The said suit of the plaintiffs was dismissed by<\/p>\n<p>the Civil Judge (Junior Division), Faridabad vide judgment and decree dated<\/p>\n<p>17.9.2007. Aggrieved by the same, plaintiffs filed an appeal and the same<\/p>\n<p>was partly accepted by the Additional District Judge(I) Faridabad vide<\/p>\n<p>judgment and decree dated 7.4.2008 and the suit was decreed to the effect<\/p>\n<p>that defendant is restrained from dispossessing the plaintiff from the suit<\/p>\n<p>land without following the due course of law. Hence, the present appeal has<\/p>\n<p>been filed by the plaintiffs.\n<\/p>\n<p>                The case of the parties, as noticed by the learned Additional<\/p>\n<p>District Judge (I) in paras 2 to 4 of its judgment reads as under:-<\/p>\n<blockquote><p>          &#8220;2.Briefly stated the facts of the present plaintiffs&#8217; case as alleged<\/p>\n<p>          are that the plaintiffs are in cultivating possession of the suit land<\/p>\n<p>          situated in village Mujessar, Tehsil Ballabagarh, Distt. Fardiabad<br \/>\n<span class=\"hidden_text\"> RSA No.2333 of 2008                                                          2<\/span><\/p>\n<p>          as tenants at Will at the rate of Rs.25.19 per annum since last 40<\/p>\n<p>          years. They are cultivating the suit land as tenants at nominal rent<\/p>\n<p>          and during this period the rent of the land in suit has never been<\/p>\n<p>          increased. Earlier father of the plaintiffs Shri Hukam Singh was<\/p>\n<p>          cultivating the suit land on the same terms and conditions and<\/p>\n<p>          presently the land is being cultivated by the plaintiffs. At the time<\/p>\n<p>          of inception of tenancy, it was agreed between the parties that the<\/p>\n<p>          plaintiffs and predecessor in interest shall never be dispossessed<\/p>\n<p>          from the suit land and nor the rent of the suit land shall be<\/p>\n<p>          increased. The plaintiffs have acquired ownership rights in the<\/p>\n<p>          land in suit by virtue of acquisition of occupancy rights, but the<\/p>\n<p>          defendant wants to dispossesses the plaintiffs without any right to<\/p>\n<p>          do so. Hence, the present suit was filed.<\/p>\n<blockquote><p>          3.The respondent was ex-parte before the learned trial court as<\/p>\n<p>          well as before this court.<\/p><\/blockquote>\n<p>          4. The plaintiffs\/ appellants led their evidence in support of their<\/p>\n<p>          case and the learned trial court dismissed the suit with costs vide<\/p>\n<p>          impugned judgment and decree dated 17.9.2007<\/p>\n<p>               Learned counsel for the appellants has argued that the rights<\/p>\n<p>of the plaintiffs had matured as occupancy tenants as the intention could be<\/p>\n<p>inferred from the circumstances that the plaintiffs were not liable to be<\/p>\n<p>ejected by the landlord. Learned counsel has placed reliance on Muni Ram<\/p>\n<p>and others vs. Phullia and Lalu 1974 PLJ 369.\n<\/p>\n<p>               After hearing the learned counsel for the appellants, I am of<\/p>\n<p>the opinion that this appeal is devoid of any merit.<\/p>\n<p>               Plaintiffs had filed a suit for declaration that they had<br \/>\n<span class=\"hidden_text\"> RSA No.2333 of 2008                                                         3<\/span><\/p>\n<p>become owner of the suit land by acquisition of occupancy rights under<\/p>\n<p>Sections 5 and 8 of the Punjab Tenancy Act, 1887 (for short `the Act&#8217;).<\/p>\n<p>Defendant-Union of India was proceeded ex-parte before the trial Court.<\/p>\n<p>Plaintiffs led their ex-parte evidence in support of their case. Learned<\/p>\n<p>Additional District Judge in the judgment has observed that as per entry<\/p>\n<p>Exhibit P1, Khasra Girdwari, possession of the plaintiffs was reflected in<\/p>\n<p>the suit land from Kharif 2003 onwards. Father of the plaintiffs was in<\/p>\n<p>possession of the suit land as a tenant. Only a sum of Rs. 25.19 ps has been<\/p>\n<p>recorded as `chakota&#8217; and the same could not be treated as nominal rent.<\/p>\n<p>Plaintiffs had failed to establish that the said amount was equal of the land<\/p>\n<p>revenue or cess which was payable with regard to the suit land. Plaintiffs<\/p>\n<p>had also failed to lead any documentary evidence with regard to the<\/p>\n<p>payment of alleged nominal rent of `chakota&#8217; or that they had deposited the<\/p>\n<p>amount as land revenue or cess. Section 5 of the Act reads as under:-<\/p>\n<blockquote><p>          &#8220;5. Tenants having right of occupancy.