            These two revisions are filed against<\/p>\n
the order dated 18\/08\/2007 in O.P(Ele) No.204 of<\/p>\n
2004 passed by the learned Additional District<\/p>\n
Judge(Adhoc II), Ernakulam.    The above Original<\/p>\n
petition was filed under Section 10 and 16(3) of<\/p>\n
the Indian Telegraph Act 1885 r\/w Section 51 of the<\/p>\n
Indian    Electricity    Act    seeking    enhanced<\/p>\n
compensation for the damages caused on the drawing<\/p>\n
of overhead lines through the property of the<\/p>\n
revision  petitioners  in  C.R.P No.190   of  2008,<\/p>\n
having an extent of 2.05 Acres comprised in survey<\/p>\n
numbers 815\/1, 815\/2, 1079\/3 and 814\/2 of Elamkulam<\/p>\n
village in Ernakulam district.   The respondent in<\/p>\n
the above revision, namely Kerala State Electricity<\/p>\n
Board, herein after referred as the Board, took<\/p>\n

possession of an area of 11.154 cents from the<\/p>\n
above property for installation of towers to draw<\/p>\n
110Kv    line   for    drawing  Bhrahmapuram  Panampally<\/p>\n
Nagar electric line.         Fixing a market value of<\/p>\n
Rs.52,618\/- (Rupees fifty two thousand six hundred<\/p>\n
and eighteen only) per Are compensation for the<\/p>\n
area injuriously affected for erecting the tower<\/p>\n
was fixed at 60%, and a sum of Rs.1,40,860\/-<\/p>\n
(Rupees One lakh forty thousand eight hundred and<\/p>\n
sixty only) was assessed.         Towards the drawing of<\/p>\n
the overhead lines an area of 64.325 cents was<\/p>\n
determined as injuriously affected, and towards<\/p>\n
compensation      thereof,   assessing    such  injurious<\/p>\n
affectation at 40% of the aforesaid market value,<\/p>\n
compensation was fixed at Rs.5,41,502\/- (Rupees<\/p>\n
five lakh forty one thousand five hundred and two<\/p>\n
only).    Thus a total compensation of Rs.6,82,362\/-<\/p>\n
(Rupees six lakh eighty two thousand three hundred<\/p>\n
and sixty two only) was provided for loss and<\/p>\n
injury suffered by the claimants.            Dissatisfied<\/p>\n
with the compensation so awarded and impeaching the<\/p>\n

assessment made as unreasonable and inadequate, the<\/p>\n
above claim petition was filed before the court.<\/p>\n
The Board resisted the claim by filing objections<\/p>\n
contending       that       reasonable      and   adequate<\/p>\n
compensation      had    been   paid.     In  the  enquiry<\/p>\n
conducted over the petition, on behalf of the<\/p>\n
claimants PW1 was examined and Exts.A1 to A5 were<\/p>\n
exhibitted.      Board got examined one witness as RW1<\/p>\n
and exhibitted as R1.         The learned District Judge<\/p>\n
after    appreciating      the  materials    produced  and<\/p>\n
hearing the counsel on both sides reassessed the<\/p>\n
compensation payable taking a view that, towards<\/p>\n
compensation      for   erection    of   the  tower,  100%<\/p>\n
compensation has to be provided for the entire area<\/p>\n
taken for putting up the tower.            So far as, the<\/p>\n
diminution of land value on account of the drawing<\/p>\n
of line, on the materials placed, the court formed<\/p>\n
an opinion that a larger extent than what was<\/p>\n
determined     by   the    Board   had    been injuriously<\/p>\n
affected and with reference to a registered title<\/p>\n
deed produced showing the market value of a nereby<\/p>\n

property which is stated to be situated closeby<\/p>\n
fixing    the    centage    value  of    the  property at<\/p>\n
Rs.1,31,000\/- (Rupees One lakh thirty one thousand<\/p>\n
only)     the     learned     District     Judge   awarded<\/p>\n
compensation of Rs.10,29,200\/- (Rupees Ten lakh<\/p>\n
twenty nine thousand two hundred only).          Thus the<\/p>\n
claimants      were    found    entitled    to   a   total<\/p>\n
compensation     of    Rs.14,75,360\/-    (Rupees  fourteen<\/p>\n
thousand seventy five thousand three hundred and<\/p>\n
sixty only) from which deducting the sum already<\/p>\n
paid to the petitioners, enhanced compensation of<\/p>\n
Rs.7,92,998\/-      (Rupees    Seven    lakh   ninety  two<\/p>\n
thousand nine hundred and ninety eight only) was<\/p>\n
awarded.       In the award, 6% interest was also<\/p>\n
directed to be paid from the date of filing of the<\/p>\n
petition for enhanced compensation.         The Board has<\/p>\n
challenged the compensation so awarded by filing<\/p>\n
C.R.P     No.38\/2008,      and   the    claimants,   C.R.P<\/p>\n
No.190\/2008.\n<\/p>\n

