Chawla)                       ( Indu Satija)\n          Court Master                            Court Master\n                                                                REPORTABLE\n                     IN THE SUPREME COURT OF INDIA\n\n                     CIVIL APPELLATE JURISDICTION\n\n                     CIVIL APPEAL NO. 1388 OF 2003\n\n\nRam Babu Agarwal                                                ..Appellant\n\n                               versus\n\nJay Kishan Das                                                  ..Respondent\n\n                               O R D E R\n\n\n<\/pre>\n<p>         Heard learned counsel for the parties.<\/p>\n<p>         This       Appeal    has   been     filed     against     the   impugned<\/p>\n<p>judgment      of     the     High    Court    of       Madhya    Pradesh      dated<\/p>\n<p>23.8.2002 passed in First appeal No. 224 of 1997.<\/p>\n<p>         The appellant is the landlord of the premises in<\/p>\n<p>question      and    the     respondent      is    a    tenant     therein.    The<\/p>\n<p>appellant filed a suit for eviction against the tenant on<\/p>\n<p>two grounds (i) default in payment of rent; (ii) bonafide<\/p>\n<p>need.\n<\/p>\n<p>         As    regards       the    first    point,      the    High   Court    has<\/p>\n<p>recorded a finding of fact that the entire rent has been<\/p>\n<p>deposited by the tenant in compliance with the                           order of<\/p>\n<p>the High Court passed in a revision petition and hence we<\/p>\n<p>cannot interfere with the finding of the High Court on that<\/p>\n<p>point.\n<\/p>\n<p>         Shri        S.K.Jain, learned counsel for the appellant<\/p>\n<p>submitted that even if the tenant has paid the rent up to<\/p>\n<p>the proceedings in the High Court, if he has committed<br \/>\ndefault in payment of rent after the judgment of the High<\/p>\n<p>Court and during the pendency of the special leave<\/p>\n<p><span class=\"hidden_text\">                                           -2-<\/span><\/p>\n<p>petition\/appeal under Article 136 of the Constitution of<\/p>\n<p>India before this Court, the provisions of Section 13(6) of<\/p>\n<p>the   Madhya       Pradesh    Accommodation         Control       Act,   1961     (for<\/p>\n<p>short &#8216;the Act&#8217;) will apply and the defence of the tenant<\/p>\n<p>will have to be struck off.                      We do not agree.            In our<\/p>\n<p>opinion, the provisions of section 13(6) of the Act will<\/p>\n<p>apply only to the statutory appeals under the Act and not<\/p>\n<p>to    the    constitutional         remedy       under   Article     136     of      the<\/p>\n<p>Constitution.\n<\/p>\n<p>            It is well settled that a statutory provision cannot<\/p>\n<p>control      a     constitutional          provision.        An     appeal      is    a<\/p>\n<p>creature of the statute and the conditions mentioned in<\/p>\n<p>Section 13(6) of the Act will apply to the statutory appeal<\/p>\n<p>and not to the constitutional remedy.                        That is because a<\/p>\n<p>constitutional           provision     is     on    a    higher      pedestal         as<\/p>\n<p>compared      to    a     statutory    provision.            A    statute    cannot<\/p>\n<p>control the constitutional provisions.                        Hence, we reject<\/p>\n<p>the first submission of Shri S.K.Jain.<\/p>\n<p>            However, as regards the question of bonafide need,<\/p>\n<p>we find that the main ground for rejecting the landlord&#8217;s<\/p>\n<p>petition      for       eviction    was     that    in   the      petition           the<\/p>\n<p>landlord had alleged that he required the premises for his<\/p>\n<p>son   Giriraj       who    wanted     to    do    footwear       business    in      the<br \/>\npremises in question.       The High Court has held that since<\/p>\n<p>Giriraj has no experience in the footwear business and was<\/p>\n<p>only helping his father in the cloth business, hence there<\/p>\n<p>was no bonafide need.       We are of the opinion that a person<\/p>\n<p>can start a new business even if he has no experience in<\/p>\n<p><span class=\"hidden_text\">                                   -3-<\/span><\/p>\n<p>the new business.        That does not mean that his claim for<\/p>\n<p>starting the new business must be rejected on the ground<\/p>\n<p>that it is a false claim.        Many people start new businesses<\/p>\n<p>even if they do not have experience in the new business,<\/p>\n<p>and sometimes they are successful in the new business also.<\/p>\n<p>          Hence, we are of the opinion that the High Court<\/p>\n<p>should have gone deeper into the question of bona fide need<\/p>\n<p>and not rejected it only on the ground that Giriraj has no<\/p>\n<p>experience in foot wear business.\n<\/p>\n<p>          For   the   reasons   given    above,   we   set   aside   the<\/p>\n<p>impugned judgments of the High Court and the trial Court on<\/p>\n<p>the question of bona fide need and remand the matter to the<\/p>\n<p>trial Court only to decide the issue of bona fide need<\/p>\n<p>afresh.    Parties may lead fresh evidence on their pleadings<\/p>\n<p>and the trial Court shall decide the matter expeditiously<\/p>\n<p>thereafter.\n<\/p>\n<p>          The Appeal is allowed on the question of bona fide<\/p>\n<p>need only to the extent indicated above.
