UP Secondary Education Services\nSelection Board and others\nHon'ble Sudhir Agarwal, J.<\/a>\n<\/pre>\n<p>1.    Heard Sri Prakash Padia, learned counsel for the petitioner<br \/>\nand learned Standing Counsel for respondents no. 2 and 3, Sri H.P.<br \/>\nSingh for respondent no.1 and Sri R.R. Singh for respondent no.7.\n<\/p>\n<p>2.    The grievance of the petitioner is that for selection to the post<br \/>\nof Principal in the institution Adarsh Uchchtar Madhyamik Vidyalaya,<br \/>\nRishi Ashram Alhadpur, Aligarh (hereinafter referred to as &#8220;the<br \/>\ninstitution&#8221;) though he is officiating as Principal since 1.7.2006, he<br \/>\nwas not called though under the statute two seniormost teachers of<br \/>\nthe institution had to be called for direct recruitment for the post of<br \/>\nPrincipal.\n<\/p>\n<p>3.    However, from the counter affidavit filed on behalf of<br \/>\nrespondent no.4 it is evident that the post of Principal was occupied<br \/>\nby one Shiv Charan Lal Saraswat who retired on 30.6.2006. Sri<br \/>\nMahavir Prasad Sharma was the seniormost teacher in the<br \/>\ninstitution who refused to officiate as Principal and thereafter there<br \/>\nwere two other teachers at seniority at serial no.2 and 3, i.e., Hari<br \/>\nShankar Sharma and Mohan Chand Sharma but the petitioner who<br \/>\nwas at serial no.4 was appointed as officiating Principal by the<br \/>\nmanagement. Be that as it may, the fact remains that in the seniority<br \/>\nlist of teachers the petitioner was at serial no.4 and not the<br \/>\nseniormost teacher.\n<\/p>\n<p>4.    Merely because he was allowed to officiate as Principal of the<br \/>\ncollege till regular selection is made by the Commission, it would not<br \/>\nconfer any higher seniority upon the petitioner qua the teachers who<br \/>\nwere senior to him but did not officiate as Principal inasmuch as, the<br \/>\nofficiating appointment does not confer any right either to hold the<br \/>\npost or to claim higher seniority over the teachers who are<br \/>\nsubstantively appointed since for the purpose of seniority, it is the<br \/>\nsubstantive appointment on the post which is relevant and not the<br \/>\n<span class=\"hidden_text\">                                                                           2<\/span><\/p>\n<p>officiating appointment.\n<\/p>\n<p>5.       Besides, even no letter of appointment of the petitioner as<br \/>\nofficiating Principal has been placed on record. However, reliance<br \/>\nhas been placed on Annexure 2 to the writ petition which shows that<br \/>\nit is only attestation of petitioner&#8217;s signature as officiating Principal of<br \/>\nthe institution. The substantively appointed Principal having retired<br \/>\non 30.6.2006,       the signatures of the petitioner were attested on<br \/>\n3.7.2006. It is thus evident that even officiating appointment of the<br \/>\npetitioner was not made by the respondent institution in accordance<br \/>\nwith the provisions of Section 18 of the U.P Secondary Education<br \/>\nServices Selection Board Act, 1982 (hereinafter referred to as &#8220;1982<br \/>\nAct&#8221;).\n<\/p>\n<p>6.       Discharge of duties of the post is distinct than the appointment<br \/>\non the post. This aspect has been considered in detail by a Division<br \/>\nBench of this Court (in which I was also a Member) in Smt. Vijay<br \/>\nRani Vs. Regional Inspectress of Girls Schools                 Region- I,<br \/>\nMeerut &amp; others 2007 (2)ESC 987 where this Court held as under:\n<\/p>\n<blockquote><p>              &#8220;&#8230;&#8230;&#8230;&#8230;&#8230;..The aforesaid documents cemented the<br \/>\n              conclusion that the Petitioner-Appellant was only<br \/>\n              required to look after and discharge the duties of the<br \/>\n              officiating Principal but was never promoted\/appointed<br \/>\n              on the said post. In other words, it can be said that the<br \/>\n              Petitioner-Appellant was given only current duty charge<br \/>\n              in addition to her substantive post and this arrangement<br \/>\n              did not result in promotion to the post of which, the<br \/>\n              current duty charge was handed over. In State of<br \/>\n              Haryana Vs. S.M. Sharma AIR 1993 SC 2273, the Chief<br \/>\n              Administrator of the Board entrusted Sri S.M. Sharma,<br \/>\n              with the current duty charge of the post of Executive<br \/>\n              Engineer, which was subsequently withdrawn as a result<br \/>\n              of his transfer to other post. He challenged the said<br \/>\n              order stating that it amounts to reversion. The Apex<br \/>\n              Court held that Sri Sharma was only having current duty<br \/>\n              charge of the Executive Engineer and was never<br \/>\n              promoted or appointed to the aforesaid post and<br \/>\n              therefore, on transfer to some other post, it did not result<br \/>\n              in reversion from the post of Executive Engineer.