Justice ANTONY DOMINIC\n\n Dated :23\/08\/2007\n\n O R D E R\n                   ANTONY DOMINIC, J.\n\n            = = = = = = = = = = = = = = = =\n              W.P.(C) No. 25188 OF 2007 W\n            = = = = = = = = = = = = = = = =\n\n            Dated this the 23rd August, 2007\n\n                    J U D G M E N T\n<\/pre>\n<p>    The grievance of the petitioner is that by Ext. P9<\/p>\n<p>the  5th  respondent  has   been   designated  as   the<\/p>\n<p>Superintendent of the District Hospital.   According to<\/p>\n<p>the petitioner, he being the senior-most, he was the<\/p>\n<p>deserving candidate to be designated in that category.<\/p>\n<p>    2. Learned Govt. Pleader, on instructions, submits<\/p>\n<p>that although the practice was always to post senior<\/p>\n<p>Doctor  in the hospital as Supdt., in this case the 5th<\/p>\n<p>respondent has been designated and that by this the<\/p>\n<p>petitioner has not been prejudiced.<\/p>\n<p>    3. In my view, this is a matter to be examined by<\/p>\n<p>the 1st respondent, especially when even according to<\/p>\n<p>the respondents, the designation of the 5th respondent<\/p>\n<p>is  against  the  practice  that   has  been  followed.<\/p>\n<p>Accordingly, I dispose of the writ petition directing<\/p>\n<p>the petitioner to move an appropriate representation<\/p>\n<p>before the   1st respondent, in   which event   the  1st<\/p>\n<p>respondent will examine the grievance of the petitioner<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 25188 OF 2007             -2-<\/span><\/p>\n<p>and pass appropriate orders without delay.<\/p>\n<p>     With      these     observations the writ petition  is<\/p>\n<p>disposed of.\n<\/p>\n<\/p>\n<p>                                              ANTONY DOMINIC<br \/>\n                                                       JUDGE<br \/>\njan\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Dr.T.V.Padmanabhan vs The State Of Kerala on 23 August, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C) No. 25188 of 2007(W) 1.
