{"id":193908,"date":"2008-11-04T00:00:00","date_gmt":"2008-11-03T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/kusum-lata-vs-haryana-urban-development-on-4-november-2008"},"modified":"2017-11-22T18:48:17","modified_gmt":"2017-11-22T13:18:17","slug":"kusum-lata-vs-haryana-urban-development-on-4-november-2008","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/kusum-lata-vs-haryana-urban-development-on-4-november-2008","title":{"rendered":"Kusum Lata vs Haryana Urban Development &#8230; on 4 November, 2008"},"content":{"rendered":"<div class=\"docsource_main\">Punjab-Haryana High Court<\/div>\n<div class=\"doc_title\">Kusum Lata vs Haryana Urban Development &#8230; on 4 November, 2008<\/div>\n<pre>Civil Writ Petition No. 8241 of 2007                              [1]\n\n  IN THE HIGH COURT OF PUNJAB AND HARYNA AT CHANDIGARH.\n\n              Civil Writ Petition No.8241 of 2007\n\n                                              Date of decision: 4.11.2008\n\nKusum Lata\n                                                     ....Petitioner.\n                             Vs.\n\nHaryana Urban Development Authority and another\n                                         ....Respondents.\n\n\nCORAM:        HON'BLE MR.JUSTICE UMA NATH SINGH.\n              HON'BLE MRS.JUSTICE DAYA CHAUDHARY.\n\nPresent:      Mr.Amit Jain, Advocate for petitioner.\n              Mr.Raghujit Singh Madan, Advocate, for respondents.\n                              ****\n\nDAYA CHAUDHARY, J.\n<\/pre>\n<p>              The present writ petition has been filed for quashing of<\/p>\n<p>order dated 6.2.2007 (Annexure P-10) passed by Estate Officer,<\/p>\n<p>HUDA, Panipat, vide which the representation of the petitioner filed<\/p>\n<p>in pursuance of the order passed in Civil Writ Petition No. 12978 of<\/p>\n<p>2006 has been rejected, and further for issuance of a direction to the<\/p>\n<p>respondents to allot a plot measuring 2100 sq. metres in Sector -29,<\/p>\n<p>Part-II, Industrial Estate, Urban Estate, Panipat.<\/p>\n<p>              Briefly the facts of the case as taken from the writ petition<\/p>\n<p>are that respondents offered 19 industrial plots measuring 2100 sq.<\/p>\n<p>metres in Sector 29, Part-II, Industrial Estate, Panipat and<\/p>\n<p>applications from various categories of entrepreneurs were invited.<\/p>\n<p>The petitioner applied for the said plot and submitted application on<\/p>\n<p>20.3.2005. After completing all formalities, the petitioner appeared in<\/p>\n<p>the    interview.      The     respondents,     on    the    basis      of   the<\/p>\n<p>documents\/project report, considered the case of the petitioner but<br \/>\n Civil Writ Petition No. 8241 of 2007                         [2]<\/p>\n<p>the same was rejected.           The amount submitted by the petitioner<\/p>\n<p>along with the application was returned. The petitioner filed Civil Writ<\/p>\n<p>Petition No. 12978 of 2006 which was disposed of vide order dated<\/p>\n<p>21.8.2006 with a direction to respondent No.2 to consider the claim<\/p>\n<p>of the petitioner and pass a detailed and speaking order. It was also<\/p>\n<p>directed that for that purpose, the petitioner would file a detailed<\/p>\n<p>comprehensive representation by appending all relevant documents.<\/p>\n<p>              In pursuance of the orders passed by this Court, the<\/p>\n<p>petitioner submitted a detailed        comprehensive representation on<\/p>\n<p>28.8.2006 and the same was rejected by the respondent-authorities<\/p>\n<p>vide order dated 6.2.2007, which is subject matter of challenge in the<\/p>\n<p>present writ petition.\n<\/p>\n<p>              Mr.Amit Jain, learned counsel for the petitioner, has<\/p>\n<p>argued that respondent authorities have not passed a detailed<\/p>\n<p>speaking order and no reasons whatsoever have been given while<\/p>\n<p>rejecting the claim of the petitioner. It has also been argued by<\/p>\n<p>Mr.Jain that performance of the petitioner was quite satisfactory in<\/p>\n<p>the interview but her case has wrongly been rejected on the ground<\/p>\n<p>that petitioner was found ignorant about her proposed project. It has<\/p>\n<p>also been argued that the claim of the petitioner has wrongly been<\/p>\n<p>rejected without considering the project report on merits.<\/p>\n<p>              Written statement has been filed on behalf of              the<\/p>\n<p>respondents, which is on record.\n<\/p>\n<p>              Mr. Raghujit Singh Madan, learned counsel appearing on<\/p>\n<p>behalf of respondent Nos.1 and 2,            has argued that petitioner<\/p>\n<p>appeared before the interview committee and was not found well<\/p>\n<p>conversant      even with the details of the project report        submitted<br \/>\n Civil Writ Petition No. 8241 of 2007                      [3]<\/p>\n<p>along with the application. He further argued that as per report of the<\/p>\n<p>interview committee, the petitioner was found ignorant about the<\/p>\n<p>proposed      project as she was not     even aware of the details as<\/p>\n<p>contained in the project report and was not found to be genuine<\/p>\n<p>woman entrepreneur            and her case was not recommended for<\/p>\n<p>allotment of industrial plot.\n<\/p>\n<p>              We have heard the arguments of learned counsel for<\/p>\n<p>parties and perused the documents on record.\n<\/p>\n<p>              We have also seen the rejection order which is quite<\/p>\n<p>comprehensive and detailed one where sufficient reasons for not<\/p>\n<p>considering petitioner&#8217;s claim have been given. The opinion of the<\/p>\n<p>interview committee cannot be interfered with and     the performance<\/p>\n<p>of the petitioner cannot be judged only by saying that she was good<\/p>\n<p>in the interview. It is a specific case of the respondents that the<\/p>\n<p>petitioner was not conversant with the project report submitted and<\/p>\n<p>was not well aware of the proposed report.\n<\/p>\n<p>              In view of the facts mentioned above, we do not find it a<\/p>\n<p>fit case for interference.
