Justice P.Q.BARKATH ALI\n\n Dated :23\/12\/2009\n\n O R D E R\n                     C.N.RAMACHANDRAN NAIR &amp;\n                             P.Q.BARKATH ALI, JJ.\n                ....................................................................\n                         Writ Appeal No.2562 of 2009\n                ....................................................................\n               Dated this the 23rd day of December, 2009.\n\n                                       JUDGMENT\n<\/pre>\n<p>Ramachandran Nair, J.\n<\/p>\n<p>      Question raised is whether stainless steel fan hooks made by the<\/p>\n<p>appellant which is a small scale industrial unit, from stainless steel rods<\/p>\n<p>attract tax at 12.5% under Entry 103 of Notification SRO 82\/006 or<\/p>\n<p>whether it is an item falling under sub-entries 21 or 22 of Entry 43 of<\/p>\n<p>the IIIrd Schedule to the KVAT Act as claimed by the appellant. We<\/p>\n<p>have heard counsel for the appellant and Government Pleader for the<\/p>\n<p>respondent.\n<\/p>\n<p>      2. Counsel for the appellant first submitted that all other dealers<\/p>\n<p>in stainless steel fan hooks are assessed at the rate of 4% treating the<\/p>\n<p>item as one falling under Entry 43 of the IIIrd Schedule.                               A<\/p>\n<p>clarification issued by the Commissioner in the case of another party<\/p>\n<p>vide order No.C7.58114\/05\/CT dated 28.7.2006 is produced in court.<\/p>\n<p>Among the items on which rate of tax is clarified, one item is hooks<\/p>\n<p>and eyes which is made taxable at 12.5%. The contention of counsel<\/p>\n<p><span class=\"hidden_text\">                                          2<\/span><\/p>\n<p>for the appellant is that hooks and eyes go together and those items are<\/p>\n<p>attachments to windows and the hooks referred to therein is not fan<\/p>\n<p>hook. We find force in this contention because items clarified by the<\/p>\n<p>Commissioner vide order abovereferred are fittings for door, window<\/p>\n<p>etc. Fan hook is not specifically covered under the clarification, even<\/p>\n<p>though MS Clamp for fan fittings is covered by Entry 14. The two<\/p>\n<p>items covered by sub-entries 21 and 22 of Entry 43 of the IIIrd<\/p>\n<p>Schedule are the following:\n<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<\/p>\n<p>Sl.No.               Description of goods                      HSN Code<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n(21) Bars and rods, hot-rolled, in irregularly                 7221<br \/>\n       wound coils, of stainless steel<\/p>\n<p>(22) Other bars and rods or stainless steel; angles,           7222<br \/>\n       shapes and sections of stainless steel: Bars<br \/>\n       and rods, not further worked than hot-rolled,<br \/>\n       hot-drawn or extruded.\n<\/p>\n<p>&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<\/p>\n<p>The contention of counsel for the appellant is that stainless steel<\/p>\n<p>products are covered by the above two entries. His further contention<\/p>\n<p>is that fan hook is nothing but stainless steel rod cut to sizes and bent<\/p>\n<p><span class=\"hidden_text\">                                   3<\/span><\/p>\n<p>on either side without any manufacturing activity. We find force in the<\/p>\n<p>contention that the manipulation done on steel rod to make it hook is a<\/p>\n<p>simple work of bending by hand or mechanically. Admittedly semi-<\/p>\n<p>finished steel products and angles, shapes, bars and rods of stainless<\/p>\n<p>steel products are covered by Entries 21 and 22.   Since stainless steel<\/p>\n<p>fan hook is not specifically covered by the entry, it is for the<\/p>\n<p>Commissioner to clarify whether such products are intended to be<\/p>\n<p>covered by sub-entries 21 and 22 of Entry 43. We are in agreement<\/p>\n<p>with the assessee&#8217;s contention that hooks and eyes referred to in the<\/p>\n<p>clarification abovereferred do not include fan hooks.       Admittedly<\/p>\n<p>stainless steel fan hook is not covered even under Notification SRO<\/p>\n<p>82\/2006 except under the residuary entry of the notification, namely,<\/p>\n<p>Entry 103, if the item is not covered by any other Schedule entry or<\/p>\n<p>under any other Entry of the Notification. Counsel also pointed out<\/p>\n<p>that value added product like stainless steel nails under the above<\/p>\n<p>clarification is subject to tax only at 4%.     Since the item is not<\/p>\n<p>specifically covered by any of the entries or under the Notification, we<\/p>\n<p>direct the Commissioner to clarify on the rate of tax on stainless steel<\/p>\n<p><span class=\"hidden_text\">                                    4<\/span><\/p>\n<p>fan hooks on an application to be filed by the appellant along with copy<\/p>\n<p>of this judgment, which the appellant is directed to do within ten days<\/p>\n<p>from the date of receipt of copy of this judgment. The Assessing<\/p>\n<p>Officer will modify the rate of tax in the assessment, if the<\/p>\n<p>Commissioner issues clarification on rate of tax at variance with the<\/p>\n<p>rate applied by the officer. There will be direction to the respondents<\/p>\n<p>not to recover the excess rate of tax assessed from the appellant for two<\/p>\n<p>months from now. The Commissioner is directed to pass orders on the<\/p>\n<p>clarification application within one month from the date of receipt of<\/p>\n<p>the application.
