Rule.\n<\/p>\n
Mr. L.B.Dabhi, learned Additional Public Prosecutor waives service of
\nnotice of Rule on behalf of the respondent State.\n<\/p>\n
2.\t\tThis
\napplication has been filed under section 439 of the Code of Criminal
\nProcedure, for grant of bail, in connection with FIR, being Cr.No.
\nI-145 of 2008, registered with Santrampur Police Station, for
\noffences punishable under sections 304-A and 114, of the Indian Penal
\nCode and sections 3 and 5 of Medical Practitioners Act.\n<\/p>\n

\n\t\tIt appears from the FIR that the deceased was a student of standard
\n10 in Adarsh Madhyamik Shala which was run by a Trust. The applicant
\nis the  Rector of the Hostel. The deceased who was staying in a
\nhostel of the school, fell ill and was taken to two doctors by the
\napplicant and Principal of the school. After treatment administered
\nby the said two doctors, the condition of the deceased deteriorated
\nand he was taken to Lunavada Cottage Hospital. However, the  deceased
\nexpired on the way and was declared dead. The allegation in the
\ncomplaint is that the applicant is involved in the commission of the
\nabove-mentioned offences.\n<\/p>\n

\n\t\tMr. B.S.Patel, learned counsel for the applicant has submitted that
\nthe applicant is innocent and is not involved in the commission of
\nthe offence. That the applicant is the Rector of the hostel run by
\nthe Trust and when the boy (deceased) fell ill, the applicant,
\nalongwith Principal of the school, immediately took him to the Doctor
\nwithout having any idea that the Doctor does not possess a valid
\ndegree. In fact,  both the doctors to whom the applicant took the
\ndeceased boy are popular in the area and are having a number of
\npatients. That the applicant has not committed any act of negligence,
\nand on the contrary, has made all  efforts to see that the deceased
\nboy gets proper treatment, in time. The complainant has falsely
\nimplicated the applicant which can be  gauged  by the fact that the
\nincident took place on 24.7.2008 and the FIR has been lodged on
\n22.11.2008. That the applicant has a very good reputation in the area
\nand is a known person.  That as the applicant is not involved in the
\ncommission of the alleged offence, the Court may exercise discretion
\nin his favour.\n<\/p>\n

\n\t\tOn the other hand, Mr. L.B.Dabhi, learned Additional Public
\nProsecutor has opposed the grant of anticipatory bail to the
\napplicant.\n<\/p>\n

\n\t\tI have heard the learned counsel for the respective parties,
\nperused the averments made in the application, contents of the FIR
\nand other documents on record.\n<\/p>\n

\n      It appears from a perusal of the material on record that the
\napplicant, who is a Rector of the School in which the deceased boy
\nwas studying, took the boy to two doctors who were having a good
\npractice in the area. Apparently, the treatment administered by one
\nDr. Paresh may have led to deterioration in the condition of the
\ndeceased boy as alleged and thereafter, the boy was taken to Lunavada
\nCottage Hospital, where he was declared dead.\n<\/p>\n
8.\t\tThe
\nnarration of events in the FIR, prima facie, does not implicate the
\napplicant as it does not transpire that he has been negligent or is
\ninvolved in the commission of the offence as alleged. Being a Rector
\nof the Hostel, it appears that he has taken care to take the deceased
\nboy to the doctor as soon as possible. In the facts and circumstances
\nof the case, considering the nature of offences alleged and the
\nmanner in which death occurred, it is a fit case in for grant of
\nbail.\n<\/p>\n
9.\t\tIt
\nis accordingly, allowed. The applicant is ordered to be released on
\nbail in connection with FIR being C.R.No.I-145
\nof 2008  registered with Santrampur Police Station on his
\nexecuting a personal bond to the tune of Rs.10,000\/-  (Rupees Ten
\nthousand only) with one solvent surety of the like amount to the
\nsatisfaction of the trial Court subject to the conditions that the
\napplicant :\n<\/p>\n
\ta)\tshall
\n\tnot take undue advantage of his liberty or abuse his liberty in any
\n\tmanner;\n<\/p>\n
\tb)
\n\tshall not act in a manner injurious to the interest of the
\n\tprosecution or tamper with evidence or intimidate witnesses;\n<\/p>\n
\tc)
\n\t \t shall maintain law and order and shall cooperate fully with the
\n\tinvestigating officers and shall make himself available for
\n\tinvestigation, as and whenever directed ;\n<\/p>\n
\td)
\n\t\t shall mark his presence
\n\tbefore the Investigating Officer of the concerned Police Station  on
\n\t15th and 30th of every English calendar month,
\n\tbetween 10:00 am and 5:00 pm, till the commencement of the trial.\n<\/p>\n
\te)\tshall
\n\tnot leave the local limits of the State of Gujarat without the prior
\n\tpermission of the concerned Sessions Judge;\n<\/p>\n
\tf)\tshall
\n\tfurnish his residential address to the Investigating Officer and
\n\talso to the court at the time of execution of the bond and shall not
\n\tchange his residential address without prior permission of this
\n\tCourt;\n<\/p>\n
\tg)\tshall
\n\tsurrender his Passport, if any, to the lower Court within a week.\n<\/p>\n
\th)
\n\tIf the applicant commits breach of any of the above conditions, the
\n\tconcerned Sessions Judge will be free to issue warrants or take
\n\tappropriate action in the matter.\n<\/p>\n
10.\t\tIt
\nis made clear that no observations made by this Court be construed as
\nhaving any bearing on the merits of the case, at the time of the
\ntrial. The trial Court will proceed in accordance with law,
\nunaffected and uninfluenced by any observations contained in this
\norder.\n<\/p>\n
11.\t\tBail
\nbefore the lower Court having jurisdiction to try the case. It would
\nbe open to the trial Court concerned to give time to furnish the
\nsolvency certificate, if prayed for.\n<\/p>\n
12.\t\tRule
\nis made absolute. Direct Service is permitted.\n<\/p>\n
