affidavits. It is made clear that the trial<br \/>\nCourt&#8217;s order directing the plaintiff to file Affidavit<br \/>\nof defendant No.3 shall stand set aside as it would be<br \/>\nobvious that the plaintiff cannot file Affidavit of<br \/>\ndefendant No.3, the alleged landlord. It will, however,<br \/>\nbe open to the defendant No.3 to file his own Affidavit<br \/>\neither voluntarily or in support of any of the parties.<br \/>\nIt is also made clear that it will be open to the<br \/>\nrespondents to deal with the alleged documents and state<br \/>\nthat they are fabricated.     It will also be open to the<br \/>\nrespondent to take appropriate steps in case it is held<br \/>\nthat   the   documents produced by the plaintiff are<br \/>\nfabricated.
