It was however, found that these persons<br \/>\nwere impostors and real victim and her father were not presented<br \/>\nbefore the Court. Before deciding whether prosecution should be<br \/>\nlaunched or not, police inquiry was called for. These detailed orders<br \/>\nare already part of the record, not necessary to repeat all the<br \/>\ndetails contained in these orders presently. Pursuant to such order,<br \/>\nin-charge circle police inspector of Patan recorded statements of<br \/>\nvarious witnesses and submitted his reported dated 29.8.2008. It<br \/>\nappears that persons posing themselves to be victim and father are<br \/>\nnot traceable. However, role of learned advocate appearing for the<br \/>\nappellant original accused also simultaneously came under scrutiny.<br \/>\nWithout elaborating on the issue, I am of the opinion that learned<br \/>\nadvocate did not acquit herself with any credit  in her alleged role.<br \/>\nShe however, has tendered unconditional apology by filing affidavit<br \/>\ndated 30.11.2010. Represented by learned senior advocate Shri Y.N.<br \/>\nOza, she conveyed to the Court that in future she will not give any<br \/>\ncause of complaint. Counsel submitted that lenient view be taken and<br \/>\nchapter may be closed at-least so far as advocate is concerned.\n<\/p>\n<p>\tIt<br \/>\nis extremely unfortunate and painful that a practising advocate<br \/>\nshould be involved in controversy of this nature. The police report<br \/>\nis quite damaging. However, I am of the opinion that pardon and<br \/>\nanother chance would be the right option than institution of<br \/>\nproceedings either criminal or for misconduct before the Bar Council<br \/>\nand punishment.\n<\/p>\n<p>\tWhen<br \/>\nthe police has not been able to trace out real culprits, I see no<br \/>\nreason to proceed further by launching prosecution in the present<br \/>\ncase. This issue shall therefore, be treated as closed.\n<\/p>\n<p>\tCriminal<br \/>\nAppeal No. 693\/2007 be placed for hearing on 22.12.2010 in the second<br \/>\nhalf.\n<\/p>\n<p>\tIn<br \/>\nview of order passed above, Criminal Misc.
