He also submitted that the applicant<br \/>\nhas been working sincerely, honestly and diligenty as Sanitary Sub<br \/>\nInspector and his work has been appreciated by the Commissioner of<br \/>\nSuarat Municipal Corporation. He also submitted that looking to the<br \/>\nquantum of punishment for the alleged offence under the provisions of<br \/>\nPrevention of Corruption Act, would be 7 years. There are several ACB<br \/>\nCases is pending before the trial Court. The applicant is only bread<br \/>\nwinner in his family.  Therefore, he prayed to enlarge the applicant<br \/>\nby imposing suitable conditions.\n<\/p>\n<p>3.\tLearned<br \/>\nAPP Mr. Maulik Nanavati for the State strongly opposed the bail<br \/>\napplication of the applicant. He submitted that the applicant being<br \/>\npublic servant involved in the serious offence under the provisions<br \/>\nof Prevention of Corruption Act and therefore, considering the<br \/>\ngravity of the offence, seriousness of the offence,, discretion may<br \/>\nnot be exercised in favour of the applicants.\n<\/p>\n<p>4.\tParties<br \/>\ndo not press for reasoned order.\n<\/p>\n<p>5.\tI<br \/>\nhave perused the papers and from the record, it appears that presence<br \/>\nof the applicant is secured as he is public servant. Having<br \/>\nconsidered the rival submissions and on perusal of the role<br \/>\nattributed to the applicants as reflected in the FIR, police papers,<br \/>\nprovisions under the Prevention of Corruption Act, quantum of<br \/>\npunishment etc., I am of the view that the applicants deserve to be<br \/>\nenlarged on bail. At the stage of bail, this Court is not going into<br \/>\nmerit of the case.\n<\/p>\n<p>6.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be enlarged on bail in connection<br \/>\nwith CR No. 12 of 2011 registered at ACB Police Station, Surat on his<br \/>\nexecuting  bond of Rs.10,000\/- [Rupees ten thousand only] with one<br \/>\nsurety of the like amount to the satisfaction of the Trial Court and<br \/>\nsubject to the conditions that he shall:\n<\/p>\n<p>a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>b)\tnot<br \/>\nto try to tamper or pressurise the prosecution witnesses or<br \/>\ncomplainant in any manner;\n<\/p>\n<p>c)\tmaintain<br \/>\nlaw and order and should cooperate the Investigating Officers;\n<\/p>\n<p>d)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>e)\tnot<br \/>\nleave the country without the prior permission of the concerned<br \/>\nSessions Judge.\n<\/p>\n<p>f)\tfurnish<br \/>\nthe address of his residence to the I.O. and also to the Court at the<br \/>\ntime of execution of the bond and shall not change the residence<br \/>\nwithout prior permission of this Court;\n<\/p>\n<p>g)\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tAt<br \/>\nthe trial, the Trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>9.\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case. It would<br \/>\nbe open to the trial Court concerned to give time to furnish the<br \/>\nsolvency certificate if prayed for.\n<\/p>\n<p>10.\tRule<br \/>\nis made absolute to the aforesaid extent.
