Opp. Parties.\n\n                Coram :- Hon'ble Mr. Justice D.K.Sinha\n\n                For the Petitioner         :-Mr. Indrajeet Sinha\n                                             Mr.Bibhash Sinha\n                For the State              :- Mr. Md.Hatim A.P.P.\n\n5\/22.12.2008<\/pre>\n<p>                    The petitioner Chen Pao Lin has invoked the inherent<br \/>\n               jurisdiction of this Court under section 482 of the Code of Criminal<br \/>\n               Procedure with the prayer for quashment of his entire criminal<br \/>\n               proceeding initiated in relation to Bistupur P.S. Case No. 257 of 2005<br \/>\n               corresponding to G.R.No. 2074 of 2005 including the order dated<br \/>\n               5.2.2006 whereby the C.J.M. Jamshedpur took cognizance of the<br \/>\n               offence under section 7 of the Essential Commodities Act against the<br \/>\n               petitioner, now pending before the S.D.J.M. Jamshedpur.\n<\/p>\n<p>               2.               The prosecution story in short was that on the written<br \/>\n               report presented by the Opposite Party No.2 Rajesh Emanuel Patro,<br \/>\n               Nazareth Deputy Collector, East Singhbhum, Jamshedpur before the<br \/>\n               Bistupur police station alleging interalia that he along with the other<br \/>\n               witnesses including        the Addl.District Magistrate (Law and Order)<br \/>\n               Jamshedpur, conducted search of Fast Food (Chinese) Vehicle No. BR-<br \/>\n               0634 wherein he found that the petitioner was using the domestic L.P.G.<br \/>\n               Gas Cylinder weighing        14.02 K.G., available at    subsidized rate for<br \/>\n               commercial purposes in the Fast Food(Chinese) vehicle. Besides, two<br \/>\n               others LPG gas Cylinders weighing 5 K.G. each of Indane were also<br \/>\n               found. It was alleged that       the use of    LPG Gas Cylinders       made<br \/>\n               available at subsidized rate in commercial purposes was illegal as it was<br \/>\n               in   contravention of Clause 13 of LPG(Regulation of Supply and<br \/>\n               Distribution)Order 2000. The opposite party No.2 made seizure of LPG<br \/>\n               Gas Cylinders weighing 14.02 K.G and two others LPG Gas Cylinders<br \/>\n               weighing 5 K.G. each along with one gas regulator in presence of the<br \/>\n               witnesses. On the basis of the written report and the seizure list,<br \/>\n               Bistupur P.S. Case No.          257 of 2005 was registered against the<br \/>\n               petitioner for the offence under section 7 of the E.C. Act.\n<\/p>\n<p>               3.               Mr. Indrajeet Sinha, the learned counsel, for the petitioner<br \/>\n               exhorted that the informant, who was the Deputy Collector, Nazareth,<br \/>\n               was not within his competence to make search and seizure as he acted<br \/>\n               in contravention of Clause-13 of LPG (Regulation of Supply and<br \/>\n<span class=\"hidden_text\">                               2<\/span><\/p>\n<p>Distribution)Order, 2000. Clause-13 speaks about the power of entry,<br \/>\nsearch and seizure.\n<\/p>\n<p>      (1) Any officer of the Central or the State Government not<br \/>\nbelow the rank of Inspector duly authorized by a general or a<br \/>\nspecial order, by the Central Government or the State Government<br \/>\nas the case may be or any officer of Government Oil Company not<br \/>\nbelow the rank of Sales Officer, authorized by the Central<br \/>\nGovernment, may with a view to securing due compliance of this<br \/>\norder or any other made thereunder:\n<\/p>\n<blockquote><p>                   (a) stop and search any vessel or vehicle used<br \/>\n                   or capable of being used for the transport or<br \/>\n                   storage of any petroleum product.\n<\/p><\/blockquote>\n<blockquote><p>                   (b) enter and search any place.\n<\/p><\/blockquote>\n<blockquote><p>                   (c) seize stocks of liquefied petroleum gas along<br \/>\n                   with container and\/or equipments, such as<br \/>\n                   cylinders, gas cylinder valves, pressure<br \/>\n                   regulator and seals in respect of which he has<br \/>\n                   reason to believe that a contravention of this<br \/>\n                   order has been, or is being, or is about to be<br \/>\n                   made.