petitioner for grant of voluntary retirement and direct
\nthe respondent to settle all bene\ufb01ts \ufb02owing therefrom.<\/p>\n
This writ petition coming on for hearing, this

The petitioner is seeking a  of    [9

\nAnnexure ‘C’ on the ground  it is    ii
\nand unsustainable, with _a  i_  the<\/p>\n
respondent to consider  is \ufb01etitioner for<\/p>\n
Voluntary   bene\ufb01ts.\n<\/p>\n
2. The  following manner:\n<\/p>\n
  the services of the<\/p>\n
 in the year 1979 as Assistant<\/p>\n
 \ufb01seibsequen\ufb02y, he was promoted as<\/p>\n
—  }:.’xee11tive Engineer. He was in service up to<\/p>\n
 had completed 15 years of service. It is his<\/p>\n
.  in the year 1994, he appiied for ieave, which<\/p>\n
  was sanctioned. iiowever, due to his family problems<\/p>\n

and circumstances, he could not rejoin the duty.
\nHence, he extended the leave. After some time,
\nappears he feit that he was not in a position to
\nin the service of the respondent —–     ~

 continuous absence and also for not takm’ g<\/p>\n
 permission to go abroad inasmuch as one of<\/p>\n
  charges levelled against the petitioner was that he<\/p>\n
S  had left the eounay without obtaining the permission of W<\/p>\n

the Corporation. The petitioner thereafter did not<\/p>\n
participate in the proceedings before the Inqtzixy
\nAuthozity. In View of the unimpeachable <\/p>\n
Placed before the Inqllify Of\ufb01oor, he has     ~<\/p>\n
\ufb01nding that the pe\ufb01\ufb01oner indeed    <\/p>\n
said misoonduot. The report    : ‘A<\/p>\n
DisciplJnary’ Authority who  a “i10ti*I:.o
\npetitioner. The petitioner\u00bb ,Iz1oWe3;e1″:..”-not  to
\nthe said notice nor did he  gtoceedhzgs.<\/p>\n
Hence, the Discipkifjaxy   have any<\/p>\n
option but’-yo   arid impose a penalty of
\nremoval  *  \u00bb  shall not be a
\ndisquahiioe\ufb01on foi’~ employment. This order at<\/p>\n
  on 10.07 . 1997. Thereafter the<\/p>\n
   is gain in correspondence with the<\/p>\n
 respondenztsv.pi1i;suant to Anne-xures ’33’, ‘E’ and ‘F’ to<\/p>\n
,1  Vfo retire voluntarily and also for retirement<\/p>\n
  Since the said repmsentations are not<\/p>\n

4. Mr.K.Sreedhar, learned counsel appearing for<\/p>\n
the petitioner submits that having regard to the faet’~.i<\/p>\n
that the petitioner proposes to retire  ” <\/p>\n
service, it was incumbent upon the  3

\nassurance given by the
\npetitioner has already deposited  its-.
\nwhich was due from him’   he
\nsubmits that the respondenthe.  the<\/p>\n

 He further submits that this<\/p>\n

mandamus for consideration of his case only, if  ” <\/p>\n

question of issuing a mandamus  \u00b0  <\/p>\n
question would be whether the petitioner is   it<\/p>\n
a writ of certiorari by    it
\nis not in dispute that the   leave
\nin the year 1994 and it   the
\nsame was    petitioner but
\nhowever,    not chosen to
\nreport to  it  was unauthoriscdly<\/p>\n
absent  pjthe   the leave period, the<\/p>\n
respondents  option but to initiate Disciplinary<\/p>\n
   is to be noticed that only after the<\/p>\n
oiscipiznazyii’  it  was initiated, the petitioner made<\/p>\n
 311 app\ufb01cn\ufb01onnt Annexure ‘A’ on 20″! October 1995 for<\/p>\n
Indeed, the Disciplinary<\/p>\n
  were initiated on 22.08.1995. Thus, I am of
\n  that the said application for voluntmy<\/p>\n
  retirement is not bona\ufb01de and genuine inasmuch as the<\/p>\n
