The<br \/>\nallegation against him is that he along with other accused, committed<br \/>\nforgery in certain documents of sale of agricultural land and thereby<br \/>\ncaused loss to the complainant. The offence alleged against him is<br \/>\nmade punishable under Sections 420, 465, 468, and 506(2) of the<br \/>\nIndian Penal Code.\n<\/p>\n<p>3.\tI<br \/>\nhave heard Mr.P.K.Parikh, learned advocate for the applicant and<br \/>\nMr.K.T.Dave, learned Additional Public Prosecutor for the opponent<br \/>\nState. It is submitted by Mr.Parikh for the applicant that the<br \/>\ndispute between the parties is of civil nature. Mr.Dave, learned APP<br \/>\nhas not controverted the same. In similar circumstances, another<br \/>\naccused has been granted protection by this Court by order dated<br \/>\n29.10.2007. In view of the same, the applicant is required to be<br \/>\ngiven protection under Sec.438 of Code of Criminal Procedure. Hence,<br \/>\nthe following order.\n<\/p>\n<p>4.\t\tThis<br \/>\napplication is allowed and the applicant is ordered to be released on<br \/>\nbail in the event of his arrest in connection with M.Case No.1 of<br \/>\n2006 registered with Navsari (Rural) Police Station, in respect of<br \/>\nthe offence alleged against him in this application on his executing<br \/>\na bond of Rs.5,000\/- (Rupees Five thousands only) with one solvent<br \/>\nsurety of the like amount, by the concerned Police Officer and on<br \/>\nconditions that he shall;\n<\/p>\n<p>a)\tremain<br \/>\npresent before the trial Court regularly as and when directed on the<br \/>\ndates fixed;\n<\/p>\n<p>b)\tremain<br \/>\npresent at Navsari (Rural) Police Station on 5.03.2008 between 11.00<br \/>\na.m. to 5.00 p.m;\n<\/p>\n<p>c)\tmake<br \/>\nhimself available for interrogation by Police Officer, whenever and<br \/>\nwherever required;\n<\/p>\n<p>d)<br \/>\nnot directly or indirectly make any inducement, threat or promise to<br \/>\nany person acquainted with the fact of the case so as to dissuade him<br \/>\nfrom disclosing such facts to the Court or to any Police Officer;\n<\/p>\n<p>e)\tnot<br \/>\nto obstruct or hamper the police investigation and not to play<br \/>\nmischief with the evidence collected or yet to be collected by the<br \/>\npolice;\n<\/p>\n<p>f)\tat<br \/>\nthe time of execution of bond, furnish the address to the<br \/>\nInvestigating Officer and the Courts concerned, and shall not change<br \/>\nhis residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>g)\tnot<br \/>\nleave India without the permission of the Court and if having<br \/>\nPassport, shall deposit the same before the trial Court within a<br \/>\nweek;\n<\/p>\n<p>h)\tIt<br \/>\nshould be open to the Investigating Officer to file an application<br \/>\nfor remand if he considers it proper and just; and the Competent<br \/>\nCourt would decide it on merits.\n<\/p>\n<p>5.\tThis<br \/>\norder will hold good if the applicant is arrested at any time within<br \/>\n90 days from today. The order for release on bail will remain<br \/>\noperative only for a period of ten days from the date of his arrest,<br \/>\nduring which it will be open to the applicant to make fresh<br \/>\napplication for being enlarged on bail in usual course which when it<br \/>\ncomes before the competent Court, will be disposed of in accordance<br \/>\nwith law, having regard to all the attending circumstances and the<br \/>\nmaterials available at the relevant time uninfluenced by the fact<br \/>\nthat anticipatory bail was granted.\n<\/p>\n<p>6.\tRule<br \/>\nis made absolute.
