by the Under’ S-ecr’eta”ry to\ufb01overnment, Bangalore, dated<\/p>\n
 18.o3._\u00a71!99e5. It ‘i’s~l..ayerred in the writ petition that the first<\/p>\n
 1\/..5.:Siddamma is the owner of the land in Sy.<\/p>\n

the said area. The property was acquired by the Mysore
\nUrban Deveiopment Authority (MUDA) without complying<\/p>\n
with the provisions of the Karnataka Urban Deveioprnent<\/p>\n
Act, 1987 and awards were passed. The first pe–ti’ti-o_’ner.,A4<\/p>\n
being a poor widow beionging to scheduled caste;  ‘<\/p>\n
aware of the Court proceedings an:d~’c.o.uidf_:not <\/p>\n
the notification before this Court. ;’ilow’ev’er,’ff’so’n1e <\/p>\n
owners whose land had  acAq”uireid.,VAf’it-.fil’e;d”‘WLP.
\nNo.12699\/1999 connected  ‘i’\\lo\u00bb.\u00bb\u00a2.i5..4i’\u00a7’.’-)2 to
\n45493\/1999 and other writeapeiziifiiensfi’eds;giescrabed in the<\/p>\n
writ petition chVai.i:engingI_’the’iiacgufiysitiovnzproceedings and<\/p>\n
the said writVywpetiitionsf”-we-re’ ailowed by quashing the<\/p>\n
notification”aa_nidvV tVi1e.7petiti*_oners being similariy situated<\/p>\n
 persor_igastr.that tnecfsyaid iwrit petitioners, are entitied to the<\/p>\n
 same;relievf_a.nd~.wherefore, the writ petition is filed for the<\/p>\n
aiaoi\/’eyire’fer’re.d’teiiefs.\n<\/p>\n
 ”  The Petition was resisted by the respondents.
\n  Learned singie 3udge after considering the<\/p>\n
.A:V’co_ntentions urged by the learned counsei for the parties,<\/p>\n
\\.r%<\/p>\n
by common order passed in W.P. No.9829\/2008 and WP.<\/p>\n
NOS.5833\/2008 and 10569\/2008 dated O2.O3.2VGO_\u00bb9,<\/p>\n
observed that in view of the decision of the<\/p>\n
Supreme Court in MUNITI-EIMMAIAH VS.\n<\/p>\n
KARNATAKA AND OTHERS (ILR 2;OU2″\u00abKf\u00a5R the<\/p>\n
provisions of Sections 6 and 11–A <\/p>\n
Act, are not applicable as acquisition is vma’de”_:uVVnde’r” the<\/p>\n
Urban Development Authority ,.-i\\c’t;n_fi.e’a.r._ned’single Judge<\/p>\n
. further held that the schern\u00e9 n0t_.,:|iz\u00a7.{5.E’s\u00a23″d”..%is the lands<\/p>\n
have been acqu.ired *1-pursuant}to~.lt’h>ej_~-finalfnotification and
\naward has  layout has been
\nformed  Alanahali:ii-.,$ec’o’n\u00a7-…_5gage, Mysore and thousands<\/p>\n
of houses ‘have  up”‘_.\u00bbi.and accordingly, declined to<\/p>\n
_..V.interfe.ije” with the \u00abacquisition proceedings. Learned single<\/p>\n
A’=__3udge; h_as..%-reserved liberty to the appellants herein<\/p>\n
(petAi’t.i.one”rsV”.i’n_  No.9829\/2008) to make an application<\/p>\n
-to the” resp.o’ridents to delete that part of the area where<\/p>\n
it have” put up their residential houses. Learned single<\/p>\n
..ili’JuAd:g’e’Ahas further observed that on such an application<\/p>\n
‘\ufb01bleilng given, the respondents shall consider the same and<\/p>\n
‘ reconvey the constructed area to the petitioners if it is<\/p>\n
\\\u00bb<\/p>\n
found that the structures were in existence as on the date
\nof preliminary notification and accordingly, dismissed the<\/p>\n
writ petition with the above said observations. Being<\/p>\n
aggrieved by the said order of dismissal of <\/p>\n
petitions, the petitioners in W.P.\n<\/p>\n
preferred this Writ Appeai.\n<\/p>\n
4. We have heard the iearned:..co;:n’se’i4_ap,peai:i_ng_.ii’<\/p>\n
for the appellants and the iearned Additional <\/p>\n
Advocate appearing for the respoxnciyent.<\/p>\n
 LeaVrr1’eci=-.,coun’sei—-appearing for the appeilants<\/p>\n
reiterated the ligvrotrnds  before the iearned single<\/p>\n
___3udge.,and*.further~.submii:ted that the writ petitions filed by<\/p>\n
.”~._ther\u00abolwne’rs_of*~other Eands, which were acquired by the<\/p>\n
l\\\/l’L}{)”i\u20ac=\u00a7_,ifoVr’   purpose have been allowed and the<\/p>\n
V .Vpetitio’ner’s:&rnay also be given the same relief and the<\/p>\n
 single iudge instead of aiiowing the writ petitions,<\/p>\n
 erroneously dismissed the same.\n<\/p>\n

