1.\tBy
\nthis petition, the petitioner, son of deceased employee has
\nchallenged an Award dated 5.3.2004, whereby the Labour Court has
\nrejected the Reference preferred by the employee against the action
\nof the respondent – Corporation of terminating his service.\n<\/p>\n
2.\tFrom
\nthe award and from the submission on behalf of the petitioner, it
\nappears that the petitioner’s  father i.e. the employee of the
\nrespondent – Corporation, died on 18.5.2000 during the pendency of
\nthe proceedings before the Labour Court and that therefore, he was
\njoined as party to the Reference proceedings.\n<\/p>\n
3.\tThe
\npetitioner has annexed only a copy of the Award and a copy of the
\nstatement of claim and no other document is produced on the record of
\nthis petition. Therefore, this Court has to consider and decide this
\npetition only on the basis of the said material.\n<\/p>\n
4.\tUpon
\nperusal of the Award, it transpires that the father of the petitioner
\ni.e. deceased employee was terminated by the respondent – Corporation
\nwith effect from 14.9.1996. Before terminating the petitioner’s
\nfather from service, the respondent Corporation had issued a
\ncharge-sheet and pursuant to the said charge-sheet, departmental
\ninquiry was conducted and upon conclusion of the departmental
\ninquiry, the petitioner’s father was terminated.\n<\/p>\n
5.\tAgainst
\nthe said termination in September, 1996, the order of Reference was
\nmade on 21.4.1998 i.e. after period of about 2 years. The said order
\nof Reference culminated into Reference (LCG) No.154 of 1998. In
\nresponse to the statement of claim filed by the employee, the
\nrespondent Corporation filed its written statement and contested the
\nReference proceedings. After hearing the parties, the Labour Court
\ncame to the conclusion that the employee failed to establish that the
\ninquiry against him was conducted improperly and in violation of
\nprinciples of natural justice.  The Labour Court has also held that
\nthe inquiry conducted against the employee was legal and proper.
\nUltimately, after considering the material available on record and
\nafter hearing the parties, the Labour Court rejected the Reference.
\nAggrieved by the said Award, son of the employee is before this
\nCourt.\n<\/p>\n
6.\tMr.\n<\/p>\n
P.M. Lakhani, learned advocate appears for the petitioner. He
\nsubmitted that the Labour Court has shifted the burden of proof on
\nthe employee and has failed to appreciate the case of the petitioner
\nas made out in the statement of claim and has erred in law in holding
\nthat the departmental inquiry was not illegal but was legal and
\nproper. He submitted that in view of the error committed by the
\nLabour Court, petition deserves to be allowed.\n<\/p>\n
7.\tAs
\nmentioned hereinabove, the Reference regarding the dispute raised by
\nrespondent was made after lapse of almost 2 years from the date of
\nhis alleged termination, which wold go to show that for almost two
\nyears after his alleged termination, the said employee was passive
\nand did not raise any dispute and now this petition is preferred
\nafter almost 4 years since the Award came to be passed in March,
\n2004. The petition, for this reason alone, does not deserve to be
\nentertained. It is pertinent to note that the Reference was made in
\nApril, 1998 and the concerned employee died in May, 2000 i.e. within
\nperiod of 2 years after the reference, the employee died and then the
\npetitioner was impleaded as party to the Reference proceedings and
\nyet he has approached this Court against the Award after lapse of
\nalmost 4 years.\n<\/p>\n
8.\tThe
\nLabour Court has recorded the findings of  fact that inquiry was
\nlegal and proper. The Labour Court has also recorded finding of the
\nfact that the employee was in habit in committing similar misconduct
\nin past also. Besides the said findings  the Labour Court has after
\nconsidering the material available on record of the Reference, also
\ncome to the conclusion that the charge levelled against the
\npetitioner was proved and that the petitioner had failed to establish
\nthat finding or conclusion regarding misconduct, are incorrect and\/or
\nhe did not commit the misconduct of which the charge was levelled
\nagainst him.\n<\/p>\n
9.\tThus,
\nafter examining the material on record and upon hearing the parties,
\nthe Labour Court has come to the conclusion that the
\nemployee\/petitioner failed to establish that the action of the
\nrespondent – Corporation was illegal and unjustified. The Labour
\nCourt did not find any reason to interfere with the order passed
\npassed by the Corporation and\/or to exercise discretion under Section
\n11-A of the Industrial Disputes Act.\n<\/p>\n
10.\tOn
\nperusal of the impugned Award and upon hearing Mr. Lakhani, learned
\nadvocate for the petitioner, this Court does not find any strong or
\nconvincing reason to interfere with the finding of the fact recorded
\nby the Labour Court and\/or to hold that the Labour Court has
\ncommitted any error of jurisdiction or law. It is not possible to
\nhold, upon examining the discussion in the impugned Award that
\nfinding recorded by the Labour Court are contrary to the evidence on
\nrecord or perverse. Hence, no ground for interfering with the Award
\nis made out. The petition therefore, fails and the same is
\naccordingly rejected. The petitioner to bear his costs.\n<\/p>\n
