SATHASIVAM\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p>Dr. ARIJIT PASAYAT, J:\n<\/p>\n<p>\tHeard learned counsel for the appellants.<br \/>\n\tChallenge in this appeal is to the judgment of a Division Bench of the<br \/>\nKerala High Court dismissing the writ appeal filed by the appellants.<br \/>\nChallenge in the writ appeal was to the order passed by a learned Single<br \/>\nJudge in O.P. No.4287 of 2000. The High Court relied on some earlier<br \/>\ndecisions to hold that a person resigning under Rule 19 of the Border<br \/>\nSecurity Force Rules, 1969 (in short `the Rules&#8217;) is entitled to pension if he is<br \/>\neligible.  The writ appeal was dismissed and the appellants were directed to<br \/>\ndispose of the representation of the respondent  in  the  light  of the<br \/>\njudgment referred to i.e. Jos. Vs. Border Security Force (1999 (3) KLT 904).<br \/>\nRelying upon this judgment, the learned Single Judge had directed the<br \/>\nrespondents in the writ petition to consider the representation of the<br \/>\nappellant within a stipulated time.\n<\/p>\n<p>\tLearned counsel for the appellants submitted that the respondent was<br \/>\nnot eligible for pension as she had completed only 18 years and three<br \/>\nmonths of service.  Strong reliance is placed on a decision of this Court in<br \/>\nCivil Appeal No.6166 of 1999 and connected cases, disposed of on<br \/>\n30.03.2001.\n<\/p>\n<p>\tThis Court, inter-alia, observed as follows:-\n<\/p>\n<p>      In the result, there is no substance in the<br \/>\ncontention of the learned counsel for the respondents<br \/>\nthat on the basis of Rule 49 of the CCS (Pension)<br \/>\nRules or on the basis of G.O., the respondents who<br \/>\nhave retired after completing qualifying service of 10<br \/>\nyears but before completing qualifying service of 20<br \/>\nyears by voluntary retirement, are entitled to get<br \/>\npensionary benefits.  Respondents who were<br \/>\npermitted to resign from service under Rule 19 of the<br \/>\nBSF Rules before the attainment of the age of<br \/>\nretirement or before putting such number of years of<br \/>\nservice, as may be necessary under  the  Rules,  to<br \/>\nbe   eligible  for retirement are not entitled to get any pension under<br \/>\nany of the provisions  under<br \/>\nCCS(Pension) Rules.  Rule 49 only prescribes the<br \/>\nprocedure for calculation and quantification of<br \/>\npension amount.  The G.O. dated 27.12.1995 does not<br \/>\nconfer additional right of pension on the BSF<br \/>\nemployee.<br \/>\n                 (Underlined for emphasis)<br \/>\n\tThere is no appearance on behalf of the respondent inspite of service<br \/>\nof notice.\n<\/p>\n<p>\tIn view of what has been stated by this Court, it is for the appellants to<br \/>\nconsider the question of eligibility.  Neither the learned Single Judge nor the<br \/>\nDivision Bench decided about the eligibility.  The only direction given was to<br \/>\nconsider the representation.\n<\/p>\n<p>\tIt was open to the appellants to reject the representation by deciding<br \/>\nthe issue of eligibility.  If the respondent has any grievance to such<br \/>\nrejection, she can take appropriate remedy as available in law.  We,<br \/>\ntherefore, dispose of the appeal  holding  that  the  representation be<br \/>\ndisposed of, if pending within three months after deciding  the  question  of<br \/>\neligibility.  Needless  to   say  if  the respondent has any grievance,<br \/>\nshe can agitate it before an appropriate forum.<br \/>\n\tThe appeal is disposed of accordingly.