- (1) A tenant-<\/p>\n<\/blockquote>\n<blockquote><p>                      (a) who at the commencement of this Act has, for more<\/p>\n<p>                      than two generations in the male line of descent through<\/p>\n<p>                      a grand- father or grand- uncle and for a period of not<\/p>\n<p>                      less than twenty years, been occupying land paying no<\/p>\n<p>                      rent therefore beyond the amount of the land revenue<\/p>\n<p>                      thereof and the rates and cesses for the time being<\/p>\n<p>                      chargeable thereon,or<\/p>\n<\/blockquote>\n<blockquote><p>                      (b) who having owned land, and having ceased to be<\/p>\n<p>                      landowner thereof otherwise than by forfeiture to the<\/p>\n<p>                      Government or than by any voluntary act, has since he<\/p>\n<p>                      ceased to be landowner continuously occupied the<br \/>\n<span class=\"hidden_text\"> RSA No.2333 of 2008                                                           4<\/span><\/p>\n<p>                      land,or<\/p>\n<\/blockquote>\n<blockquote><p>                      (c) who, in village or estate in which he is settled along<\/p>\n<p>                      with or was settled by the founder thereof as a cultivator<\/p>\n<p>                      therein occupied land on the twenty first day of<\/p>\n<p>                      October, 1868, and has continuously occupied the land<\/p>\n<p>                      since that date, or<\/p>\n<\/blockquote>\n<blockquote><p>                      (d)who being jagirdar of the estate or any part of the<\/p>\n<p>                      estate in which the land occupied by him is situate has<\/p>\n<p>                      continuously occupied the land for not les than twenty<\/p>\n<p>                      years, or having been such jagirdar occupied the land<\/p>\n<p>                      while he was jagirdar and has continuously occupied it<\/p>\n<p>                      for not less than twenty years;\n<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>          has a right of occupancy in the land so occupied, unless, in the<\/p>\n<p>         case of a tenant belonging to the class specified in clause(c), the<\/p>\n<p>         landlord proves that the tenant was settled on land previously<\/p>\n<p>         cleared and brought under cultivation by, or at the expense of, the<\/p>\n<p>         founder.\n<\/p><\/blockquote>\n<blockquote><p>         (2) if a tenant proves that he has continuously occupied land for<\/p>\n<p>         thirty years and paid no rent thereof beyond the amount of the<\/p>\n<p>         land revenue thereof and the rates and cesses for time being<\/p>\n<p>         chargeable thereon it may be presumed that he has fulfilled the<\/p>\n<p>         conditions of clause(a) of sub-section (1)<\/p>\n<p>         (3) The words in that clause denoting natural relationship denotes<\/p>\n<p>         also relationship by adoption, including therein the customary<\/p>\n<p>         appointment of an heir and relationship, by the usuage of a<\/p>\n<p>         religious community.&#8221;\n<\/p><\/blockquote>\n<p><span class=\"hidden_text\"> RSA No.2333 of 2008                                                          5<\/span><\/p>\n<blockquote>\n<\/blockquote>\n<p>As per the same, a person can be treated as a occupancy tenant either if he is<\/p>\n<p>paying the lease money equal of the land revenue or cess and further that he<\/p>\n<p>is tenant over the suit property since last three generations. Plaintiffs had,<\/p>\n<p>however, failed to prove their case.\n<\/p>\n<p>               The judgment relied upon by the learned counsel for the<\/p>\n<p>appellants fails to advance the case of the appellants in the facts and<\/p>\n<p>circumstances of the present case.\n<\/p>\n<p>               Learned District Judge rightly held that the plaintiffs had<\/p>\n<p>failed to prove that they were in possession of the suit land since the time of<\/p>\n<p>their grand father and `chakota&#8217; amount was equal to rates and cesses for the<\/p>\n<p>time being charged on the land. Hence, the present appeal is liable to be<\/p>\n<p>dismissed.\n<\/p>\n<p>               No substantial question of law arises in this case which<\/p>\n<p>would warrant interference by this Court.