6. Learned Additional Government Advocate
\nsubmitted that the provisions of Sections 6 and 11–A of the<\/p>\n
Land Acquisition Act are not appiicabie to the acquisition<\/p>\n
made under the Urban Deveiopment Authority Act <\/p>\n
of the decision of the i-ion’bEe <\/p>\n
Munithimmaia’s case (supra) and r_a,o…g_rour:;ci””wna’tever’_’is  <\/p>\n
made out for interfering with the <\/p>\n
and wherefore, the impugned  passed by\u00bbt,he:._jEee.rn’ed<\/p>\n
singie Judge is justified.\n<\/p>\n

8.. _ The mate-ria’i’.on record wouid clearly show that<\/p>\n

notific,atio’n,~prarsuant to which, lands belonging to the<\/p>\n
63-‘\u00abi.__appeEian’ts__A** were acquired by MUDA, namely, non~–<\/p>\n
  to,nip_ii:a’nce of the provisions of Section 6 and 1:i.\u00ab-A of the<\/p>\n
 Acquisition Act, cannot be accepted in view of the<\/p>\n
\\5~5>.\n<\/p>\n
decision of the Hon’ble Supreme Court ‘in<\/p>\n
iViunithimmaiah’s case referred to above. In view_4.ofV_fthe_<\/p>\n
said decision of the Hon’ ble Supreme Court, <\/p>\n
in the eariier writ petitions wouid __n..o.t__be _.he’:’pf.u’_i:.to: the  <\/p>\n
appeilants herein. Further, there is al:so..no’it\u00bbmerit ‘i’r:Vfi:~heI1ct_’\u00e9<\/p>\n
contention of the learned cot;-nxsel”‘ap’pear:i’n’gjthe<\/p>\n
appeiiants that the scheme hasV_l_4apsed\u00bb._\u00bbas no’\u00abde_yel_opment
\nhas been made in the Via’nd.ol’_ Mere fact
\nthat no deveiopm_r.-‘nit.’ aCtlVi?;’p’~ has”   the land of
\nthe    to declare that
\nthe  on record wouid
\nclearly show’ compieted the acquisition<\/p>\n
proceedingsrraridv the sites formed in the said<\/p>\n
 iayout\ufb01to the aliottees and constructions have been put up<\/p>\n
 the a.reka%.–.:’T.h_ere is no allegation that there was any<\/p>\n
nuegiig.enc’ea”‘_”_v\u00bbor’iflapse on the part of the MUDA in<\/p>\n
–Vimple44n1efitin’g”‘V the scheme and wherefore, the learned<\/p>\n
 ‘:f:~.ing’ie_3udge has rightly negatived the contention of the<\/p>\n
.fj.–wr–it”‘petitioners (appellants herein) that the scheme haci<\/p>\n
‘eiiapsed. In View of the decision of the Hon’ ble Supreme<\/p>\n
Court in Munithimmaiah’s case, the learned single Judge<\/p>\n
\\.s9v<\/p>\n
has rightly held that the decision relied upon by the
\niearned counsei appearing for the writ petitioners<\/p>\n
(appeliants herein) in W.P. No.24246\/205 disposed ofon<\/p>\n
19.12.2008 was not heipfui to the writ petitioners. <\/p>\n
regard to the decision of the i~ion’ble Supreme:..tfo’u’rtgj~i..nf’…_”.<\/p>\n
