RAMKUMAR, J.\n                 .........................................\n                        B.A. No.8234 of 2010\n                ..........................................\n             Dated this the 20th day of December, 2010\n\n                                    ORDER\n<\/pre>\n<p>     Petitioner, who is the sole accused in Crime No.964\/2010 of<\/p>\n<p>Valappad    Police   Station,      Thrissur      District  for  offences<\/p>\n<p>punishable under Sections 341,323 and 308 I.P.C., seeks<\/p>\n<p>anticipatory bail.\n<\/p>\n<p>     2.    The    learned      Public      Prosecutor     opposed    the<\/p>\n<p>application.\n<\/p>\n<p>     3.    After evaluating the factors and parameters which<\/p>\n<p>are to be taken into consideration in the light of paragraph 122<\/p>\n<p>of the verdict     dated      2-12-2010       of the Apex Court       in<\/p>\n<p><a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of Maharashtra<\/p>\n<p>and Others<\/a>     (2010(4) KLT 930),              I am of     the view that<\/p>\n<p>anticipatory bail cannot be granted in a case of this nature, since<\/p>\n<p>the investigating officer        has not had           the advantage of<\/p>\n<p>interrogating the petitioner.          But at the same time,       I am<\/p>\n<p>inclined to permit the petitioner to surrender before the<\/p>\n<p>Investigating Officer for the purpose of interrogation and then to<\/p>\n<p>have his application for bail considered by the Magistrate or the<\/p>\n<p><span class=\"hidden_text\">B.A. No.8234 \/2010              -:2:-<\/span><\/p>\n<p>Court     having jurisdiction.   Accordingly, the petitioner shall<\/p>\n<p>surrender before the investigating officer on 30.12.2010 or on<\/p>\n<p>31.12.2010 for the purpose of interrogation and recovery of<\/p>\n<p>incriminating material, if any. In case the investigating officer<\/p>\n<p>is of the view that having regard to the facts of the case arrest<\/p>\n<p>of the petitioner is imperative he shall record his reasons for<\/p>\n<p>the arrest in the case-diary as insisted in paragraph 129       of<\/p>\n<p>Siddharam Satlingappa Mhetre&#8217;s case (supra).                  The<\/p>\n<p>petitioner shall thereafter be produced before the Magistrate or<\/p>\n<p>the Court concerned and permitted to file an application for<\/p>\n<p>regular bail.      In case the interrogation of the petitioner is<\/p>\n<p>without arresting him, the petitioner shall thereafter appear<\/p>\n<p>before the Magistrate or the Court concerned       and apply for<\/p>\n<p>regular bail. The Magistrate or the Court on being satisfied that<\/p>\n<p>the petitioner has been interrogated by the police shall, after<\/p>\n<p>hearing the prosecution as well, consider and dispose of his<\/p>\n<p>application for regular bail preferably on the same date<\/p>\n<p>on which it is filed.\n<\/p>\n<p>      4.     In case the petitioner   while surrendering before<\/p>\n<p>the Investigating Officer     has   deprived   the   investigating<\/p>\n<p><span class=\"hidden_text\">B.A. No.8234 \/2010                  -:3:-<\/span><\/p>\n<p>officer    sufficient time for interrogation, the officer shall<\/p>\n<p>complete the interrogation        even if it is beyond the time limit<\/p>\n<p>fixed as above and submit a report to that effect             to the<\/p>\n<p>Magistrate or the Court concerned.