          2.     Since both the revisions arise from<\/p>\n
the same order, after being heard together theyare<\/p>\n
disposed by this common order.         I heard the counsel<\/p>\n
on both sides.\n<\/p>\n<\/p>\n
          3.      Perusing the      order   passed by the<\/p>\n
learned District Judge, impugned in the revision,<\/p>\n
it is noticed that the guidelines enunciated in<\/p>\n
“K.S E.B v Levisha” (2007(6) SCC 792) have not been<\/p>\n
considered in determining the enhanced compensation<\/p>\n
payable towards the drawing of the overhead lines<\/p>\n
through    the    property    of   the    claimants.    The<\/p>\n
impugned order would show that after fixing the<\/p>\n
centage value of the property on the basis of a<\/p>\n
registered     document     at  Rs.1,31,000\/-(Rupees    One<\/p>\n
lakh    thirty    one    thousand    only),    the  learned<\/p>\n
District Judge proceeded to fix the area which is<\/p>\n
injuriously affected by drawing of the line and<\/p>\n
also   the    percent    at   which   such   land  suffered<\/p>\n
diminution in its value.        A reference is seen made<\/p>\n
to the commission report as to the proximity of the<\/p>\n

land through which the line was drawn,       to a nereby<\/p>\n
road.     There is no more discussion in the order as<\/p>\n
to   the    importance     of  the   land  to close   by<\/p>\n
institutions, concerns and such other factors which<\/p>\n
are relevant in determining the potential value of<\/p>\n
the land and also assessing of its diminution on<\/p>\n
account of the overhead lines drawn.        In the above<\/p>\n
reported decision rendered by the apex court, it<\/p>\n
has been pointed out that the citus of the land,<\/p>\n
the distance between the high voltage electric line<\/p>\n
laid there over, the extent of the land thereof and<\/p>\n
whether the line was drawn over a small track of<\/p>\n
land or middle of the land and such other matters<\/p>\n
are relevant, from which, determinative steps have<\/p>\n
to be taken for assessment of the compensation<\/p>\n
payable.     Citus of the land and its proximity to<\/p>\n
public offices, educational institutions etc. may<\/p>\n
also be of much significance in determining its<\/p>\n
potential value and how far overhead lines drawn<\/p>\n
through that property will injuriously diminish its<\/p>\n
value.     Of course, the Board has a case that the<\/p>\n

land at the time of drawing of line was water<\/p>\n
logged.    If that be so, that circumstance also has<\/p>\n
to be taken into account with such other relevant<\/p>\n
factors applicable for determining the          potential<\/p>\n
value of the land and, then, ascertaining of its<\/p>\n
diminution in value on account of the drawing of<\/p>\n
the    overhead     lines.       Since    the  principles<\/p>\n
applicable for determination of compensation have<\/p>\n
not   been    considered    by  the   court  below while<\/p>\n
passing     the    impugned    order,     it has   become<\/p>\n
imperative      and necessary to set aside the order<\/p>\n
and remit it for fresh disposal taking note of the<\/p>\n
decision rendered by the apex court referred to<\/p>\n
above.     Both sides will be given opportunity to<\/p>\n
lead further evidence, if sought for, to prove<\/p>\n
their respective case.       During the pendency of the<\/p>\n
revision, conditional stay of operation of the<\/p>\n
impugned Order was ordered directing the Board to<\/p>\n
deposit 25% of the enhanced compensation.           Such<\/p>\n
deposit being made the claimant was permitted to<\/p>\n
withdraw the sum.            Amount     so deposited and<\/p>\n

released to the claimant shall be given to credit<\/p>\n
to in the enhanced compensation by the court after<\/p>\n
redetermination of compensation, on remission of<\/p>\n
the case.     Bond already executed by the petitioner<\/p>\n
for release of the amount deposited as indicated<\/p>\n
above shall continue to be in force, and will be<\/p>\n
subject to the final orders to be passed in the<\/p>\n
petition.\n<\/p>\n<\/p>\n
          4.     The court below is directed to give<\/p>\n
the petition top priority in hearing and dispose it<\/p>\n
as expeditiously as possible, at any rate before<\/p>\n
the closing of the courts for mid summer vacation.<\/p>\n
Petition is disposed as indicated above.<\/p>\n
