Secy., &#8230; on 10 May, 2010<\/div>\n<pre>                                      1\n\n                                                                 Court No. 1\n\nWrit Petition No. 3426 (MB) of 2010\nEkta Shakti Foundation\nVs.\nState of U.P. and others.\n\n\nHon'ble Pradeep Kant, J.\n<\/pre>\n<p>Hon&#8217;ble Ritu Raj Awasthi, J.\n<\/p>\n<p>       Sri T.J.S. Makkar, counsel for the State, says that instructions have<br \/>\nnot been received.\n<\/p>\n<p>       Learned counsel for the petitioner has submitted that at no point of<br \/>\ntime, any complaint against the petitioner has been made nor in the order<br \/>\nitself any specific charge against the petitioner has been found to be proved<br \/>\nbut only general allegations have been made and the contract of supply of<br \/>\nmid-day meal has been cancelled without affording any opportunity.\n<\/p>\n<p>       He has drawn the attention of the Court to the fact that the impugned<br \/>\norder appears to have been passed in a casual manner without application of<br \/>\nmind, as it does not specifically say, whether at the time of first review<br \/>\nmission, the relevant papers were not shown or were not prepared by the<br \/>\npetitioner, but both the contingencies have been mentioned.\n<\/p>\n<p>       Placing reliance upon Clause 20 of the agreement, learned counsel<br \/>\nfor the petitioner says that in case there was any complaint in the<br \/>\nperformance of the functions by the petitioner, it was obligatory upon the<br \/>\nrespondents to issue one week notice before taking any action.\n<\/p>\n<p>       Further, he says that the order has been passed by the District<br \/>\nMagistrate himself, though the contract was awarded by the Basic Shiksha<br \/>\nAdhikari and the District Magistrate himself is the Arbitrator\/Nodal Officer<br \/>\nunder Clause 21, therefore, the petitioner cannot approach the District<br \/>\nMagistrate, though the order has been issued by the District Magistrate,<br \/>\nwithout any authority and jurisdiction.\n<\/p>\n<p>       We take notice of the fact that for the supply of mid-day meal,<br \/>\npersons are selected and contract is granted by the State functionaries, for<br \/>\nimplementation of the said scheme of the Central Government.\n<\/p>\n<p>       We, therefore, in view of the fact that the impugned order is<br \/>\nabsolutely a general order, which does not show as to what are the<br \/>\nshortcomings which can be attributed to the petitioner in the supply of mid-<br \/>\nday meal and also that it does show the non-application of mind for the<br \/>\n<span class=\"hidden_text\">                                        2<\/span><\/p>\n<p>reasons as argued by the counsel for the petitioner and also the same having<br \/>\nbeen passed by the District Magistrate, who is the Arbitrator\/Nodal Officer<br \/>\nand was having no authority to pass the said order and that too without<br \/>\naffording opportunity to the petitioner, stay the operation of the order dated<br \/>\n24.2.2010 till further orders of the Court.\n<\/p>\n<p>        Liberty is, however, given to the concerned authority to pass fresh<br \/>\norders, after taking appropriate steps and giving opportunity to the<br \/>\npetitioner.\n<\/p>\n<p>        The respondents are granted three weeks&#8217; time to file counter<br \/>\naffidavit.
