Justice K.HEMA\n\n Dated :18\/06\/2010\n\n O R D E R\n                               K.HEMA, J\n                          -----------------------\n                       B.A No.3634 OF 2010\n                      --------------------------------\n                Dated this the 18th day of June 2010\n\n                                 ORDER\n<\/pre>\n<p>         This petition is for anticipatory bail.<\/p>\n<p>      2. The alleged offence is under Section 302 r\/w Section 34<\/p>\n<p>of IPC. According to prosecution, accused numbers one to four in<\/p>\n<p>furtherance of their common intention to attack the deceased<\/p>\n<p>Vinil, assaulted him by using dangerous weapons and caused<\/p>\n<p>serious injuries to him and he succumbed to the injuries, on the<\/p>\n<p>way to hospital. The incident happened on 02\/05\/2010 at about<\/p>\n<p>10:45 P.M. Petitioners are accused numbers one to four.<\/p>\n<p>      3. Petitioner is the fourth accused. Learned counsel for<\/p>\n<p>petitioner submitted that in the morning of the date of occurrence<\/p>\n<p>in this case, the autorickshaw of the second accused was<\/p>\n<p>damaged by some workers of B.J.P. He lodged a complaint before<\/p>\n<p>the police and a crime was registered as Crime No.283\/2010.<\/p>\n<p>Infuriated by the complaint made by the second accused,<\/p>\n<p>deceased Vinil, who is a leader of B.J.P, who was residing 12 Kms.<\/p>\n<p>away from place of occurrence came along with six other persons<\/p>\n<p>armed with deadly weapons and assaulted fourth accused, who is<\/p>\n<p>brother of second accused. Fracture was caused to both his legs.<\/p>\n<p>Injuries were also caused to the face and neck of the fourth<\/p>\n<p>accused.   He underwent two operations and he is still in the<\/p>\n<p><span class=\"hidden_text\">B.A No.3634 OF 2010                2<\/span><\/p>\n<p>hospital and not so far arrested in this case. Accused numbers<\/p>\n<p>one, two and four are brothers and third accused is first accused&#8217;s<\/p>\n<p>son. Accused numbers one to three rushed to the scene while<\/p>\n<p>assaultants escaped.       The incident happened in between the<\/p>\n<p>house of second and fourth accused.          A crime was registered<\/p>\n<p>against deceased Vinil and his companions under Section 143,<\/p>\n<p>147, 148, 447, 326, 307 r\/w 149 of IPC.         Petitioner is not in a<\/p>\n<p>position to move about and his condition is very bad. In such<\/p>\n<p>circumstances anticipatory bail may be granted, it is submitted.<\/p>\n<p>      4. On hearing both sides and on considering the various<\/p>\n<p>aspects in the light of various documents produced, the physical<\/p>\n<p>condition of fourth accused, medical certificates etc., I am<\/p>\n<p>satisfied that it is only just and proper to grant anticipatory bail to<\/p>\n<p>petitioner. Hence the following order is passed.<\/p>\n<p>         (1) Petitioner shall surrender before the Magistrate<\/p>\n<p>            Court concerned within seven days from today.<\/p>\n<p>        (2) On such surrender, petitioner shall be released on<\/p>\n<p>            bail on his executing a bond for Rs.50,000\/-<\/p>\n<p>            (Rupees fifty thousand only) each with two<\/p>\n<p>            solvent sureties each for the like sum to the<\/p>\n<p>            satisfaction of the learned Magistrate on the<\/p>\n<p>            following conditions:\n<\/p>\n<p><span class=\"hidden_text\">B.A No.3634 OF 2010            3<\/span><\/p>\n<blockquote><p>                 (i)   Petitioners shall report before the<\/p>\n<p>                      Investigating Officer as and when<\/p>\n<p>                      directed    and    co-operate      with<\/p>\n<p>                      investigation.\n<\/p><\/blockquote>\n<p>               (ii)    Petitioner shall not influence or<\/p>\n<p>                      intimidate any witnesses or tamper<\/p>\n<p>                      with any evidence.\n<\/p>\n<p>               (iii)  In case the petitioner is involved in<\/p>\n<p>                      any similar case, his bail is liable to<\/p>\n<p>                      be cancelled.\n<\/p>\n<p>               (iv)    Condition No.(i) will apply only after<\/p>\n<p>                      he is able to move about as per the<\/p>\n<p>                      report of Medical Officer.\n<\/p>\n<p>             Petition is allowed.\n<\/p>\n<\/p>\n<p>                                               K.HEMA<br \/>\n                                               JUDGE<\/p>\n<p>vdv<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Sudarsanan vs State Of Kerala on 18 June, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 3634 of 2010() 1.
