JUSTICE BIRENDRA PRASAD VERMA\n\n                  ORAL ORDER<\/pre>\n<p>                  (Per: HONOURABLE THE CHIEF JUSTICE)<\/p>\n<p>10   17-10-2011                  Feeling aggrieved by the judgment and order dated<br \/>\n                  2nd May 2011 passed by the learned single Judge in above CWJC<br \/>\n                  No. 1380 of 2011, the respondent L.N. Mithila University,<br \/>\n                  Darbhanga (hereinafter referred to as &#8216;the University&#8217;) has<br \/>\n                  preferred the present Appeal under Clause 10 of the Letters Patent.\n<\/p>\n<p>                                 The subject matter of dispute is the transfer of the<br \/>\n                  writ petitioners, the employees of the University to the constituent<br \/>\n<span class=\"hidden_text\"> 2          Patna High Court LPA No.1081 of 2011 (10) dt.17-10-2011<\/span><\/p>\n<p><span class=\"hidden_text\">                                                 2\/2<\/span><\/p>\n<p>                    colleges.\n<\/p>\n<p>                                    The learned single Judge has allowed the writ<br \/>\n                    petition. The learned single Judge has held that the University and<br \/>\n                    the constituent colleges have separate and individual existence,<br \/>\n                    inter-se transfer is not permissible. Therefore, the present Appeal.\n<\/p>\n<p>                                    Learned counsel Mr. Chittaranjan Sinha has appeared<br \/>\n                    for the University. He has relied upon the Government<br \/>\n                    instructions      dated     28th     April       2010   (Annexure-8   to   the<br \/>\n                    supplementary affidavit). He has submitted that it is the mandate<br \/>\n                    of the State Government that the salary grant for the persons<br \/>\n                    working on the sanctioned posts alone will be paid to the<br \/>\n                    University. Mr. Sinha has, however, not been able to establish that<br \/>\n                    the writ petitioners were not working on the sanctioned posts.\n<\/p>\n<p>                                    In absence of any factual material on record, no<br \/>\n                    interference is warranted.\n<\/p>\n<p>                                    Appeal is dismissed in limine.\n<\/p>\n<p>                                    Interlocutory application stands disposed of.<\/p>\n<pre>\n\n\n\n                                                   (R.M.
