From 16.6.2005 to<\/p>\n<p>19.2.2007 she was working in the           Calf Feed Subsidy<\/p>\n<p>Scheme office at Thalayolaparambu in Kottayam District.<\/p>\n<p>According to her, On account of illness she could not<\/p>\n<p>undertake long distance travel and on that basis<\/p>\n<p>representations were made seeking convenient posting in<\/p>\n<p>a Dispensary.   This was considered and by Exhibit-P1<\/p>\n<p>order of the 2nd respondent, petitioner was posted at the<\/p>\n<p>Veterinary Dispensary, Memmury in Kottayam District. In<\/p>\n<p>her place, the 3rd respondent who was then working at<\/p>\n<p>Champakkara at Kottayam was transferred and posted. By<\/p>\n<p>Exhibit-P2 order on 1.8.2007, she has been transferred<\/p>\n<p>out from the Veterinary Dispensary, Memmury and posted<\/p>\n<p>in   the  Calf    Feed     Subsidy      Scheme    Office  at<\/p>\n<p>Thalayolaparambu in Kottayam District and the 3rd<\/p>\n<p>respondent is posted at Memmury. Alleging that it is only<\/p>\n<p>to accommodate the 3rd respondent in her own old chosen<\/p>\n<p>W.P ( C) No. 24015 of 2007<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>place that this writ petition has been filed. Thereafter, she made<\/p>\n<p>Exhibit -P3 representation before the 2nd respondent seeking<\/p>\n<p>review of the order of transfer.        The petitioner has placed<\/p>\n<p>reliance on Exhibits P4 and P5, Exhibit-P4 is the Caste<\/p>\n<p>Certificate certifying that she belongs to        Scheduled Caste<\/p>\n<p>community.      Exhibit-P5 is the guidelines         issued by the<\/p>\n<p>Government, wherein, certain reservations are provided for in<\/p>\n<p>favour of candidates belonging to SC\/ST category, the benefit of<\/p>\n<p>which is claimed by her.\n<\/p>\n<p>      2.   It is settled law that this court can interfere with an<\/p>\n<p>order of transfer, if there is a positive finding of malafides or on<\/p>\n<p>grounds of illegalities. This case, at best is one of violation of<\/p>\n<p>guidelines which does not confer any right enforceable under<\/p>\n<p>Article 226 of the Constitution of India. Hence I do not find any<\/p>\n<p>ground to interfere with the order of transfer.<\/p>\n<p>      3.   The petitioner has highlighted her grievances in Ext-<\/p>\n<p>P3 representation before the 2nd respondent which is pending.<\/p>\n<p>In the circumstances, it is ordered that the 2nd respondent shall<\/p>\n<p>take up and consider Ext.P3 representation filed by the<\/p>\n<p>petitioner as expeditiously as possible, at any rate within four<\/p>\n<p>W.P ( C) No. 24015 of 2007<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>weeks from the date of receipt of a copy of this judgment.<\/p>\n<p>      The petitioner is directed to produce a copy of this<\/p>\n<p>judgment before the 2nd respondent, for compliance.<\/p>\n<p>     The writ petition is disposed of as above.<\/p>\n<p>                                  (ANTONY DOMINIC,JUDGE)<br \/>\nma<\/p>\n<p>W.P ( C) No. 24015 of 2007<br \/>\n<span class=\"hidden_text\">                            4<\/span><\/p>\n<p>                               K.THANKAPPAN,J<\/p>\n<p>                              CRL.A.
