With the consent of<br \/>\n\tthe learned advocates for the respective parties, today the matters<br \/>\n\tare taken up for final disposal.\n<\/p>\n<p>It<br \/>\n\tis pertinent to note that this Court on 09th April 2009<br \/>\n\tin Special Civil Application No.1774 of 2009, inter alia passed the<br \/>\n\tfollowing order :\n<\/p>\n<p>&#8220;13.\t\tIn<br \/>\nview of above, it is hereby ordered that till the disposal of the<br \/>\npetition the operation and implementation of order dated 7th<br \/>\nFebruary, 2009 passed by the learned In-charge Joint Charity<br \/>\nCommissioner, Vadodara in Appeal No.1 of 2007 as well as order dated<br \/>\n16th<br \/>\nJanuary, 2007 passed by the learned Assistant Charity Commissioner,<br \/>\nAnand in Change Report No.118 of 2006 shall remain under suspension.<br \/>\nThe Principal District Judge obviously can hear the appeal<br \/>\nirrespective of pendency of this petition as if the change report<br \/>\nsubmitted earlier is still under scrutiny. The Registry is directed<br \/>\nto list the petition for final disposal on re-opening of the summer<br \/>\nvacation.&#8221;\n<\/p>\n<p>In<br \/>\n\tview of aforesaid, the impugned orders have been stayed by this<br \/>\n\tCourt and the same have not been disturbed till date. In that view<br \/>\n\tof the matter, with consent of the parties, both these petitions are<br \/>\n\thereby disposed of. The Appellate Court is directed to decide the<br \/>\n\tsaid appeal within a period of  One Year from<br \/>\n\tthe date of receipt of writ of present order. The parties will<br \/>\n\tbe governed by the aforesaid order dated 09th<br \/>\n\tApril 2009 till pendency of the aforesaid appeal before the<br \/>\n\tAppellate Court. The Appellate Court is directed to list the<br \/>\n\tappeal before appropriate Court at the earliest.
