THE HEAD MASTER, TOWN MIDDLE SCHOOL, HAJIPUR, DISTRICT VAISHALI\n       AT HAJIPUR.\n                                   -----------\n<\/pre>\n<p>3        11.2.2011                            The     petitioner            is    working       in     the<\/p>\n<p>                                Town       Middle        School        in        the    district        of<\/p>\n<p>                                Vaishali.            He had filed a writ application<\/p>\n<p>                                before       this      Court       for      payment      of     certain<\/p>\n<p>                                portion of his salary.                      This Court directed<\/p>\n<p>                                that the petitioner would be entitled for<\/p>\n<p>                                payment         of     the      salary           for    the     reasons<\/p>\n<p>                                contained in Annexure-2 (CWJC No. 2662 of<\/p>\n<p>                                1978).        The petitioner had to again come to<\/p>\n<p>                                this Court as he was not being permitted to<\/p>\n<p>                                join      the     school       by     the        Principal      on    the<\/p>\n<p>                                ground       that      he    had     remained          absent     for     a<\/p>\n<p>                                short period of time.                       The petitioner had<\/p>\n<p>                                filed a representation before the District<br \/>\n<span class=\"hidden_text\">                2<\/span><\/p>\n<p>Superintendent of Education and as such this<\/p>\n<p>Court     directed       that       the      District<\/p>\n<p>Superintendent of Education, Hajipur should<\/p>\n<p>dispose of the representation.             Apparently<\/p>\n<p>the representation was not disposed of.             It<\/p>\n<p>is, therefore, not clear to this Court as to<\/p>\n<p>whether the petitioner actually joined the<\/p>\n<p>school thereafter or not.\n<\/p>\n<p>        The    present    writ     application     has<\/p>\n<p>been filed as there was a notice issued on<\/p>\n<p>11.2.2004 in a daily Hindi newspaper asking<\/p>\n<p>all the teachers of the school in question<\/p>\n<p>to appear before the District Superintendent<\/p>\n<p>of   Education,     Hajipur,     along    with    their<\/p>\n<p>certificates   of    educational     qualification,<\/p>\n<p>appointment    letters     etc.     to     test    the<\/p>\n<p>validity of their appointments.           It has been<\/p>\n<p>submitted that this advertisement was issued<\/p>\n<p>on a complaint lodged by some persons.<\/p>\n<p>        It is expected that the petitioner<\/p>\n<p>must have appeared before the Committee.             As<\/p>\n<p>far as the claim of the petitioner that he<\/p>\n<p>has not been paid his salary and has not<\/p>\n<p>been allowed to join the duty, this Court<\/p>\n<p>cannot pass any positive order, as if the<\/p>\n<p>petitioner was aggrieved by the fact that<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>         despite      the       orders        of     the        Court,    the<\/p>\n<p>         District Superintendent of Education had not<\/p>\n<p>         disposed      of        the      representation           of     the<\/p>\n<p>         petitioner,        he       ought     to    have       moved    this<\/p>\n<p>         Court   at    the       earliest,          but    certainly      not<\/p>\n<p>         after   20    years         to      seek    a    direction      for<\/p>\n<p>         payment of salary.\n<\/p>\n<p>                    In the result, this writ application<\/p>\n<p>         is   dismissed         on     the    ground       of    delay    and<\/p>\n<p>         latches.\n<\/p>\n<\/p>\n<pre>Sanjay                                          ( Sheema Ali Khan, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Md.Alamgir Ansari vs The State Of Bihar &amp;Amp; Ors on 11 February, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.14169 of 2005 MD.ALAMGIR ANSARI, SON OF LATE DR.
