Choudhary,\n      for the petitioner\/s.\n      Mr M.A. Siddiqui, for the respondents.\n                                 ...\n\n\n      The Deputy Conservator of Forest, Indira Gandhi Canal Project,\n\nHanumangarh under an office order dated 30.3.1992 declared an\n\neligibility list of the work charged employees completing 10 or 2 years of\n\ncontinuous service.    In the order aforesaid name of the petitioner\n\nappears at S.No. 54 with 1.4.1988 as the date on which semi permanent\n\nstatus was conferred upon her and 1.4.1996 as the date on which\n\npermanent status was given. Pertinent to note here that an employee\n\nworking in work charged cadre of the Department of Forest becomes\n\nentitled to be considered for grant of semi permanent status on\n\ncompletion of two years of service as per the provisions of Certified\n\nStanding Orders of 1973.         The Deputy Conservator of Forest,\n\nHanumangarh by notice dated 25.8.1995 informed the petitioner that\n\non scrutiny she was not found fit for grant of semi permanent status,\n\nand therefore, an opportunity was given to her to explain as to why the\n\nstatus already given be not withdrawn.          As per the explanation\n\nsubmitted by the petitioner on 31.8.1995,        she was in continuous\n                                        2\n\nemployment of Forest Department since 1982, and as such, semi\n\npermanent status was rightly granted to her w.e.f. 1.4.1988 under the\n\norder dated 30.3.1992. The petitioner after submitting the explanation\n\nas said above approached this Court by way of filing the present petition\n\nfor writ giving challenge to decision of the respondents as referred in\n\nthe notice dated 25.8.1995.\n\n\n\n\n       A reply to the writ petition is filed on behalf of the respondents\n\nstating therein that the semi permanent status was erroneously granted\n\nto the petitioner w.e.f. 1.4.1988 under an order dated 30.3.1992 on the\n\ncount that initially the petitioner was working in certain schemes under\n\nthe planned budget as such that period was wrongly taken into\n\nconsideration while conferring semi permanent status. The respondents\n\nalso   stated   that   services   of   the   petitioner   were   utilized   for\n\ndepartmental purposes in the month of April 1991, and therefore, as a\n\nmatter of fact, she became entitled for grant of semi permanent status\n\non 1.4.1993 only.\n\n\n\n\n       A rejoinder is filed by the petitioner, in general reiterating\n\nwhatever already stated in the petition for writ. . A copy of the order\n\ndated 31.3.1997 is also placed on record whereby the semi permanent\n\nstatus granted to the petitioner under the order dated 30.3.1992 was\n\nwithdrawn.\n                                           3\n\n\n\n      It is contended by learned counsel for the petitioner that the\n\npetitioner was working with the Forest Department since 1982, and\n\ntherefore, she was entitled to be considered for grant of semi\n\npermanent status much back in the year 1984 itself. It is also pointed\n\nout by learned counsel for the petitioner that the Principal Chief\n\nConservator of Forest, Government of Rajasthan, Jaipur under a letter\n\ndated 6.9.2000 (Annex.P\/8) clarified that the services rendered by a\n\nworkman under the Schemes viz. NREP, RLEGP, JRY or under Feminine\n\nRelief Work is required to be taken into consideration while considering\n\ncandidature of such workman for grant of semi permanent status. Beside that, a\n\nperson working on casual basis in various schemes of the forest\n\ndepartment is certainly required to be treated as a casual workman of\n\nthe department. Merely, on the count that his services were utilized by\n\nthe department for some time under a scheme by no way deprive him\n\nfrom getting benefits under the Certified Standing Orders of 1973.\n\nPertinent to note here that entire work charged cadre itself is operated\n\nunder the planned budget, and as such, the persons serving in a scheme\n\nsubsequently taken on work charged cadre of the department concerned\n\nand a person directly employed in work charge cadre stands at same\n\npedestal.\n\n\n\n\n      In view of whatever stated above, the respondents were wrong in\n\nwithdrawing semi permanent status granted to the petitioner by\n\nexcluding the service given by her under Government Scheme.\n\n\n\n\n      Accordingly,    this petition for writ is allowed. The order\n\nwithdrawing semi permanent status granted to the petitioner w.e.f.\n\n1.4.1988 is declared illegal, and therefore, the same is quashed.    The\n                                              5\n\n          order dated 30.3.1992 granting semi permanent status to the petitioner\n\n          w.e.f. 1.4.1988 stands restored. The respondents are directed to grant\n\n          all consequential benefits to the petitioner by treating her a semi\n\n          permanent work charged employee with the respondent department\n\n          w.e.f. 1.4.1988.
