Anupma Kumari @ Gudiya (Wife of Pulekesh Kumar Singh), Daughter of Ganesh\n       Sharma, Resident of Mohalla Baban Bigha, Kanhauli, PS Mithanpura, District\n       Muzaffarpur. ------ Opposite Parties.\n                                             -----------\n<\/pre>\n<p>9       16.11.2011                  Heard         learned          counsel         for      the<\/p>\n<p>                         petitioner and the counsel appearing on behalf<\/p>\n<p>                         of the opposite party no. 2.\n<\/p>\n<p>                                    Both      the    parties        have      been        living<\/p>\n<p>                         together for the past two years.                          The main<\/p>\n<p>                         problem,       if   any,    between        them     is    that      the<\/p>\n<p>                         complainant         is    not     able    to   adjust        in    the<\/p>\n<p>                         village with her husband.                   For the past two<\/p>\n<p>                         years she has not made any complaint that her<\/p>\n<p>                         husband ill-treats her in any manner.                           One of<\/p>\n<p>                         the main reasons which have caused this dispute<\/p>\n<p>                         between     the     parties       is   because       of   the     case<\/p>\n<p>                         pending between them.              It has been submitted by<\/p>\n<p>                         the petitioner that he has to visit the Court<\/p>\n<p>                         every    two    months      and    infact      the    complainant<\/p>\n<p>                         along with her father have given a statement<\/p>\n<p>                         before     charge        during     the    pendency         of    this<\/p>\n<p>                         application.         Under these circumstances, it is<\/p>\n<p>                         difficult to expect that any good feeling can<\/p>\n<p>                         be   restored       between       them    as   whatever          little<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>         headway is made by virtue of the fact that they<\/p>\n<p>         are living together in the same house, it is<\/p>\n<p>         destroyed by the fact that the father of the<\/p>\n<p>         complainant    and       the    complainant        have       made<\/p>\n<p>         statements in Court against the husband.<\/p>\n<p>                 Taking           all       these       facts          into<\/p>\n<p>         consideration, provisional bail granted to the<\/p>\n<p>         petitioner    on       17.9.2009      in    connection        with<\/p>\n<p>         Complaint    Case      No.     1128    of   2008    is    hereby<\/p>\n<p>         confirmed.    The complainant is free to make a<\/p>\n<p>         decision either to live with her husband or to<\/p>\n<p>         go with her father and mother.
