Misc.<\/p>\n<p>                       No.29367\/2009 have been filed by the accused petitioners<\/p>\n<p>                       under Section 407 of the Code of Criminal Procedure for<\/p>\n<p>                       transfer of S.T.No.37\/2009\/140\/2009 arising out of<\/p>\n<p>                       Makhdumpur P.S. Case No.321\/2007 from the Sessions<\/p>\n<p>                       Division, Jehanabad to any other Sessions Division i.e.<\/p>\n<p>                       Patna or Gaya or any other place on the ground that no<\/p>\n<p>                       lawyer of Jehanabad Bar Association is ready to appear on<\/p>\n<p>                       behalf of the accused petitioners. In support of their<\/p>\n<p>                       contention, a copy of the resolution of the Bar Association,<\/p>\n<p>                       Jehanabad has been filed (Annexure-3 of Cr. Misc.<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>No.10715\/2008).\n<\/p>\n<p>            It has also been submitted that at the time of<\/p>\n<p>anticipatory bail application, a petition was filed, but later<\/p>\n<p>on no one appeared on behalf of the petitioner before the<\/p>\n<p>learned Sessions Judge and the case was dismissed as<\/p>\n<p>withdrawn. Later on, anticipatory bail was granted by a<\/p>\n<p>Bench of this Court and the anticipatory bail was allowed,<\/p>\n<p>but there was no lawyer of the Jehanabad Bar Association<\/p>\n<p>to file the bail bond etc. on behalf of the petitioners. For<\/p>\n<p>filing the bail bond, the petitioners had to engage the<\/p>\n<p>lawyer from Patna. Local lawyer was not ready to file the<\/p>\n<p>bail bonds etc. as there was resolution of the Bar<\/p>\n<p>Association, Jehanabad dated 8.02.2008 that the lawyers<\/p>\n<p>association has taken a decision that in the murder case of<\/p>\n<p>Dindayal Yadav, A.P.P., no advocate of the Association<\/p>\n<p>will appear and the petitionfor anticipatory bail will also<\/p>\n<p>be withdrawn.\n<\/p>\n<p>            It has been stated in the rejoinder filed on<\/p>\n<p>behalf of the petitioners to the counter affidavit filed on<\/p>\n<p>behalf of the opposite party no.2 that the petitioner after<\/p>\n<p>grant of anticipatory bail, since no advocate of Jehanabad<\/p>\n<p>Bar Association was ready to do Pairvi on behalf of the<br \/>\n<span class=\"hidden_text\">                    3<\/span><\/p>\n<p>petitioners, the petitioners had no option but to engage the<\/p>\n<p>advocate of Patna Bar Association namely Vinay Sharma,<\/p>\n<p>Dilip Kumar and Sunil Kumar, who went to Jehanabad<\/p>\n<p>and any how completed the legal formalities for execution<\/p>\n<p>of bail bond of the petitioners, although there was severe<\/p>\n<p>protest made by the members of Jehanabad Bar<\/p>\n<p>Association. Now, the aforesaid advocates are not ready to<\/p>\n<p>do Pairvi in the present case having gone to Jehanabad and<\/p>\n<p>they are also charging heavy fee for doing Pairvi in the<\/p>\n<p>present case, which is beyond the reach of the petitioners.<\/p>\n<p>            The counter affidavit has been filed on behalf<\/p>\n<p>of the State as well as on behalf of the informant-opposite<\/p>\n<p>party no.2. They have controverted the statement made by<\/p>\n<p>the petitioners.\n<\/p>\n<p>            It has been submitted on behalf of the State<\/p>\n<p>that no lawyer has been demanded from the State or from<\/p>\n<p>the local administration by the petitioners. However Mr.<\/p>\n<p>Ramakant Sharma, the learned Senior counsel appearing<\/p>\n<p>on behalf of the opposite party no.2, the informant has<\/p>\n<p>fairly submitted that the informant has no objection if the<\/p>\n<p>aforesaid case is transferred from the Sessions Division,<\/p>\n<p>Jehanabad to the Sessions Division at Patna as the<br \/>\n<span class=\"hidden_text\">                    4<\/span><\/p>\n<p>informant is living at Patna.\n<\/p>\n<p>            It has been observed by the Hon&#8217;ble Supreme<\/p>\n<p>Court in the case of Mrs. Maneka Sanjay Gandhi &amp; ors.<\/p>\n<p>Vs. Miss Rani Jethmalani reported in 1979 SC 468 at<\/p>\n<p>paragraphs 2 that &#8220;Assurance of a fair trial is the first<\/p>\n<p>imperative of the dispensation of justice and the central<\/p>\n<p>criterion for the court to consider when a motion for<\/p>\n<p>transfer is made is not the hypersensitivity or relative<\/p>\n<p>convenience of a party or easy availability of legal<\/p>\n<p>services   or   like   mini-grievances.   Something   more<\/p>\n<p>substantial, more compelling, more imperiling, from the<\/p>\n<p>point of view of public justice and its attendant<\/p>\n<p>environment, is necessitous if the court is to exercise its<\/p>\n<p>power of transfer. This is the cardinal principle although<\/p>\n<p>the circumstances may be myriad and vary from case to<\/p>\n<p>case. We have to test the petitioner&#8217;s ground on this<\/p>\n<p>touchstone bearing in mind the rule that normally the<\/p>\n<p>complainant has the right to choose any court having<\/p>\n<p>jurisdiction and the accused cannot dictate where the case<\/p>\n<p>against him should be tried. Even so, the process of justice<\/p>\n<p>should not harass the parties and from that angle the court<\/p>\n<p>may weigh the circumstances&#8221;.\n<\/p>\n<p><span class=\"hidden_text\">                                  5<\/span><\/p>\n<p>                          Considering the facts and circumstances stated<\/p>\n<p>              above, the S.T.No.37\/2009\/140\/2009 arising out of<\/p>\n<p>              Makhdumpur P.S. Case No.321\/2007 is transferred from<\/p>\n<p>              the Sessions Division, Jehanabad to Sessions Division,<\/p>\n<p>              Patna.\n<\/p>\n<p>                          Let the records of aforesaid case be sent to the<\/p>\n<p>              court of Sessions Judge, Patna, who will deal with the case<\/p>\n<p>              himself or transfer to any other Additional Sessions Judge,<\/p>\n<p>              Patna for the speedy trial.\n<\/p>\n<p>                          In the result, both these applications are<\/p>\n<p>              allowed.\n<\/p>\n<\/p>\n<pre>V.K.