<br \/>\n                  A somewhat similar situation occurred in<br \/>\n              Ramakant Shripad Sinai Advalpalkar Vs. Union of<br \/>\n<span class=\"hidden_text\">                                                                        3<\/span><\/p>\n<p>            India and others, 1991 Supple (2) SCC 733 and the<br \/>\n            Apex Court observed as under:-\n<\/p><\/blockquote>\n<blockquote><p>                  &#8220;The distinction between a situation where a<br \/>\n                  government servant is promoted to a higher post<br \/>\n                  and one where he is merely asked to discharge the<br \/>\n                  duties of the higher post is too clear to require any<br \/>\n                  reiteration. Asking an officer who substantively<br \/>\n                  holds a lower post merely to discharge the duties<br \/>\n                  of a higher post cannot be treated as a promotion.&#8221;<\/p><\/blockquote>\n<blockquote><p>                   It was further held that such situations are<br \/>\n            contemplated where exigencies of public service<br \/>\n            necessitate such arrangements and even consideration<br \/>\n            of seniority do not enter into it sometimes. However the<br \/>\n            person continues to hold substantive lower post and only<br \/>\n            discharges duties of the higher post essentially as a<br \/>\n            spot-gap arrangement. A further contention was raised<br \/>\n            that if such an arrangement continued for a very long<br \/>\n            period it would give some kind of right to continue on the<br \/>\n            post but negativing such contention, it was held that an<br \/>\n            in-charge arrangement is neither recognition nor is<br \/>\n            necessarily based on seniority and therefore, no rights,<br \/>\n            equities and expectations can be built upon it.\n<\/p><\/blockquote>\n<blockquote><p>                   In this view of the matter, the Petitioner-Appellant<br \/>\n            has miserably failed to show that the management ever<br \/>\n            appointed her as officiating Principal of the College and,<br \/>\n            therefore, we hold that she was only allowed to<br \/>\n            discharge duties of the office of officiating Principal, but<br \/>\n            was never appointed\/promoted by the management as<br \/>\n            officiating Principal of the College.&#8221;<\/p>\n<p>7.    In view of the law laid down as above in Smt. Vijay Rani<br \/>\n(supra), the petitioner&#8217;s claim for seniority over other senior<br \/>\nteachers of the Institution on the ground of his discharge of duties as<br \/>\nOfficiating Principal, is not acceptable.\n<\/p>\n<p>8.    Sri A.K. Yadav, appearing for the Selection Board further<br \/>\npoints out that the selection in question was held for the year 1999-<br \/>\n2000 and in view of the law laid down in Balbir Kaur Vs. U.P.<br \/>\nSecondary Education Service Selection Board and others<br \/>\n(2008) 3 UPLBEC 2376, the persons who were eligible and had<br \/>\napplied for selection at the relevant time were only entitled for<br \/>\ninterview and not those who were appointed subsequently. The<br \/>\npetitioner thus even otherwise has no locus standi to challenge the<br \/>\n<span class=\"hidden_text\">                                                                       4<\/span><\/p>\n<p>impugned selection which is with respect to 1999-2000. This fact<br \/>\ncould not be disputed by Sri Padia. However, he submits that actual<br \/>\ninterview took place in 2009 and the petitioner ought to have been<br \/>\ncalled for interview. I find no substance in this submission. Since the<br \/>\npetitioner was not eligible and was not within the zone of<br \/>\nconsideration in respect of selection in question, there is no question<br \/>\nof his consideration in this selection.\n<\/p>\n<p>9.     I find no merit in this petition.\n<\/p>\n<p>10.
