Sunil)<\/p>\n<p>            Date of order            ::    30.04.2009<\/p>\n<p>                          P R E S E N T<\/p>\n<p>        HON&#8217;BLE MR. JUSTICE GOPAL KRISHAN VYAS<\/p>\n<p>Mr.O.P. Singaria, Public Prosecutor.\n<\/p>\n<p>           In     this    leave      to     appeal,    the   State<br \/>\nGovernment is challenging the judgment dated 26th<br \/>\nJuly,    2006   rendered        by   the    learned    Additional<br \/>\nSessions     Judge,      Nathdwara         in   case   No.43\/2005<br \/>\nwhereby the learned Judge has acquitted accused-<br \/>\nrespondent for offence under Section 411 IPC and<br \/>\nset aside the judgment dated 29th November, 2005<br \/>\npassed by the learned Additional Chief Judicial<br \/>\nMagistrate, Nathdwara in criminal case No.2\/2004.\n<\/p>\n<p>           The brief facts of the case are that on<br \/>\n27th   October,    2003    an     FIR     was   registered   under<br \/>\nSection 457 and 380 at Police Station Nathdwara.<br \/>\nAfter due investigation in the said FIR, challan<br \/>\n                                    !! 2 !!<\/p>\n<p>was filed against three persons namely Rama Kand,<br \/>\nGajjanan and Sunl.               Against non-petitioner Sunil,<br \/>\nchallan    under      Section       411      IPC     was      filed.         The<br \/>\nlearned trial court after trial held Sunil guilty<br \/>\nfor offence under Section 411 IPC and convicted<br \/>\nhim    for      three       months           rigorous         imprisonment<br \/>\nalongwith     a     fine     of     Rs.500\/-         for      the     offence<br \/>\ncommitted by him.\n<\/p>\n<p>             Against       the      said      judgment         dated        29th<br \/>\nNovember,     2005        passed     by      the     trial       court,       an<br \/>\nappeal was preferred by the non-petitioner Sunil.<br \/>\nThe said appeal was finally decided by the learned<br \/>\nAdditional         Sessions       Judge,       Nathdwara            vide     its<br \/>\njudgment      dated       26th    July,       2006       by    which,       the<br \/>\nlearned appellate court while giving benefit of<br \/>\ndoubt to non-petitioner Sunil acquitted him for<br \/>\nthe charges levelled against him for committing<br \/>\noffence under Section 411 IPC.\n<\/p>\n<p>             I have perused both the judgments passed<br \/>\nby    learned       trial        court       as    well        as     learned<br \/>\nappellate court.\n<\/p>\n<p>             The      learned         appellate            court           while<br \/>\ndiscussing entire evidence on record come to the<br \/>\nconclusion         that    prosecution             has     not       properly<br \/>\n                                                !! 3 !!<\/p>\n<p>             proved    any      recovery       from       Sunil,       therefore,     the<br \/>\n             learned appellate court reversed the finding of<br \/>\n             guilt     against         the     non-petitioner            Sunil     while<br \/>\n             holding that the prosecution has not proved the<br \/>\n             charges levelled against the non-petitioner beyond<br \/>\n             reasonable         doubt.       The    learned        appellate        court<br \/>\n             reversed      the    finding          of    trial    court       on   cogent<br \/>\n             grounds       and        after     considering             the     evidence<br \/>\n             recorded by the trial court.\n<\/p>\n<p>                           In    my    opinion,          the     learned      appellate<br \/>\n             court has rightly arrived at with the finding that<br \/>\n             prosecution         has     not       proved        its     case      beyond<br \/>\n             reasonable doubt against non-petitioner Sunil for<br \/>\n             committing offence under Section 411 IPC.\n<\/p>\n<p>                           In this view of the matter, there is no<br \/>\n             force    in     this      leave       to     appeal.        Hence,     this<br \/>\n             criminal leave to appeal is hereby dismissed.\n<\/p>\n<p>                                                        (GOPAL KRISHAN VYAS), J.\n<\/p>\n<p>A.K.
