Sinha,<br \/>\n                                        Sr. Adv.\n<\/p>\n<p>                                     :Mr. Anita Kumari Singh, Adv.\n<\/p>\n<p>                  For the State     :Mrs. Indu Bala Pandey, APP<\/p>\n<p>2.   14.11.2011                 The      accused-         petitioners          have<\/p>\n<p>                  preferred this revision application against the<\/p>\n<p>                  order    dated       12.7.2011     passed       by    the     1st<\/p>\n<p>                  Additional          Sessions     Judge,     Bhagalpur         in<\/p>\n<p>                  Mojahidpur (Babarganj) P. S. Case No. 128 of<\/p>\n<p>                  2010, G. R. No. 2311 A of 2010 by which the<\/p>\n<p>                  petition      to    discharge    them    from   the    offence<\/p>\n<p>                  punishable under Sections 20\/22 of the N.D.P.S.<\/p>\n<p>                  Act has been rejected.\n<\/p>\n<p>                                The    prosecution   case,     in      brief,    is<\/p>\n<p>                  that    on    21.8.2010    after    getting       information<\/p>\n<p>                  that hue quantity of ganja is available in the<\/p>\n<p>                  Mill Premises of Lale Sah @ Mani Kant Sah in<\/p>\n<p>                  Gulab Bigha Mohalla, the S. I.                  Rajesh Kumar<\/p>\n<p>                  with    the     police    party    went     there      and    in<\/p>\n<p>                  presence       of the witnesses, the premises was<\/p>\n<p>                  searched and 40 packets containing 10 kg of<\/p>\n<p>                  Ganja each being total quantity of 147 kg. was<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>recovered. Accused Nawal Sah failed to produce<\/p>\n<p>any documents regarding the possession of the<\/p>\n<p>same and a case was registered under Section<\/p>\n<p>20\/22 of the N.D.P.S. Act. During investigation<\/p>\n<p>it appears that the petitioners were indulged<\/p>\n<p>in   this   illegal       possession       of       ganja    in   the<\/p>\n<p>premises of the mill of co-accused Nawal Sah.<\/p>\n<p>Accordingly,       the    charge-sheet          was       submitted.<\/p>\n<p>Cognizance        was     taken      and       the         case   was<\/p>\n<p>transferred       to     the    Court     of    1st       Additional<\/p>\n<p>Sessions Judge for trial where a petition dated<\/p>\n<p>10.6.2011     filed       on     behalf    of       the     accused-<\/p>\n<p>petitioners under Section 227 Cr.P.C. for their<\/p>\n<p>discharge    has        been    rejected       by     the    learned<\/p>\n<p>trial Court.\n<\/p>\n<pre>            The        main      contention           of     learned\n\ncounsel     for     the        petitioners          is     that   the\n\npetitioners       have    been     falsely      implicated         in\n\n<\/pre>\n<p>this case at the instance of the main accused<\/p>\n<p>Nawal Sah which can be said to be a defence<\/p>\n<p>version of Nawal Sah. After much delay, the<\/p>\n<p>witnesses have stated that the petitioners have<\/p>\n<p>taken premises of rice mill for business of<\/p>\n<p>Dalada and coconut oil from where the ganja has<\/p>\n<p>been recovered. Neither the seizure witnesses<\/p>\n<p>nor co-accused Nawal Sah has stated anything in<br \/>\n<span class=\"hidden_text\">                     3<\/span><\/p>\n<p>their statement.\n<\/p>\n<p>            Learned counsel for the State submits<\/p>\n<p>that during investigation independent witnesses<\/p>\n<p>have stated that paddy mill of accused Nawal<\/p>\n<p>Sah was closed and one of the rooms of paddy<\/p>\n<p>mill had been let out to the petitioners for<\/p>\n<p>the business of coconut oil and dalada, from<\/p>\n<p>that let out room ganja has been recovered.<\/p>\n<p>Learned counsel for the State has referred to<\/p>\n<p>several paragraph of the case-diary including<\/p>\n<p>paragraph nos. 58, 59, 60, 36 and 37 of the<\/p>\n<p>case-    diary    to    show    the    involvement       of   the<\/p>\n<p>petitioners in this offence. She has further<\/p>\n<p>submitted that rice mill was closed and to meet<\/p>\n<p>the household expenses the godown of the mill<\/p>\n<p>was given to the accused Md. Raza prior to a<\/p>\n<p>few months from the date of occurrence on the<\/p>\n<p>basis of a Kirayanama and since that date it<\/p>\n<p>was in possession of accused Md. Raza and his<\/p>\n<p>companions co-accused Inamul @ Nihal for the<\/p>\n<p>trade of coconut oil and the godown was under<\/p>\n<p>lock of the petitioners.\n<\/p>\n<p>            After       hearing       learned     counsel     for<\/p>\n<p>both the parties and on perusal of the impugned<\/p>\n<p>order,     it    appears       that     learned       Additional<\/p>\n<p>Sessions    Judge       has    considered       the    material<br \/>\n<span class=\"hidden_text\">                             4<\/span><\/p>\n<p>          available    in   the   case-diary   and    has    found<\/p>\n<p>          sufficient    material    on    record    for    framing<\/p>\n<p>          charge against the petitioners.<\/p>\n<p>                      Considering        the       facts       and<\/p>\n<p>          circumstances stated above, I do not find any<\/p>\n<p>          ground to interfere with the impugned order.<\/p>\n<p>          This petition is dismissed.\n<\/p>\n<\/p>\n<pre>Kanchan                         (Amaresh Kumar Lal, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Md.