<\/p><\/blockquote>\n<p>      (2) The sales officer of a Government Oil Company shall be<br \/>\nauthorized to secure compliance of this order by the distributors<br \/>\nappointed under the public distribution system and or by the<br \/>\nconsumer registered by them.\n<\/p>\n<p>4.           Admittedly, the informant\/opposite party No.2, an officer of<br \/>\nthe rank of the Deputy Collector, who made search and seizure in the<br \/>\nvehicle of the petitioner dealing in Fast Food ( Chinese) behind the hotel<br \/>\nknown as &#8220;New Chhappan Bhog&#8221; at Bistupur, was not authorized to<br \/>\nmake search and seizure and therefore, the criminal prosecution initiated<br \/>\nagainst the petitioner in contravention of specific provisions of law was<br \/>\nnot sustainable. The learned counsel relied upon the decision reported<br \/>\nin (2000) 8 S.C.C. 590.The Apex court in the case of Roy V.D Vs.<br \/>\nState of Kerala observed :-\n<\/p>\n<blockquote><p>                    &#8220;The power under section 482 Cr.P.C. has to be<br \/>\n                    exercised by the High Court, inter alia to prevent<br \/>\n                    the abuse of the process of any court or<br \/>\n                    otherwise to secure the ends of justice. Where<br \/>\n                    Criminal proceedings are initiated based on<br \/>\n                    illicit material collected on search and arrest<br \/>\n                    which are per se illegal and vitiate not only a<br \/>\n                    conviction and sentence based on such material<br \/>\n                    but also the trial itself, the proceedings cannot<br \/>\n                    be allowed to go on as it cannot but amount to<br \/>\n                    abuse of the process of the court; in such a case<br \/>\n                    not quashing the proceedings would perpetuate<br \/>\n                    abuse of the process of the court resulting in<br \/>\n                    great hardship and injustice to the accused. So,<br \/>\n                    exercise of power under section 482 Cr.P.C. to<br \/>\n                    quash proceedings in a case like one in hand,<br \/>\n                    would indeed secure the ends of justice.&#8221;\n<\/p><\/blockquote>\n<p>5.           Though it was urged on behalf of the State that          the<br \/>\nopposite party No.2 under the delegated         power of the       Deputy<br \/>\nCommissioner    acted   by conducting      the raids   but   the   Deputy<br \/>\n<span class=\"hidden_text\">                                        3<\/span><\/p>\n<p>         Commissioner had no authority to        delegate the power which was<br \/>\n         prohibited under the law.\n<\/p>\n<p>         6.            Regard been had to the facts and circumstances of the<br \/>\n         case, I find that Clause-13 of LPG (Regulation of Supply and<br \/>\n         Distribution) Order, 2000 is very specific that the authority delegated to<br \/>\n         the Opposite party No.2\/ Deputy Collector (Nazareth) by the Deputy<br \/>\n         Commissioner, East Singhbhum was not an authority delegated either<br \/>\n         by the Central Government or the State Government to conduct raid or<br \/>\n         to make certain seizure. Admittedly, the Deputy Commissioner is not the<br \/>\n         State Government under the        Rules of   Executive Business and in<br \/>\n         similar situation this Court in Cr.M.P. No. 722 of 2006 had quashed the<br \/>\n         criminal prosecution of the petitioner-accused on 13.10.2006 wherein<br \/>\n         also the authority of a Dy.Collector in making search and seizure was<br \/>\n         challenged and I find that defence of the petitioner stands on similar<br \/>\n         footing.\n<\/p>\n<p>         7.            Under the facts and circumstances, I observe that the<br \/>\n         criminal prosecution of the petitioner including the cognizance order<br \/>\n         dated 5.2.2006 passed by the Chief Judicial Magistrate, Jamshedpur in<br \/>\n         relation to Bistupur P.S.Case No.       257 of 2005 corresponding to<br \/>\n         G.R.No.2074 of 2005,now pending in the court of SDJM Jamshedpur is<br \/>\n         not maintainable under the law, accordingly the same is quashed. This<br \/>\n         petition is allowed.\n<\/p>\n<p>                       I.A.
