RADHAKRISHNAN, J.\n\n  = = = = = = = = = = = = = = = = = = = = = = = =\n\n            W.P.(C).No.13668 of 2009-C\n\n  = = = = = = = = = = = = = = = = = = = = = = = =\n\n     Dated this the 23rd day of December, 2009.\n\n                     JUDGMENT\n<\/pre>\n<p>1.The petitioner was born on 28.5.1981. His mother<\/p>\n<p> belongs to Hindu Cheramar (a Scheduled Caste).<\/p>\n<p> Ext.P1 SSLC book shows that petitioner belongs to<\/p>\n<p> Cheramar caste. That was issued on 28.3.1996.<\/p>\n<p> Thereafter, Ext.P2 caste certificate was issued<\/p>\n<p> in 2004 showing the petitioner as belonging to<\/p>\n<p> Hindu   Cheramar  caste.   Ext.P3  is   issued  on<\/p>\n<p> 22.8.2008 showing his caste as Hindu Cheramar.<\/p>\n<p> Ext.P4 shows that the petitioner had undergone<\/p>\n<p> course of study in trade &#8211; Mechanic Diesel.<\/p>\n<p> Thereafter, as of now, he has been selected for<\/p>\n<p> recruitment to the State Police.\n<\/p>\n<\/p>\n<p>2.When the petitioner applied for certificate as<\/p>\n<p> regards his caste, he found that the competent<\/p>\n<p> authority is not issuing a caste certificate<\/p>\n<p> afresh. He applied for a direction for grant of<\/p>\n<p> the certificate. With the passage of time, the<\/p>\n<p><span class=\"hidden_text\">WPC13668\/09           -: 2 :-<\/span><\/p>\n<p> official respondents started taking the stand<\/p>\n<p> that though the petitioner&#8217;s mother belongs to<\/p>\n<p> Hindu Cheramar caste, on enquiry, it is seen that<\/p>\n<p> as of now, the petitioner stays with his father,<\/p>\n<p> a Nadar Christian and who is estranged from the<\/p>\n<p> petitioner&#8217;s  mother;     that the petitioner is<\/p>\n<p> following the practices of a Nadar Christian and<\/p>\n<p> hence the officials came to the conclusion that<\/p>\n<p> the petitioner cannot be treated as belonging to<\/p>\n<p> Hindu Cheramar caste.\n<\/p>\n<\/p>\n<p>3.Born in the womb of a woman, identified as<\/p>\n<p> belonging to Hindu Cheramar caste and having been<\/p>\n<p> identified for all intents and purposes for more<\/p>\n<p> than two decades as belonging to that caste, the<\/p>\n<p> mere fact that the parents could not continue<\/p>\n<p> their matrimonial tie and were separated, does<\/p>\n<p> not mean that the child of an inter-caste couple<\/p>\n<p> should suffer the consequences. The petitioner<\/p>\n<p> was identified as belonging to Hindu Cheramar<\/p>\n<p> caste following the caste of his mother. Such<\/p>\n<p> status came to his aid for furtherance in life.<\/p>\n<p><span class=\"hidden_text\">WPC13668\/09           -: 3 :-<\/span><\/p>\n<p> With the passage of time, the Government have<\/p>\n<p> come forward with a Government Order which states<\/p>\n<p> that the caste status of the mother could also be<\/p>\n<p> relied on for issuing caste certificate of the<\/p>\n<p> child of an inter-caste couple. Fortunately, the<\/p>\n<p> intelligible      differentia      and      hostile<\/p>\n<p> classifications are slowly getting cleansed off.<\/p>\n<p> Having noticed the aforesaid situation, it goes<\/p>\n<p> without saying that the petitioner is entitled to<\/p>\n<p> be issued a caste certificate showing that he<\/p>\n<p> belongs to Hindu Cheramar caste (a Scheduled<\/p>\n<p> Caste) following the caste of his mother. It is<\/p>\n<p> so   declared and   it   is  further  ordered  that<\/p>\n<p> certificate in terms of this declaration shall be<\/p>\n<p> issued to the petitioner on production of a copy<\/p>\n<p> of   this  judgment.
