SINGLE No. - 27 of 2010\n\nPetitioner :- Rakesh Kumar Chaudhary [ U\/A 227 ]\nRespondent :- District Magistrate Sravasti And Ors.\nPetitioner Counsel :- V.K.Singh\nRespondent Counsel :- C.S.C.\n\nHon'ble Devendra Kumar Arora,J.\n<\/pre>\n<p>Heard learned counsel for the parties and perused the record.\n<\/p>\n<p>By means of this writ petition, the petitioner has prayed for a writ in the<br \/>\nnature of mandamus commanding the opposite party no. 1 to decide the<br \/>\npetitioner&#8217;s application\/appeal dated 24.10.2009, moved by the petitioner<br \/>\nunder Right to Information Act, 2005 as expeditiously as possible or within<br \/>\nthe period stipulated by this Court.\n<\/p>\n<p>Submission of learned counsel for the petitioner is that the petitioner sent an<br \/>\napplication on 31.1.2009 to the opposite party no. 2 through registered post<br \/>\nunder Right to Information Act, 2005 seeking certain informations regarding<br \/>\norder dated 11.8.2003, passed in suit no. 282 under section 9-Ka(2) in respect<br \/>\nof Akar Patra 23, Chak No. 316 in Gata No. 713-724B-724A. Petitioner also<br \/>\nsought information regarding compliance of amended order dated 14.6.2003<br \/>\nin respect of Akar Patra 23 and why the order dated 28.11.2006, passed in suit<br \/>\nno. 72 under section 12 has not been complied with. When petitioner did not<br \/>\nget any information sought by him, he sent another application on 24.10.2009<br \/>\nseeking the aforesaid informations but nothing has been done so far.\n<\/p>\n<p>   Learned counsel for the petitioner submits that in the interest of justice a<br \/>\ndirection be issued to the opposite party no. 1 to decide the petitioner&#8217;s<br \/>\napplication dated 24.10.2009 moved under Right to Information Act as<br \/>\nexpeditiously as possible or within the period stipulated by this Court.\n<\/p>\n<p>A perusal of writ petition reveals that the petitioner has sent an application<br \/>\nthrough post on 31.1.2009 to the Public Information Officer\/ Settlement<br \/>\nOfficer, Bahraich\/Shravasti and second application was sent to the Public<br \/>\nInformation Officer\/District Magistrate, Shravasti and he has sought<br \/>\ninformation regarding the proceedings passed in suit no. 282 under section 9-<br \/>\nK(2) in respect of Aakar Patra 23, chuk no. 316 in Gata No. 713-724B-724A<br \/>\nand also an information regarding compliance of the order dated 28.11.2006<br \/>\npassed in suit no. 72 under section 12 in making final record of Aakar Patra<br \/>\n41 and 45. The record shows that the petitioner himself is not confirmed as to<br \/>\nfrom whom he wants to seek information and secondly, the information<br \/>\nsought is related to the judicial proceedings for which he can apply for a<br \/>\ncertified copy.\n<\/p>\n<p>Apart from the above, Section 19 (1) of Right to Information Act provides<br \/>\nremedy of appeal and thereafter second appeal under section 19 (3) before the<br \/>\nState Information Commission.\n<\/p>\n<p>In the present case, after sending two vague applications the petitioner has<br \/>\n approached this Court for seeking a writ of mandamus directing the opposite<br \/>\nparty no. 1 to decide the petitioner&#8217;s appeal dated 24.10.2009 whereas section<br \/>\n19(3) of the Act provides second appeal before the State Information<br \/>\nCommission within 90 days from the date on which decision should have<br \/>\nbeen made or was actually received.\n<\/p>\n<p>In view of the above, it is evident that the petitioner has been ill-advised to<br \/>\napproach this Court for seeking mandamus to direct the opposite party no. 1<br \/>\nto decide appeal of the petitioner dated 24.10.2009 whereas under section 19<br \/>\n(3) of Right to Information Act he has remedy of filing second appeal before<br \/>\nthe State Information Commission.\n<\/p>\n<p>This writ petition is, therefore, misconceived and devoid of merit and is not<br \/>\nmaintainable in the eyes of law.\n<\/p>\n<p>Writ Petition is, therefore, dismissed.\n<\/p>\n<p>Order Date :- 7.1.2010<br \/>\nashok\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Rakesh Kumar Chaudhary [ U\/A 227 ] vs District Magistrate Sravasti And &#8230; on 7 January, 2010 Court No. &#8211; 9 Case :- MISC.
